James Timmons With a quorum present, Mayor Eubankscalled the meeting to order at 6:30p.m followed by the Pledge of Allegiance and opening prayer. APPROVALOF AGENDA Council Member. Adams made al motion to approve the agenda, seconded by Mayor Pro' Tem Brown. The vote was unanimous. CITIZEN'S COMMENTS There were no citizen comments. PUBLIC HEARING- CONDITIONALI USE APPLICATION: 203 W RAILROADST.S Mayor. James Eubanks called the Public Hearing to order at 6:31 PM. Pelham Code Enforcement Officer James Timmons explained to the council that there were: 3 problems with the initial application that was submitted to the City. 1.Off Street Loading Area: Initially, the application lacked a designated off-street loading area, which posed potential logistical issues. This concern has been resolved, and appropriate off- street loading provisions have now been included int the plan. 2. 6-Inch Curbing on Jackson Street: The absence oft the required 6" curbing on Jackson Street was another issue. The applicant has made the necessary adjustments to install the required curbing, resolving this matter. 3. Parking Spaces for Quick- Service Retail (QSR): The number of parking spaces provided was considered insufficient based on an ordinance requirement. Because the plans did not meet the parking requirements outlined by the City Ordinançe the Mr. Timmons could not recommend approval of the application. The vote was unanimous. EMERGENCY DECLARATION Council Member Adams made a motion to adopt the emergency declaration ordinance, dispensing of the second reading, seconded by Council Member Davis. The vote was unanimous. Mayor Eubanks announced after the ordinance passed that the city would have a curfew from 9:00 pm on September 26" to 4:00 AM on September 27"in preparation of Hurricane Helene. ROAD CLOSURE- PELHAM WILDLIFE City Manager Drake presented proposed road closures for the annual Wildlife Festival and' Trunk or Mayor Pro' Tem Brownmade a motion to approve the road closures for the Wildlife Festival and the Treat. Trunk ori treat seconded by Council MemberDavis. .The vote was unanimous. SET MILAGE FOR 2024 Council Member Robinsonmade a motion to adopt ordinance No. 2024-9-26-1 adopting an ad valorem tax for 2024, dispensing of the second reading, seconded by Council Member Davis. The vote was unanimous. WA4TAXCOLLECTION CONTRACT Council Member Davis made a motion to approve the 2024 tax collection contract with the Mitchell County Board of Commissioners, seconded by Council Member Robinson.The vote was unanimous. Page/2 INVENTORYTAX EXEMPTION Council Member. Davis made: a motion to adopt a resolution establishing an inventory tax exemption for the city of Pelham, seconded by Council Member Shiver. The vote was unanimous. PURCHASE OF POLICE VEHICLE FROM SPLOST City Manager Drake requested approval to utilize Special Purpose Local Option Tax (SPLOST) funds to purchase a 2024 Dodge Ram truck with a vehicle package for the police department. The truck is priced Mayor Pro Tem Brown made a motion to utilize Special Purpose Local Option Tax (SPLOST) funds to purchase a 2024 Dodge Ram truck with a vehicle package for the police department, seconded by at $52,225.
