These tax bills include $16,221.83 in interest. On behalf of United Fuels Rockingham LLC, we are respectfully asking that the Board of Commissioners release the interest portion of these bills. We understand that the taxes are due, however the amount of interest applied to these bills is especially burdensome at such a tough time for businesses due to COVID restrictions, etc. Thank youi for your consideration oft this matter. Please see attached information on a proposed settlement with QUICK CHEK reference county tax billing error. In a nut shell collection oft taxes are subject to a1 10 year statute of limitations meaning the statute ofl limitations limits forced collections to 10 year period but does not limit billing of same nor doesi it effect liens for those taxes. Iti is the opinion of city finance staff that this situation occurred due to a clerical error( (county has had property coded in the wrong fire district for the business personal property since 2007) which therefore did not include that billf for business personal property fort the city tax scroll. QUIK CHECK was apparently billed for and paid county fire taxes for that fire district during that period oft time. Int the proposed attached email agreement with QUIK CHECKIhave offered to recommend that city council fully waive the interest owed due to a clerical error (permissible under NCGS 105-381) with the understanding that QUIK CHECK will pay the full amount of taxes owed from 2007 to 2020 in the full amount of 23,631.35.. As noted in the email agreement QUIK CHECK's company president has consented to that agreement/payment. This settlement is fair and balanced in that the city will receive full payment for taxes owed fort the entire period 2007 to 2020 even though by law we could practically only collect 10 years and QUIK CHEK gets al break on being relieved ofi interest accrued due to a clerical error and neither party has to be adversarial to achieve an acceptable remedy. Apparently QUIK CHECK willl be entitled to a refund of county fire tax district taxes as well. Thisi item will be placed on. June 8, 2021 agenda just as presented in this email. We know of at least one other commercial property int the area with the same situation and we are in the process of notifying them. Inr my discussion with. Jeff Smart concerning this matterl - have asked him to: seek an internal review by the County Tax Office of Rockingham's tax! billing scroll to determine ift there are other properties not coded properly as well. In reviewing this situation with our legal team, we don't think we: should be responsible for 2009 taxes and interest due to the 10 year statute of limitation pursuant to Section 105-378. In addition, the legal team couldn't locate any specific language regarding being able to charge interest. Moreover, we don't feel we should be responsible for interest in general since we did noty voluntarily assume this obligation. Waffle House would've paid taxes timely "but for" the mistake of the County. With that being said, we would've paid the taxes for 2010-2020 sO we agree that we should be on the hook for those years but dispute the interest and tax year 2009. Thank you! Massey, Jr., Assistant City Manager Date: June 1, 2021 Re: Demolition Ordinance for Dilapidated Dwelling located at 914 Leak Street City staff recommends the City Council approve a demolition ordinance for the dilapidated dwelling located at 914 Leak Street and identified as Richmond County PIN 7473-13-13-7500. A copy of the demolition ordinance and photographs of the property are included in the agenda packet. As background information, City staff initiated minimum housing proceedings in Janyary of 2021. The property owner, Beulah C. McRae, and parties of interest were notified of a heaking with the Code Enforcement Officer regarding the condition oft the dwelling. The notice was sent via certified and regular mail; published in the Richmond County Daily Journal; and posted on the subject property. No one attended the hearing. The Code Enforcement Officer issued his findings of fact and directed the property owners to either repair or demolish the dwelling by May 11, 2021. Again, the notice was sent via certified and regular mail; published in the Richmond County Daily Journal; and posted on the subject property. The Building Inspector shall certify the remaining balance tot the Tax Collector. TAXES LEVIED. There is hereby levied the Ad Valorem tax rate of $.58 per $100 valuation of taxable property, as listed for taxes as of January 1, 2021, for the purpose of raising revenues to finance the foregoing appropriations. This tax rate is based upon an estimated total valuation of $691,291,941 (623,995,483 property and 67,296,458 auto) and an estimated collection of 99.38% for property and collection rate of Auto Tax in accordance with Statutory Authority. SECTION 4. SPECIAL AUTHORIZATION. The Budget Officer shall be authorized to reallocate departmental appropriations among the various line item expenditures of the department as said officer believes necessary. The Budget Officer shall be authorized to effect interdepartmental transfers, in the same fund, provided that no departmental budget shall be reduced by more than ten percent without the prior approval of the City Council. Any such transfers shall be reported to the City Council at its next regular meeting and shall be entered into the minutes. 29 Budget Ordinance 2021-2022 Page 6 SECTION 6. DISTRIBUTION. Copies of this Ordinance shall be furnished to the Finance Officer of the City of Rockingham to be kept by her for her direction in the disbursement of funds.
