MINUTES REGULAR MEETING AUGUST 26, 2024 The City Council of the City of Navasota, Grimes County, Texas met at the City Council Chambers, Room No. 161, located at 200 E. McAlpine Street at 6:00 p.m., Navasota, Texas on the above date with the following being present: Bernie Gessner, Mayor Pro-Tem, Place # 1 Kenneth Stevens, City Councilmember, Place # 2 Josh M. Fultz, Counciimember, Place # 3 Bert Miller, Mayor, Place #4 4 James Harris, councimember, Place #5 Thus constituting a quorum. STAFFF PRESENT: Jason Weeks, City Manager; Susie M. Quarles, Dia Copeland and others. 1. Mayor Bert Miller called the meeting to order at 6:00 p.m. 2. Invocation was given by Rev. Betty Tomkins. The City Council, staff members and visitors then recited the Pledge of Allegiance to the American Flag 3. Remarks of visitors: Michael Medeiros addressed the City Council about enforcement of city ordinances in HOA's (Pecan Lakes Estates). His concerns Max Hill addressed the City Council about speed limit signs in Pecan Lakes Estates. He also mentioned that more police presence was needed. and the Texas Flag. are with tall grass and junk vehicles. 4. Staff report: (a)Michael Mize, Police Chief, introduced two new staff members: McKenzie Diggs, Animal Control Officer and Caitlyn Markantes, Communication (b)Jon MacKay, Graduate Engineer, gave an update on the CIP projects. (c) Councilmember James Harris said that he missed the last Airport Meeting SO d)Councimembers and staff informed the audience about upcoming events. 5. A public hearing was held regarding a conditional use permit application submitted by the City of Navasota for the property located at the Southwest corner of Farquhar & Holland Street, in Navasota, Grimes County, TX 77868, legally described as H&TC, Block 107, Lot 11, 12. The conditional use permit parking as a primary use, a conditional use listed under Article XIII CBD: Central Business District. Mayor Bert Miller opened the public hearing at 6:19 p.m. Citizen Dia Copeland spoke concerning lighting issues. With no other comments, Mayor Bert Miller closed the public hearing at 6:34 p.m. Councilmember Kenny Stevens moved to approve Ordinance No. 1050-24, with conditions, a conditional use permit application submitted by the City of Navasota for the property located at the Southwest corner of Farquhar & Holland Street, in Navasota, Grimes County, TX 77868, legally described as H&TC, Block 107, Lot 11, 12. The conditional use permit application requests to allow for parking as a primary use, a conditional use listed under Article XIII CBD: Central Business District, seconded by Mayor Pro-Tem Bernie Gessner. Legal Counsel asked Councimember Kenny Stevens if he meant to allow the exceptions to include non-rigid materials and he said yes. Councilmember Kenny Stevens moved to amend his motion to approve Ordinance No. 1050-24, to allow the exceptions to include non-rigid materials for the parking surface, a conditional use permit application submitted by the City of Navasota for the property located at the Southwest corner of Farquhar & Holland Street, in Navasota, Grimes County, TX 77868, legally described as H&TC, Block 107, Lot 11, 12. The conditional use permit application requests to allow for parking asa primary use, a conditional use listed under Article XIII CBD: Central Business District, seconded by Mayor Pro-Tem Bernie Gessner and with each Operator. Public Works Director Jennifer Reyna gave an update. application requests to allow for Councimember voting AYE, the motion carried. 6. A public hearing was held for the purpose of receiving public comment and testimony regarding a zoning amendment initiated by the City of Navasota for the purpose of prohibiting tobacco, hookah, & vapor retail stores, in Navasota, Grimes County, TX77868, The proposed zoning amendment amends Article IV A/O: Agriculture/Open Space District, Article V R-1A: High Density, Single Dwelling Unit, 7,000 Square Foot Lot, Residential District, Article VI R-1B: Medium Density, Single Dwelling Unit, Quarter Acre, Residential District, Article VII R-1C: Low Density, Single Dwelling Unit, 2 Acre Lot or Larger, Residential District, Article VIII R-2: Medium Density, Multi-Dwelling Unit, Residential District, Article IX R-3: High Density, Multi-Dwelling Unit, Residential District, Article X OD: Overlay District, Article XI B-1: General Business District, Article XII B-2: General Business District, Single Structures/Uses Over 50,000 SF, Article XIII CBD: Central Business District, Article XIV M-1: Light Industrial District, M-2: Heavy Industrial District, Article XVI PU: Public Use District, Article XVII Planned Unit Development (PUD) District, Article XXIV Definitions. Mayor Bert Miller opened the public hearing at 6:40 p.m. The following comments Police Chief Mike Mize read the stats for vape detection at NISD from April and May 2024. Citizen Michael Medeiros made a comment concerning tobacco products. He asked the City Council not to eliminate tobacco products. Citizen Deborah Richardson asked the City Council to eliminate all tobacco products from the ordinance. Citizen Alicia Rangel addressed the City Council about her concerns with minors getting a hold of these vape products. With no other comments from the public, Mayor Bert Miller closed the public hearing at 7:05 7. Councilmember Josh Fultz moved to approve BrooksWatson & Co., PLLC to perform the independent audit of financial statements of the City of Navasota for FY September 30, 2024, 2025, 2026, 2027 and 2028 with the option to extend this contract for two additional one-year terms, and other related services, seconded by Councimember Kenny Stevens and with each were made by staff and citizens: p.m. Councilmember voting AYE, the motion carried. 8. Mayor Pro-Tem Bernie Gessner moved to issue a request for proposals (RFP) for administrative services and request for qualifications (RFQ) for engineering services related to the Texas Community Development Block Grant Program for 2025/2026 Community Development Fund as administered by the Texas Department of Agriculture, seconded by Councilmember Josh Fultz and with each Councilmember voting AYE, the motion carried. 9. Mayor Pro-Tem Bernie Gessner moved to approve the interlocal agreement between the City and Navasota I.S.D., seconded by Councilmember Josh Fultz 10. Councilmember Josh Fultz moved to approve the interlocal agreement between the City and Grimes County regarding potential temporary jurisdiction of the Brosig Avenue bridge project, seconded by Mayor Pro-Tem Bernie Gessner and with each Councilmember voting AYE, the motion carried. 11. Councilmember Josh Fultz moved to approve the 2025 City of Navasota holiday calendar, seconded by Councilmember James Harris and with each 12. A brief workshop was held on the proposed annual FY 2024-2025 budget. and with each councilmember voting AYE, the motion carried. Councilmember voting aye, the motion carried. 13.
