This is an action to abate the existence of a public nuisance located within the City of Miami, Florida ("City"). 2. A description oft the property, a single-family residence that is the subject of this nuisance abatement action is as follows: 128NW77S7 Lot 9, Block 2, Phoenix Pk. Per Sec. 46-1 oft the Code oft the City ofl Miami, thel Property described in Paragraph 2i isa "public nuisance." The Property has been used on more than two occasions within a six- month period, as the site oft the unlawful sale, delivery, manufacture, or cultivation ofany controlled substance. 4. The following facts reasonably establish the existence of a public nuisance located within the City and attached is the affidavit of Commander Robert Laurenceau, City of Miami Police Department ("MPD"), Little Haiti Neighborhood. See Exhibit B. 5. The following are the required statutory violations: a. On March 19, 2024, Vice Intelligence and Narcotics Unit Detectives C. Nickerson (01-41515) and R. Perez (01-41343) met with a confidential informant (hereinafter "CI") and instructed him/her to purchase narcotics from 128 NW 77 ST (hereinafter Property"). The CI was searched by the Detectives for any contraband (including currency) and none were found. The CI was provided with $50 of official City of Miami funds to purchase fentanyl. The CI arrived at the Property, knocked on the front door and pressed the doorbell. Shortly thereafter, Enmanuel Estrada (hereinafter "Seller") opened the door and engaged in conversation with the CI. The CI advised he/she wanted $50 worth of fentanyl. The Seller directed the CI to the rear of the Property. The CI handed the Seller $50 in exchange for five (5) clear yellow tinted baggies of suspected fentanyl. The Seller also provided the CI with his phone number. After the transaction, the CI departed from the Property and handed Detective Perez the narcotics. The narcotics were impounded into property under City of Miami police case number 240319-0019167. See Exhibit C, pages 010-011. 1281 NW 77 ST, Miami, Florida NAB 24-03 Packet Pg. 5 2.1.a b. On March 21, 2024, Detective Nickerson and Detective Perez met with a CI and instructed him/her to purchase narcotics from the Property. The CI was searched by the Detectives for any contraband (including currency) and none were found. The CI was provided with $40 of official City of Miami funds to purchase fentanyl. As the CI arrived at the Property, he/she texted the Seller. The Seller told the CI to meet in the back of the Property. The Seller exited the rear door of the Property to conduct the narcotics transaction. The CI handed the Seller $40 in exchange for four (4) clear yellow tinted baggies of suspected fentanyl. After the transaction, the CI departed from the Property and handed Detective Perez the narcotics. The narcotics were impounded into property under City of Miami police case number 240321-0019766. See Exhibit C, pages 011-012. On April 3, 2024, the Special Investigation Section Narcotics Unit Detectives along with the assistance of the Miami SAWT team executed a narcotics search warrant on the Property (see Exhibit C pages 005-020) which resulted in the arrest Emmanuel Estrada (hereinafter referred to as "Estrada"). Estrada was arrested and charged with the following: possession with intent to sell fentanyl (2 counts), possession of fentanyl, unlawful use of communications device, possession with intent to sell fentanyl within 1000 feet of a school, armed possession with intent to sell fentanyl, armed possession with intent to sell fentanyl within 1000 feet ofa school, and possession of firearm by convicted felon (see Exhibit C pages 021- 031). During the course of the search the following contraband was recovered: . (30) baggies of suspected fentanyl (approximately 2.2 grams) ii. More specifically, "Your Affiant" has interviewed numerous persons arrested on narcotics charges and viewed many forms of narcotics, consisting of, but not limited to, cocaine, crack cocaine, heroin, ecstasy, marijuana and prescription narcotics as well as weapons and firearms violations. "Your Affiant's" training and experience has made him familiar with the manner in which narcotics, weapons and firearms are used, prepared, distributed, stored and sold in the South Florida area. Furthermore, "Your Affiant" has conducted numerous field interviews with gang and narcotic subjects that consist of identifying and recording any criminal gang affiliations, attributes, and related activity. "Your Affiant" is a sworn State Investigator as a member of the Miami- Dade Gang Strike force and Miami-Dade Homicide Task