MINUTES OF SPECIAL-CALLED MEETING OF THE CITY COUNCIL SANFORD, NORTH CAROLINA The City Council met for a special-called Council meeting at the Sanford Municipal Center, 225 E. Weatherspoon Street, on Tuesday, October 1, 2024, at 1:00 p.m., in Council Chambers. Seconded by Council Member Williams, the motion carried unanimously. SPECIAL. AGENDA Proclamation October 9.2024 as Arbor Day in the City of Sanford (ExhibitA) Mayor Salmon read the proclamation and presented it to Historic Preservation Planner II Liz Whitmore, who spoke about the upcoming Arbor Day Celebration at Kiwanis Family Park, October 9, 2024. She commented that there will be approximately fifteen trees planted on public property for the City of Sanford's Sesquicentennial Celebration. Mrs. Whitmore also noted that the installation of the Pollinator Garden, previously scheduled for this weekend, has been rescheduled for October 14, 2024, due to the recent extensive rainfall. Special-Called City Council Meeting October 1,2024 NEW BUSINESS Festival (Exhibit B) Resolution in Support oft the Temporary Closure of Portions of Several Streets for the Trinity Fall Parks and Grounds Administrator Caroline Ratkus explained that this resolution provides Council Member Rhodes made a motion to approve the Resolution in Support of the Temporary Closure of Several Streets for the Trinity Fall Festival. Seconded by Mayor Pro Tem Resolution in Support oft the Temporary Closure of a Portion of Charlotte Avenue for the Sanford Parks and Ground Administrator Caroline Ratkus explained that this resolution provides details ofa a street closure for the Sanford Farmers' Market Holiday Market, on November 9, 2024. Council Member Dabbs made a motion to approve the Resolution in Support of the Temporary Closure of a Portion of Charlotte Avenue for the Sanford Farmer's Market Holiday Market. Seconded by Council Member Ferguson, the motion carried unanimously. Resolution in Support ofthe Temporary Closure ofa PortionofCarthage Street fort the Sunday with Parks and Grounds Administrator Caroline Ratkus explained that this resolution provides details of a street closure for the annual Sunday With Santa Tree and Train Lighting event on details ofs street closures on November 2, 2024, for the Trinity Fall Festival. Akinosho, the motion carried unanimously. Farmers' Market Holiday Market (Exhibit C) Santa Tree and Train Lighting (ExhibitI D) November 24, 2024. Council Member Rhodes made a motion to approve the Resolution in Support of the Temporary Closure of a Portion of Carthage Street for the Sunday with Santa Tree and Train Lighting. Seconded by Mayor Pro Tem Akinosho, the motion carried unanimously. Resolution in Support of the Temporary Closure of Portions of Several Streets for the Sanford Parks and Grounds Administrator Caroline Ratkus explained that this resolution provides Council Member Dabbs made a motion to approve the Resolution in Support of the Temporary Closure of Portions of Several Streets for the Sanford Christmas Parade on December 2,2024. Seconded by Council Member Rhodes, the motion carried unanimously. Resolution by the City Council ofthe City of Sanford - Acceptance of] Funding for Sanford Water Executive Director ofUtilities Paul Weeks reminded Council that we received an award of $115 million from the Division of Water Infrastructure for the Water Treatment Expansion Project. Mr. Weeks explained that oft the $115 million funding, 26 percent is in the form ofa grant and the remainder is an interest-free 30-year loan. The first stepi in requesting those funds is for Council to Christmas Parade (Exhibit E) details of street closures for the Christmas Parade on December 2, 2024. Filtration Facility (WFF) Expansion WIF-2025 (Exhibit F) approve this resolution of acceptance oft funding. 