MINUTES REGULAR MEETING SEPTEMBER 23, 2024 The City Council of the City of Navasota, Grimes County, Texas met at the City Council Chambers, Room No. 161, located at 200 E. McAlpine Street at 6:00 p.m., Navasota, Texas on the above date with the following being present: Bernie Gessner, Mayor Pro-Tem, Place #1 Kenneth Stevens, City Councilmember, Place #2 Josh M. Mayor Bert Miller called the meeting to order at 6:00 p.m. 2. Invocation was given by Councimember James Harris. The City Council, staff members and visitors then recited the Pledge of Allegiance to the American Flag and the Texas Flag. 3. Remarks of visitors: Citizen John Sanders addressed the City Council and thanked the Public Works Department for the work they did on the ditch near his house located at 113 Clayton Street. 4. Staff report: (a) Mayor Bert Miller proclaimed October 15, 2024 as "National Night Out". (b)City Manager Jason Weeks recognized the "City Slickers" Cook Off team for (c). Jon MacKay, Graduate Engineer, gave an update on the CIP projects. (d)There was not an update on Boards and Commissions. placing 2nd in the Bubba Can Cook-Off event. e)Counclmembers and staff informed the audience about upcoming events. 5.A A public hearing for the purpose of receiving public comments and testimony regarding a zoning change application submitted by CAJ Family Limited Partnership, for the purpose of developing an AutoZone, a retail sales use. The zoning change application requests change the zoning from Article VI R-1B: medium density, single dwelling unit, quarter acre, residential district with Article XOD: overlay district to Article XI B-1: General Business District with Article X OD: overlay district. The property affected is located at 1539 E Washington Ave, Navasota, TX 77868, legally described as. Jones, Block 1, Lot 3, (R25721). Mayor Bert Miller opened the public hearing at 6:19 p.m. Sally Matthews addressed the City Council and briefly went over the zoning change application that they submitted. The following individuals spoke against the zoning change at the location as submitted on the application: Kathy Wells, Elton & Rhonda Wilson, Judith LaFontaine, Marsha Wellman, Lisa Binford, Julie Barrett, Betsy Lehnert, Todd Wisner, Ricardo Rios, Julie Myers and Kimberly Hertan. The following people spoke in favor of the zoning change at the location presented: Sally Matthews, Todd Matthews, Marco Castaneda and Nancy Perry. With no other comments, Mayor Bert Miller close the public hearing at 7:04 p.m. Councimember Josh Fultz moved to deny Ordinance No. 1057-24, regarding a zoning change application submitted by CAJ Family Limited Partnership, for the purpose of developing an AutoZone, a retail sales use. Mayor Pro-Tem Bernie Gessner moved to approve Ordinance No. 1053-24, adopting the City of Navasota's budget for the fiscal year beginning October 1,2024, and ending September 30, 2025, seconded by Coundilmember Josh Fultz. The following votes were recorded by a voting AYE, the motion carried. show of hands: AYES: Mayor Bert Miller, Mayor Pro-Tem Bernie Gessner, Councilmember Josh Fultz, Councilmember Kenny Stevens and Councilmember James Harris. NAYS: ABSTAIN: Mayor Bert Miller announced that the motion carried. 7. Mayor Pro-Tem Bernie Gessner moved the property tax rate be increased by the adoption of a tax rate of 0.5078, which is effectively a 4.46 percent increase in the tax rate, and approve Ordinance No. 1054-24, establishing the tax rate of $0.5078 per $100 assessed valuation for fiscal year 2024-2025, seconded by Councilmember Josh Fultz. The following votes were recorded as follows by a show of hands: AYES: Mayor Bert Miller, Mayor Pro-Tem Bernie Gessner, Councilmember Josh Fultz, Councilmember Kenny Stevens and Councilmember James Harris. NAYS: ABSTAIN: 8. Councilmember Josh Fultz moved to approve Ordinance No. 1055- 24, amending the Code of Ordinances Appendix A "Fee Schedule", Article A13.000, adopting the revised sanitation rates for the City of Navasota, Texas with an effective date of February 1, 2025, seconded by Mayor Pro-Tem Bernie Gessner and with each Councilmember voting AYE, the motion carried. 9. Councilmember Kenny Stevens moved to approve Ordinance No. 1056-24, amending the Code of Ordinances Appendix A "Fee Schedule", Article A5.000, adopting the revised water, natural gas, and wastewater (sewer) monthly rates for the City of Navasota, Texas with an effective date of October 1, 2024, seconded by Mayor Pro-Tem Bernie Gessner and with each Councimember voting AYE, the motion 10. Mayor Pro-Tem Bernie Gessner moved to approve the Interlocal Agreement between the City of Navasota and Grimes County for fire protection in the unincorporated areas of Grimes County for FY 2024- 2025, seconded by Coundilmember Josh Fultz and with each Councilmember voting AYE, the motion carried. carried. 11. Councimember Josh Fultz moved to approve the contract between the City of Navasota and JC Sand Dirt and Construction Services LLC for the 2024 annual lawn care contract for an amount not to exceed $319, 843.00 for the base bid items, not to include Miller Park, seconded by Councimember James Harris and with each Councilmember voting AYE, the motion carried. 12. Mayor Bert Miller moved to approve Change Order No. 5 on the contract between the City of Navasota and Keischnick General Contractors in the amount of negative $31,085.30, seconded by Councilmember Kenny Stevens and with each Councimember voting 13. Councimember Josh Fultz moved to appoint Michael Dearing, Mark Frnka and Martha Newsome to the Airport Advisory Committee for a two-year term ending September 2026, seconded by Mayor Pro-Tem Bernie Gessner and with each Councimember voting AYE, the motion Councimember Kenny Stevens moved to appoint Nancy Vidotto, Alan Philips, Jennifer MacKay and Debra Fincher to the Board of Adjustments with a term ending September 2026, seconded by Councimember James Harris and with each Counciimember voting AYE, the motion carried. carried. Councilmember Josh Fultz moved to appoint Lucy Ybarra, Aaron Davis and Sherry Gillespie to the Navasota Economic Development Corporation with a term ending September 2026, seconded by Councilmember Kenny Stevens and with each Councilmember voting Councilmember Josh Fultz moved to appoint Michael Medeiros, Tiffany Woodard, Sierra Higginbotham, Malinda Jean Pimentel and Deborah Foutz to the Keep Navasota Beautiful Commission with a term ending September 2026, seconded by Councimember James Harris and with Mayor Pro-Tem Bernie Gessner moved to appoint Deborah McGregor, Robert Goldstein and Deborah Grimes to the Navasota Housing Authority with a term ending September 26, seconded by Councimember Kenny Stevens and with Councimember voting AYE, Councimember Kenny Stevens moved to appoint Barry Wade Colbert, Michele Steinhauser, DeeDee Setzer and George Taylor to the Parks and Recreation Board with a term ending September 2026, seconded by Mayor Pro-Tem Bernie Gessner and with each Councimember AYE, the motion carried. each Coundimember voting AYE, the motion carried. the motion carried. voting AYE, the motion carried.
