CALL TO ORDER, PLEDGE, AND INVOCATION  Mayor Jennifer McCoy called the meeting to order at 6:00 p.m.  Present: Mayor. Jennifer McCoy, Councilmember James Warren, Councilmember Randy McCoy, Councilmember Lucia Butler, Assistant City Secretary/Billing Clerk Sunshine Alcorta, Code Enforcement Tambra Farrell, and  citizens Traci Mersiovsky and Nicholas Hannah.  Absent: Councilmember Tammy Baughman and Mayor Pro Tem Chuck Conner.  The pledge of allegiance was followed byt the invocation given by Councilmember James Warren.  B. PUBLIC COMMENTS None REGULAR AGENDA  Discuss, Consider, and Possibly Take Action Regarding:  1. Canvass the Votes of the May 6th, 2023, General Election, and approving Ordinance 05152023 Canvassing The council reviewed the tally sheets from Early Voting and Election Day. Councilmember James Warren made a motion, seconded by Lucia Butler to accept the canvassing of the votes and to approve Ordinance 05152023 Canvassing the Election. All in favor, 2 "aye" Councilmember Randy McCoy abstained.  the Election. Administer the Oath of Office to New Council. Councilmembers Randy McCoy and James Warren.  Assistant City Secretary/Blling Clerk Sunshine Alcorta administers the Oath to Mayor. Jennifer McCoy and Mayor Jennifer McCoy nominated Councilmember James Warren. Councilmember Randy McCoy made a motion, seconded by Councilmember Lucia Butler, to appoint Councilmember James Warren as Mayor Pro Councilmember. James Warren made a motion, seconded by Councilmember Lucia Butler, to refund Nicolas  3. Appointment ofa Mayor Pro Tem for the City of Elkhart through Resolution.  Tem for 1 year term. All in favor, motion carried. 4. Hearing for Nicolas Hannah regarding the water bill.  Hannah in the amount of $159.40. All in favor, motion carried. Discuss options related to hiring process for the City Secretary position, interview potential candidates for Councilmember Lucia Butler made a motion, seconded by Councilmember James Warren, to move C51 to  same, and consider appointment of a City Secretary. after I1. All in favor, motion carried. PUBLIC WORKS REPORT.  Public Works Director Eric Clark reported: None. Code Enforcement Nikki Farrell reported:  D. MUNCIPAL COURT  1. There were two dogs' bites on Sunday, 1 adult and 1 child, by the same dog. Anderson County initially handled the call since it was over the weekend. Iwas contacted by the state that informed me that the city  should be handling this case since the county did not have any. jurisdiction. 2. The dogs are now quarantine at the Anderson County Animal Shelter until May 17, 2023. 4. Received a call that there was a dog dumped on Bedre Lane, no dog was located.  3. Shelter will return one of her dogs back on Wednesday.  E. MAYOR REPORT  Mayor McCoy reported: None. F. EMERGENCY MANAGEMENT REPORTS  Emergency Management Randy McCoy reported: None.  G. CLOSED SESSISION  6:36 p.m. Council convenes into Closed Session pursuant to Section 551.074 of the Texas Government Code 1. Discuss and take action if any, of employment, evaluation, reassignment, duties, discipline, or dismissal ofa public officer or employee; or to hear a complaint or charge against an officer or employee; including  regarding personnel matters as follows:  deliberation regarding thet following officers or employees.  City Secretary position  H. RECONVENE INTO REGULAR SESSION 7:19 p.m. Council reconvened into regular session.  Councilmember Randy McCoy made a motion, seconded by Councilmember James Warren, to take no action.