Force. Through field interviews, "Your Affiant" has gained experience in the identification of gang signs, tattoos, language, culture, and hierarchy. "Your Affiants" documentation of gang members and associates has been conducted pursuant to Chapter 874 of the Florida Statutes, also known as the Criminal Gang Enforcement and Prevention Statute. In his official capacity, "Your Affiant" became involved in an investigation documented under City of Miami Police case numbers: 240319-0019167 & 240321-0019766. Because this affidavit is being submitted for a limited purpose of establishing probable cause, "Your Affiant" has not included every aspect, fact, or detail of this investigation. The facts of said investigation are as follows: On Tuesday, March 19th,2024, Detective C. Nickerson (#01-41515) and "Your Affiant" met with the Confidential Informant (hereafter referred to as the C.I.) and instructed him/her to purchase narcotics from "The Premises". The C.I. is trusted and reliable. The C.I. was then given fifty dollars of official City ofMiami funds and was instructed toj purchase fentanyl. Detective C. Nickerson and "Your Affiant" arrived in the area of "The Premises" in an undercover vehicle, the C.I. exited the undercover vehicle and walked towards "The Premises". Upon approaching the "The Premises", the C.I. proceeded to knock on the front door and press the doorbell. Brieflya after, Enmanuel Estrada, DOB: 05/07/1989 (hereafter referred to as the Seller) opened the front door and engaged in a brief conversation. The C.I. advised the Seller that he/she wanted $50.00 worth of Fentanyl. The Seller then proceeded to direct the C.I. to thel back of"The Premises". Shortly thereafter the Seller exited through the rear door of"Thel Premises". The Seller then produced a baggie containing several smaller baggies of suspected Fentanyl. The C.I then handed the Seller $50.00 ofofficial City ofMiami funds and the Seller gave the C.I. five (5) clear yellow tinted baggies of suspected Fentanyl. The Seller also provided the C.I. with his phone number and advised the C.I. to call him whenever he/she was coming. The C.I. then departed' "The Premises", and returned to the undercover vehicle. "Your Affiant"then collected the narcotics from the C.I and checked the C.I. for additional narcotics or contraband and none were found. "Your Affiant" conducted a debriefing at the City of Miami Police Department. Upon concluding the debriefing, "Your Affiant" photographed and weighed the suspected narcotics. The narcotics were also tested via "TruNarc" which returned aj presumptive positive for Fentanyl. A request was made with the Miami Dade County lab to process the narcotics. The narcotics were subsequently turned into the City of Miami Police Department Property Unit by "Your Affiant" under City ofMiami Case # 240319-0019167. On Thursday, March 21st, 2024, Detective C. Nickerson (#01-41511) and "Your Affiant" met with the C.I. and instructed him/her toj purchase narcotics from The Premise. TheC.I. was searched by "Your Affiant" for any contraband, including money, and none were found. C.I. was then given forty dollars of official City of Miami funds and was instructed to purchase fentanyl. Affiant's Initials RP Page 7 Judge'sI Ex. The C.I. exited the undercover vehicle and walked towards "The Premises". As the C.I. was approaching, he/she proceeded to text the Seller to confirm to meet in the back and advise the Seller how much fentanyl was needed. The Seller texted the C.I. to meet him in thel back. The C.I. proceeded to the back of"Thel Premises" and observed the Seller exiting the rear doorof"The Premises". The C.I.I handed the Seller $40.00ofOfficial City ofMiami funds. The Seller then handed the C.I. four (4) clear yellow tinted baggies containing suspected. Fentanyl. The Seller then returned back into "The Premises", and the C.I. returned to the undercover vehicle. "Your Affiant" then collected the narcotics from the C.I. and checked the C.I. for additional narcotics or contraband. "Your Affiant" conducted a debriefing at the City of Miami Police Department. A request was made with the Miami Dade County lab to process the narcotics. USE OF DRONE SURVEILLANCE Section 934.50(2), Florida Statutes, defines a drone as a powered aerial vehicle that does not carry al human operator; uses aerodynamic force to provide vehicle life; can fly autonomously or be piloted remotely; can be expendable or recoverable; and can cany a lethal or nonlethal payload. Section 934.50(3), Florida Statutes, prohibits law enforcement from using a drone to gather evidence or other information without the