Thej purpose ofthe) Public Hearing is tol hear an appeal, per O.C.G.A. 36-66-4(g) and Sec. 27-8.1.10, pertaining to thel Planning Director's: assignment oft the principal activity, Addiction Treatment Facility Jeffery Hollaway presented opening remarks on behalf of the appellant, Embark Behavioral Health. His request was for planning commission to consider reclassifying the principal activity to Community Education or Addiction' Treatment Facility (limited). Either of these align! better with the actual activities of] Embark Health. They are pursuing a' "child care institute" license at the state and that license will not meet the criteria as described in Addiction Treatment Facility (extensive).. All of the medical aspects of Rebecca Mincey presented the following opening remarks for Lumpkin County. For each land use activity in) Lumpkin County, staffundergoes al land use approval permit process per Sec. 27-8.1.1. This begins with the determination oft thel Principal Activity oft the request. We ask applicants to submit land use inquiry forms describing their operations to assist with assigning al Principal Activity. Sec. 27-2.1.1.- General classification rules. While there are not principal activities for ALL situations, the code ofordinance accounts for this by stating in the event of conflicting interpretations, or uncertain references to aj particular use, the planning director will administratively assign uses to the most appropriate activity category. Robin Hall made ai motion to approve the appeal and modify the land use activity from Addiction Treatment Facility (extensive) to. Addiction Treatment Facility (limited), while also being subject to the performance standards of extensive: minimum 5 acres, 100' activity buffer, 100' building setback adjoining property, 50' building setback right of way, 150' partial screening.
