Minutes oft the regular meeting of the Mayor and Board of Commissioners of the Town of Elkin, Present: Mayor Sam Bishop, Commissioners Cecily McCulloch, Robert Ball, Alvin Hayes, Jeff Eidson and Will Gwyn. Also present: Town Manager Brent Cornelison and' Town Clerk Darla Mayor Bishop welcomed everyone and called the meeting to order. He asked Police Chief Joey Parker. Vanhoy to lead our Pledge of Allegiance. Consent. Agenda Approve minutes of the August 12"h, 2024 Board of Commissioners meeting. Approve BA#2025-3 to appropriate GF Fund Balance to purchase new HVAC until for Approve BA#2025-4 to appropriate donations for downtown bucks' promotion payouts for Approve BA#2025-5 to appropriate fund balance for the purchase of land for the new fire Approve BA#2025-6 to appropriate GF fund balance to NC Department of Commerce Downtown Revitalization Project Fund for amphitheater project overages. / Approve BA#2025-7 to appropriate insurance proceeds check for police vehicle repairs. Hispanic Heritage Month Mayor Bishop read the Proclamation for Hispanic Heritage Month that runs from September 15th through October 15!h, and presented it to Mr. & Mrs. Tirzo Ortiz, valued citizens of the Town of Elkin and owners of the Hispanic 2. New Police Captain - Police Chief Joey Vanhoy introduced our newly promoted Police 3. Years of Service Recognition - Town Manager, Brent Cornelison recognized several employees for their years of service with the Town of Elkin. Michelle Wood of Public Works has 5 years of service, Police Officer Will Blackburn has 10 years of service, Police Captain Joey Johnson has 15 years of service and Randy Gilliam of Public Works has 20 years of service. Public Comments -none Mayor and Board Comments Commissioner Gwyn stated that it was good to see all of the years of service awards to some many employees. Public Hearing - Text Amendment of the Downtown Parking Ordinance Mayor Bishop opened the public hearing at 6:12 pm to discuss the recommended changes to the Downtown Parking Ordinance from the Main Street Advisory Board. Main Street Manager, Laura Gaylord presented the amended ordinance for approval. The 3-hour parking restrictions have imposed new civil penalties. The first offense violation will be considered a warning with no his promotion. fee. The 2nd offense is a written citation with a fee of $25.00. If this citation is not paid with 10 days, the civil penalty will increase to $50.00 and al boot may be placed on the offending vehicles tire, with a separate, additional cost of $50.00 to remove the boot. The new fees are the legally enforceable limit mandated by the State. Public Hearing - Rezoning of a partial of #4962411429 Elkin Wildlife Rd. Mayor Bishop opened the Public Hearing at 6:18 pm. Planner, Sarah Harris stated that a petition was submitted by Mr. Hugo Lopez, owner of Best Choice Metals, LLC to request a rezoning of a portion of his property that is currently zoned as LDR (low density residential to M2 (heavy manufacturing district). The Planning Board reviewed the request on August 26, 2024 and has made the recommendation that this application be approved. Mr. Lopez spoke to the BOC explaining that he would like to expand his business and this would not be possible if Having no further speakers, Mayor Bishop closed the public hearing at 6:20 pm. A motion was made by Commissioner McCulloch that the application is consistent with all oft the objectives and policies for growth and development contained in the Town of Elkin Land Use Plan. Public Hearing - Special Use Application - 150 Hendrix St. Duke Energy Planner, Sarah Harris stated that Duke Energy has applied for a special use permit to construct a new mono 165' tower. The property went through a variance request on April 24, 2023 regarding setbacks in Chapter 2.7. Supplemental Standards by Use, Section XX. Wireless Communication Towers. The Planning Board had approved the application on August 26, 2024 Mr. Remington Jackson, attorney for Duke Energy and Mr. Eric Dickerson of Engineering Tower Solutions was sworn in to give evidentiary facts for the special use application. "I am present to answer any questions that the BOC might have concerning the application. We believe we have satisfied all oft the requirements in conforming to the character of the neighborhood, not causing undue traffic congestion, adequate utilities, no noxious or offensive vibrations, noise, odor, dust, smoke or gas, etc. Iwill be glad to answer any questions that you may have." Commissioner Gwyn asked about the it being a mono pole? Sarah Harris stated that it resembles a flag pole. Commissioner Ball ask what evidence to you have that it will not impact surrounding property values? Because there is currently a pole already there and they are just replacing it, should not affect property values. Attorney Raymond Parker stated that was is currently there is al lattice type tower and the new mono tower will be a single pole and have a much smaller footprint. Commissioner Gwyn ask if there will be any light differences compared to the beacon on the existing tower? Regular Agenda Crater Park Project - Recreation and Parks Director Adam McComb and Town Manager Brent Cornelison have reviewed the contract bids for the Crater Park Project. The two areas that are already funded is the playground and the splashpad area and are within budget. The bids received on August 6th, 2024 were to finish the project including the bathrooms, sidewalks and the parking lot area. The bid from Garanco Construction came in at $487,950. J.G. Coram Construction came in at $628,877 and GL Wilson Construction was at $664,000 all with a $25,000 contingency. Using the lowest bid of $487,950 will still leave us with a $200,000 shortfall for the entire project which does not include a needed accessible swing set that would be an additional $35,878.00. If the Town pays for the project entirely it would lower the current fund balance from 5.6 million to 5.4 million. Since this is an accessibility grant we have accepted, we need toi finish the project completely stated Commissioner Eidson. After further discussion, Commissioner Eidson made a motion that the Town approve Garanco Construction's bid and award them the contract, pay the additional monies needed from fund balance and give Town Manager, Brent Cornelison authority to sign the contract. Commissioner McCulloch seconded the motion, and passed unanimously. Commissioner Eidson and G&B Energy will pay % of the cost of the accessibility swing set needed for the project. Commissions and Boards - None Manager Updates: Brent presented pictures of the Carlton building at the airport that is currently under renovation, Surry County Commissioner, Larry Johnson has requested a donation to this year's Special Olympic games.