issuance ofas search warrant. Your Affiant seeks authorization in this search warrant for use of a drone pursuant to Section 934.50(4), Florida Statutes. It is anticipated that prior to the actual execution of this warrant, a drone willl be utilized by a qualified remote pilot ofthe City ofMiami Police Department to conduct aerial surveillance ofthea above-described property to determinei ifany potential dangers exist to law enforcement, which includes the locations of any objects, structures, and/or barriers on the property not previously observed or visible through ground surveillance, and the presence ofany visible occupants at the Premises that are awake and/or have ready access to any items that Affiant's Initials RP Page 8 Judge's L Ex. Drone photography and/or motion video shall be focused on the aforementioned Premises; however, it is understood that, due to the nature of drones and imaging devices, incidental photographs and/or motion video may be captured of areas in the immediate surrounding area of the Premises, including areas that may be captured during the drone's takeoff location, flight path to or from the Premises, and landing location. Based on unforeseeable circumstances, including airspace restrictions and weather conditions, the exact takeofflanding location and flight route cannot be specified until aj pre-mission briefing. At the time the warrant was served an arrest was: made on thel Property ofaj person involved with narcotics related activities. CONCLISIONSOFLAW 1. Based upon the evidence presented at the hearing, the Property located at 128 NW 77 Street, Miami, Florida, constitutes: a drug relatedi nuisance at said location, in violation ofl Florida Statutes Chapter 893 and City of] Miami Ordinance 46-1(2) and (3). 2. The Board will exercise jurisdiction over this property for aj period of one (1) year, but only takei further action int the event ofa ai recurrence of the nuisance related activity. In the event that there are noi furthernuisance related activities, no sanctions will be assessed'against the Property. Defendant shall meet monthly with Commander Gabriel or another representative of the City of Miami Police to continue the development and implementation of aj property management plan to abate the nuisance activity on the Property. 3. Defendant shall commence the necessary steps to properly insure the property is not in violation of any local, municipal, and county regulations. 4. Property with the Crime Specialist. 5. Defendant shall take steps toj provide the necessary and adequate lighting to insure that thel Property remains lit. Specifically, thej perimeter oft the property, including thej parking area, must] have adequate lighting. In addition, Defendant, ifa applicable, shall contact the utility company to accommodate and arrange for: the current street lighting to remain operable; that any necessary additional lighting be implemented; and seek that the lighting be resistant to being vandalized with bullet fire and/or any other glass shattering device. 6. Thel Property does not have a "No Trespassing" sign posted and Defendant shall execute the associated "No Trespassing" Affidavit to empower the City of Miami Police or any/other law enforcement remoye person or persons from the Property after warning. In addition, Defendant shall post signage that the Property is being monitored by the Eity of Miami Police Department. Furthermore, Defendant shall maintain and continuously post that the Property is "Drug Free." 7.. Defendant shall provide al list of tenants/occupants who are: month-to-month, including the vehicle information andi names of authorized visitors fort these tenants, and/or copies of the leases for all occupied units. In addition, should Defendant provide written leases/agreements in the future, Defendant shall incorporate into the eases/agreements that any criminal activity including but notl limited to drug related activities by any tenant and/or its occupants shall result in an immediate termination of the lease/agreement andi removal oft the tenant and/ori its occupants. Furthermore, Defendant shall conduct criminal background checks on any new or prospective tenant and/or occupant and provide the background checks to Commander Gabriel or another representative of the City of Miami Police. The new and existing leases/agreements (or month-to-month tenant list) with names of all tenants and/or occupants or any persons routinely visiting thej property shall bei made available within fifteen (15)daysof thel hearing to Commander Gabriel or another representative of the City of Miami Police.