2 Special-Called City Council Meeting October 1,2024 Council Member Ferguson made ai motion to approve the Resolution by the City Council of the City of Sanford - Acceptance of Funding for Sanford WFF Expansion WIF-2025. Seconded Resolution for the Abandonment of Streets or Roads from the] North Carolina State Secondary Road Executive Director of Utilities Paul Weeks reminded everyone oft the short section ofroad located between City Hall and the Service Center, and explained that it is an extension of Third Street and it provides access to the City Hall campus. Third Street is al North Carolina Department of Transportation (NCDOT) maintained street, including the extension inside the City's campus. Along with the proposed City Hall annex building, the City plans to make improvements to the campus, as well as to this section of Third Street; however, in order to make improvements, the by Mayor Pro Tem Akinosho, the motion carried unanimously. System Third Street (SR 1515)(Exhibit G) City must own it and agree to maintain it. Council Member Rhodes made ai motion to approve the Resolution for the Abandonment of Streets from the North Carolian Secondary Road System - Third Street (SR 1515). Seconded by Petition Requesting Contiguous Voluntary Annexation by Pulte Home Company, LLC.of47.36 Long-Range Planning Administrator David Montgomery explained that Pulte Home Company, LLC, submitted a petition for annexation for the property shown on the attached Exhibit G. Mr. Montgomery reviewed information on the exhibit and noted that this property is currently in the extra-territorial jurisdiction (ETJ) and Council rezoned the property to Conditional Zoning in 2022. Mr. Montgomery noted that the date for the Public Hearing on the Question of Annexation Council Member Dabbs, the motion carried unanimously. +/- Acres should be fixed for October 15, 2024. Resolution Directing the Clerk to Investigate a Petition for Contiguous Annexation Council Member Dabbs made a motion to approve the Resolution Directing the Clerk tol Investigate a Petition for Contiguous Annexation under G.S. 160A-31. Seconded by Receive the Certificate of Sufficiency for Voluntary Contiguous Annexation (Exhibit City Clerk Bonnie Davis confirmed that the Certificate of Sufficiency for Voluntary Resolution Fixing Date of Public Hearing on Ouestion of Annexation Pursuant to G.S. Council Member Dabbs made a motion to approve the Resolution Fixing the Date of the Public Hearing on the Question of Annexation Pursuant to G.S. 160A-31 for October 15, 2024. Seconded by Council Member Ferguson, the motion carried under G.S. 160A-31 (Exhibit H) Council Member Williams, the motion carried unanimously. D Contiguous Annexation was valid. 160A-310 (ExhibitJ) unanimously. 3 Special-Called City Council Meeting October 1,2024 Ordinance Amending the Annual Operating Budget of the City of Sanford FY 2024-2025-Police Assistant City Manager Beth Kelly explained that this ordinance appropriates funds in the Council Member Taylor made a motion to approve the Ordinance Amending the Annual Operating Budget of the City of Sanford FY 2024-2025 - Police. Seconded by Council Member Ordinance Amending the Annual Operating Budget of the City of Sanford FY 2024-2025 - Water Assistant City Manager Beth Kelly explained that this ordinance appropriates funds in the Council Member Dabbs made a motion to approve the Ordinance Amending the Annual Operating Budget of the City of Sanford Water Filtration - Pittsboro. Seconded by Council Ordinance Amending the Annual Operating Budget ofthe City of Sanford FY 2024-2025 - Hearne Assistant City Manager Beth Kelly explained that this ordinance appropriates $684,150 in Council Member Dabbs made a motion to approve the Ordinance Amending the Annual Operating Budget of the City of Sanford FY 2024-2025 - Hearne Road Project - Pittsboro Service Area. Seconded by Mayor Pro Tem Akinosho, the motion carried unanimously. Capital Project Ordinance - Hearne Road Project, Pittsboro Service Area (Exhibit N) (Exhibit K) amount of$24,850 for replacing and installing a computer server. Buckels, the motion carried unanimously. Filtration Pittsboro (Exhibit L) amount of$110,317: for utility capital costs. Member Rhodes, the motion carried unanimously. Road Project, Pittsboro Service Area (Exhibit M) retained earnings for the Hearne Road Project, Pittsboro Service Area. Assistant City Manager Beth Kelly explained that this ordinançe sets the project up and Council Member Rhodes made. ai motion to approve the Capital Project Ordinance -Hearne Road Project, Pittsboro Service Area. Seconded by Council Member Dabbs, the motion carried Ordinance Amending the Annual Operating Budget of the City of Sanford FY 2024-2025- - Re- Assistant City Manager Beth Kelly explained that this ordinance re-appropriates funds to