BOROUGH OF BOYERTOWN, BERKS COUNTY, PENNSXLVANIA ORDINANCE NO. 2024- 0J AN ORDINANCE OF THE BOROUGH OF BOYERTOWN, BERKS COUNTY, PENNSYLVANIA, AMENDING THE CODE OF THE BOROUGH OF BOYERTOWIN, BY AMENDING CHAPTER 184 ENTITLED "VEHICLES AND TRAFFIC", ARTICLE II ENTITLED "PARKING REGULATIONS" BY ADDING A NEW SECTION 184-20.1, ENTITLED "PARKING PROHIBITED AT ALL TIMES; MOTOR CARRIER VEHICLES", TO AMEND THE PARKING REGULATIONS ORDINANCE TO PROHIBIT MOTOR CARRIER VEHICLES FROM PARKING ON. ALLSTREETS WITHINTHE BOROUGH. WHEREAS, the Borough of] Boyertown, Berks County, Pennsylvania ("Borough") is a political subdivision organized as al Borough in the Commonwealth ofPennsylvania; and WHEREAS, as a Borough the Borough ofBoyertown is governed by the Commonwealth of] Pennsylvania Borough Code, 8: Pa.C.S.A. $101 et. seq.; and WHEREAS, Section 1202(5) oft the Borough Code. of] Pennsylvania, 81 Pa.C.S.A. $1202(5), authorizes a Borough to make regulations that may bei necessary for thel health, safety, morals, gèneral welfare and cleanliness and' beauty, convenience, comfort and safety ofthe Borough; and WHEREAS, the. Borough of] Boyertown has experienced issues with motor carrier vehicles parking on the streets oft the Borough, which has disrupted traffic flow, created safety concerns, and disturbed neighbors; and WHEREAS, the Borough Council desires to amend the Code oft the Borough of Boyertown, Chapter 184 entitled "Vehicles and Traffiç" toj prohibit motor carrier vehicles from parking on all streets within the Borough. NOW THEREFORE, BE IT ENACTED AND ORDAINED, by the Borough Council oft the Borough of Boyertown, Berks County, Pennsylvania ("Borough") as follows: SECTION1. Chapter 184 of the Code of the Borough of Boyertown, entitled "Vehicles and Traffic", Article II entitled "Parking Regulations", Section 20 entitled "Parking Prohibited at. All Times" isl hereby amended to add ai new Section 20.1 to read ini its entirety as follows: $184-20.1, Parking Prohibited At All' Times; Motor Carrier Vehicles. A. Defimitions, For the purpose of this section, the following terms shall have the meanings set forth herein: a. "Motor carrier vehicle." Atruck, truck tractor, or combination: having a gross vehicle weight rating, gross combination weight rating, registered gross weight, registered combination weight, or actual gross weight of 17,001 ii. A truck, truck tractor, or combination engaged in interstate commerce and having a gross vehicle weight rating, gross combination weight rating, registered gross weight, registered combination weight, or actual gross weight of 10,001 pounds or pounds or more. more. B. Prohibition. No motor carrier vehicle, as defined in $184-20.1(A), shall be parked C. Penalties.. The provisions of this Ordinance are severable, and if any provision, section, sentence, clause, or part oft this Ordinance shall be held to be invalid, illegal, or unconstitutional by a court of compétent jurisdiction, such decision of the court shall not affect or impair the remaining provisions, sections, sentences, clauses, or parts ofthis Ordinance.
