MINUTES REGULAR MEETING SEPTEMBER 9, 2024 The City Council of the City of Navasota, Grimes County, Texas met at the City Council Chambers, Room No. 161, located at 200 E. McAlpine Street at 6:00 p.m., Navasota, Texas on the above date with the following being present: Bernie Gessner, Mayor Pro-Tem, Place #1 Kenneth Stevens, City Councilmember, Place #2 Josh M. Fultz, Councilmember, Place #3 Bert Miller, Mayor, Place # 4 James Harris, Councilmember, Place #5 5 Thus constituting a quorum. STAFF PRESENT: Jason Weeks, City Manager; Susie M. Homeyer, City Secretary; Jennifer Reyna, Public Works Director; Cary Bovey, Legal Counsel; Jon Mackay, Graduate Engineer; Lupe Diosdado, Development Services Director; Kristin Gauthier, Assistant City Manager; Mike Mize, Police Chief; Jason Katkoski, Fire Chief/EMC; Michelle Savensky, Executive Administrative Assistant; Maribel Frank, Chief Financial Officer; Pat Gruner, Municipal Judge; and Heaven VISITORS: Connie Clements, Morgan Porter, Berry Colbert, Mac Vaughn, Betsy Lehnert, Dia Copeland, Michael Medeiros, Kathleen Dimmel, Edwin Smith and Diana Armstrong. THE ITEMS ON THE AGENDA WERE TAKEN UP IN DUE ORDER AS FOLLOWS: Dominguez, Accounting Manager. 1. Mayor Bert Miller called the meeting to order at 6:00 p.m. 2. Invocation was given by Pastor Mac Vaughn. The City Council, staff members and visitors then recited the Pledge of Allegiance to the American Flag and the Texas Flag. 3. Remarks of visitors: Received two requests that will speak on Agenda Item # 6. 4. Staff report: (a) Jon MacKay, Graduate Engineer, gave an update on the CIP projects. (b) There were not any Board and Commission updates; and (c) Councimembers and staff informed the audience about upcoming events. 5. Councimember Josh Fultz moved to approve a credit to Christian Community Services utility account, in the amount up to $200.00 per month, beginning October 1, 2024 and ending September 30, 2025, seconded by Mayor Pro-Tem Bernie Gessner. Mayor Bert Miller stated that he would like to see the credit go from $200.00 per month to $250.00 per month due to the increase ini families being served. Councilmember Josh Fultz amended his motion to approve a credit to Christian Community Services utility account, in the amount up to $250.00 per month, beginning October 1 2024 and ending September 30, 2025, seconded by Mayor Pro-Tem Bernie Gessner and with 6. A public hearing was held on the proposed FY 24-25 budget to receive public comments. Mayor Bert Miller opened the public hearing at 6:16 p.m. City Manager Jason Weeks briefly went over the budget, along with a power point presentation. Citizen Betsy Lehnert asked the City Council not to forget about the history of this town by focusing just on the downtown area. Keep the charm and history of the city. Preserve the Horlock House and quality of life. Citizen Dia Copeland addressed the City Council about the FY 24-25 Proposed Budget and stated that she felt the wish list was much bigger than the needs. She suggested cutting the budget by 15%. Councilmember Kenny Stevens moved that the City Manager revise the proposed budget by deleting the purchase of the high-water rescue vehicle for the Fire Department, and that the City Manager schedule adoption of the proposed budget for the September 23, 2024 City Council meeting, seconded by Councilmember Josh Fultz, and with each Coundilmember voting AYE, the motion carried. With no other comments from the public, Mayor Bert Miller announced that a public hearing will be held on September 23, 2024 at 6:00 p.m. in the City Council Chambers, located at: 200 E. McAlpine Street, Navasota, Texas 77868, to vote on the tax rate. Mayor Bert Miller 7. A public hearing was held on the proposal to adopt the tax rate for FY 2024-2025 and receive public comments. Mayor Bert Miller opened the public hearing at 7:03 p.m. Mayor Bert Miller announced that a vote on the tax rate will occur on September 23, 2024 at 6:00 p.m. in the City Council chambers located at 200 E. McAlpine Street, Navasota, Texas 77868. With no other comments, Mayor Bert Miller closed the public 8. A discussion was held on the Code of Ordinances, Appendix A, "Fee Schedule", Article A13.000, adopting the revised sanitation rates for the City of Navasota, Texas with an effective date of February 1, 2025; and amending the Code of Ordinances, Appendix A, "Fee Schedule", Article A5.000 adopting the revised water, gas, and sewer monthly rates for the City of Navasota, Texas with an effective date of October 1, 2024. Maribel Frank, Chief Financial Officer, briefly went over the proposed rate changes for FY 2024-2025. With no comments from the public, Mayor Bert Miller announced that a vote on the proposed changes to the Code of Ordinances, Appendix A," Fee Schedule" for FY 2024-2025 will take place on September 23, 2024 at 6:00 p.m. in the City Council Chambers located at 200 E. McAlpine, Navasota, Texas 77868. 10. Councilmember Josh Fultz moved to approve Ordinance No. 1052-24, relating to the rules and regulations; creating platting requirements; administration; providing for the making of deeds; establishing permits and fees, providing for grave sites and control of decorations and landscaping; creating a perpetual care fund; creating an endowment fund; and establishing general administration of the Oakland Cemetery, to include the additional wording of "Funeral Directors and their staff" added to Section 7- 2(a) Administration, seconded by Mayor Pro-Tem Bernie Gessner, and with each 11. Councilmember Josh Fultz moved to approve Ordinance No. 1051-24, a zoning amendment initiated by the City of Navasota for the purpose of prohibiting tobacco, hookah, & vapor retail stores, in Navasota, Grimes County, TX 77868, to include deleting the words "Second Reading"i in Section 19, seconded by Councilmember Kenny Stevens and with each Councilmember voting AYE, the motion carried. The proposed zoning amendment amends Article IV A/O: agricuiture/Open Space District, Article V R- 1A: High Density, Single Dwelling Unit, 7,000 Square Foot Lot, Residential District, Article VI R-1B: Medium Density, Single Dwelling Unit, Quarter Acre, Residential District, Article VII R-1C: Low Density, Single Dwelling Unit, 2 Acre Lot or Larger, Residential District, Article VIII R-2: Medium Density, Multi-Dwelling Unit, Residential District, Article IX R-3: High Density, Multi-Dwelling Unit, Residential District, Article X OD: Overlay District, Article XI B-1: General Business District, Article XII B-2: General Business District, Single Structures/Uses Over 50,000 SF, Article XIII CBD: Central Business District, Article XIV M-1: Light Industrial District, M-2: Heavy Industrial District, Article XVI PU: Public Use District, Article XVII Planned Unit Development 12. Mayor Bert Miller moved to appoint the following individuals to the Texas Municipal League Intergovernmental Risk Pool Board of Trustees Election for Places 11-14 for 2024, seconded by Councilmember Josh Fultz and with each Councimember voting Councilmember voting AYE, the motion carried.