various departments for contracts and purchase orders that remained open at the end of the prior allows it to move: forward. unanimously. appropriations (Exhibit O) fiscal year on June 30, 2024. The subject property is owned by Janet Brown Warner and Preston D. Zoning Administrator David Montgomery reminded Council that the Planning Board met on September 17, 2024, after the public hearing and unanimously recommended by unanimous vote that Council approve the request detailed on Exhibit P. The Planning Board found that this request is consistent with the Plan Sanlee Long-Range Plan since it is listed as commercial use and it is reasonable and in the public interest. Vote to Approve a Statement on Long-Range Land Use Plan Consistency asi it] Relates Council Member Rhodes made a motion that the request is consistent with the Plan Sanlee Long Range Land Use Plan designations of Maker District because General Commercial (C-2) is listed as a proposed secondary land use and convenience retail is listed as a commercial use. Seconded by Council Member Ferguson, the motion carried Ordinance Amending the Official Zoning Map of the City of Sanford, North Carolina Council Member Dabbs made a motion to approve the proposed zoning map amendment because it would allow commercial development along: a main throughfare. Also, it is reasonable and in the public interest because the site has access to public water, and streets. Seconded by Council Member Rhodes, the motion carried tot this Zoning Map Amendment unanimously. (Exhibit Q) unanimously. Application by Peak Engineering & Design. LLC.tor rezone a vacant 0.64 acre +/-] lot with frontage on E. Seawell Street from General Commercial (C-2)to] Light Industrial (LI). The subject property iso owned by NC Industrial Holdings. LLC, and is identified as Lee County Tax Parcel 9651-79- Zoning Administrator Amy McNeill reminded Council that the Planning Board met after the public hearing on September 17, 2024, and unanimously voted to recommend that Council support the rezoning request detailed on Exhibit R, since they found that the request is consistent with the Plani Sanlee Long-Range Land Use Plan designation Maker District and that the request is 1013-00 as depicted on Tax Map 9651.07 (Exhibit R) reasonable and in the public interest. Vote to Approve a Statement on Long-Range Land Use Plan Consistency as it Relates Council Member Buckels made a motion that the zoning map amendment is consistent with the Plan Sanlee Long-range Land Use Plan designations of Maker District to this Zoning Map Amendment 5 Special-Called City Councill Meeting October 1, 2024 because Light Industrial is listed as both the current and propose primary zoning district. Seconded by Council Member Rhodes, the motion carried unanimously. Ordinance Amending the Official Zoning Map oft the City of Sanford, North Carolina Council Member Rhodes made a motion to approve the proposed zoning map amendment because it will allow commercial development along the main throughfare; also, itisr reasonable and in the public interest because the site has access toj public water, sewer and streets. Seconded by Mayor Pro Tem Akinosho, the motion carried (ExhibitS) unanimously. CASES FOR PUBLICHEARING There were no cases for public hearing. OTHER BUSINESS Council Member Rhodes acknowledged Deputy Fire Chief Ken Cotten (who recently retired) for his many years of service. She noted that more than 1,100 people attended the Liquid Pleasure Concert last week and encouraged everyone to attend the upcoming Streetfest event, which will include trolley transportation service this year from two nearby parking lots. Council Members expressed conçern for the residents in the Western part of the state, along with South Carolina, Georgia, and Florida and complimented the Financial Services staff on receiving the Certificate of Achievement for Excellence. City Manager Hegwer stated that Sanford has received and provided help from and to our neighbors during catastrophic events and will be considering how to help those ini the western part oft thes state. Mayor Salmon echoed Mr. Hegwer's comments and noted that it will take some time forthose communities to recover. She stressed that any efforts tol help the hurricane victims should be coordinated with organizations in Sanford.
