BOROUGH OF BLAWNOX ORDINANCENO.635 AN ORDINANCE OF THE BOROUGH OF BLAWNOX, ALLEGHENY COUNTY, COMMONWIALTI OF PENNSYLVANIA, PURSUANT TO' TIL NIERCOVERNMENTAL COOPERATION ACT, AUTHORIZING AND ADOPTING AN INTERGOVERMMENTAL COOPERATION AGREEMENT WITH THE TOWNSHIP OF O'HARA FOR POLICE SERVICES AND PROVIDING FOR SEVERABILITY AND THE REPEAL OF PRIOR INCONSISTENT ORDINANCES. WHEREAS, the Borough of Blawnox and O'Hara Township have negotiated an Intergovernmenta. Cooperation. Agreement ("Agreement"), which is attached hereto as "Exhibit. A"andi is fully incorporated! herein as part ofthis Ordinance, and which regards the terms and conditions under which police services will be furnished by the Township of O'Hara to the Borough ofBlawnox for the period of January 1, 2025 through December 31, 2029 (subject to possible automatic renewal for 3-year terms thereafter), pursuant to the authority of the Intergovernmental Cooperation Act, 53 Pa.C.S.A. $ 2301, et seq., and; WHEREAS, the aforesaid Act provides that local governments may enter into intergovermmental cooperation with or delegate any functions, powers or responsibilities to another local government upon the passage of an ordinance or resolution by its governing body, (53: Pa.C.S.A. $ 2305), and; WHEREAS, the Township of O'Hara maintains a full-time police department, the individual members of which have received all of the requisite training, as required by statute, and possess the appropriate certifications, for protecting the health, safety, and welfare oft the citizens oft the Township of O'Hara and the Borough ofBlawnox, and; WHEREAS, the purpose and intent of the Agreement is for the Township of O'Hara to provide police protection and related services to thel Borough ofB Blawnox asi more: fully described in the Agreement, and to establish the costs and payments for such services as more: fully described in the. Agreement, and; WHEREAS, the Agreement between the Borgugh ofBlawnox and the' Township ofO'Hara, which isf fully incorporated herein as part of this Ordinance, provides for the duration of the Agreement, the conditions of agreement for cooperation between the Borough of] Blawnox and the Township of O'Hara, the purpose and objectives oft the. Agreement and the powers and scope of authority to be delegated, the manner and extent of financing the Agreement, the organizational structure necessary to implement the Agreement, and the manner in which real or personal property shall be acquired, managed, licensed or disposed of, among other necessary and proper provisions for the purpose of lawful and beneficial intergovernmental cooperation,a and; WHEREAS, the Agreement contains provisions regarding the employment of current Borough of Blawnox police officers by the Township of O'Hara, and the Borough recognizes that the Township of O'Hara and thel Negotiating Committee of the O'Hara' Township Police, Fraternal Order ofl Police, County of Allegheny Lodge No. 91 have negotiated the terms and conditions of employment for the Borough of Blawnox officers whov will become-Township of O'Hara employees (subjectt to thet terms ofal Memorandum ofUnderstanding executed between the' Township ofO'Hara and its police union), and; WHEREAS, the Borough of Blawnox and the Borough of Blawnox Police Department have entered into a Memorandum of Understanding setting forth their mutual understandings concerning the (DOeNo-0109240.1) Borough's exercise ofi its inherent managerial right to go out oft the business of providing police services through a Borough-operated police department and to contract for the provision of police services with the Township of O'Hara pursuant to the Agreement, and; WHEREAS, the Borough Council of the Borough of Blawnox believes that the approval of the NOW, THEREFORE, be it ordained and enacted by the Borough Council of the Borough of Section 1. The Intergovermmental. Cooperation Agreement ("Agreement") between the Borough of Blawnox and the Township of O'Hara, a true and correct copy of which is attached hereto as "Exhibit A"andi is fully incorporated! herein as part ofthis Ordinance, under which the Township pofO'Hara agrees, pursuant to certain terms and conditions contained within the Agreement, to provide police protection andi related services to the Borough ofl Blawnox, is hereby approved and adopted. The President ofBorough Council, thel Borough Manager and] Mayor are hereby authorized to execute the Agreement and all such documents necessary to effectuate same.. A copy ofsuch. The Agreement shall be effective January 1, 2025 and may be subject to possible automatic renewal for 3-year terms thereafter, pursuant to the terms and conditions contained within the Agreement. Section 3. Ifa final decision ofc a court of compctent jurisdiction holds any provision oft this Ordinance or the application of any provisions of this Ordinance to any circumstance to be illegal or unconstitutional, the other provisions of this Ordinance and the application of such provisions to other circumstances shall remain in full force and effect. The intention of the Borough Council of the Borough ofBlawnox is that the provisions ofthis Ordinance shall be severable and that this Ordinance would have been adopted ifa any such illegal or unconstitutional provisions had not been included. Section 4. All Ordinances of parts of Ordinances conflicting with the provisions of this Ordinance are hereby repealed to the extent ofsuch conflict. Section 5.
