Jason Burchard, Current' Trée Warden has worked oft the Town for many: years as the' Tree Warden and prior as a worker for the former. Tree Warden. His primary concern ist the shared road shoulder space. As his crew are out during storms or events they need to use of the shoulders for safety reasons, He feels anything private on the shared road shoulder that could damage equipment, tires or crew should not be allowed. He feels ai restriction prohibiting any items within the shared road shoulder would helpful, Councilor McHugh read Marjory O'Toole's comments and concerns. Noting her concerns of clutter on town property. She hoped only non-profits (opposed to for profit entities) could place signs with permission, limit time placement and number ofs signs allowed. It was confirmed with the Solicitor that no signage should bej put on State property without State approval, nor on Town property without Town permission. Roadways can have different widths and measurements. State maps and town surveys can confirm widths ifa question arises. The Tree Warden was informed that ifhe has a problem with debris or signage in the road shoulder he should contact the State for state roads and DPW,Administrator or the Building Official for town roads. The Planning Board did yoted that they did not see the need to amend the ordinances at this time. This vote was ini response to ai request from the Council to consider amending the towns sign ordinance. Some residents feel they need their comments to bel heard as they did not attend thei meeting of the Planning Board. Councilor McHugh felt the Board should have reviewed what was sent to them and commented on ift they were compliant with the' Town's Comprehensive Plan. Iriarte-Moore, voting in favor (Golembeske, Iriarte-Moore, McHugh) opposed (Mataronas): To request thel Planning Board consider four (4) specific actions suggested by Marjory O'Toolet to determine ift they are compliant with the' Town's Comprehensive Plan, listed as follows: 1) Can only non-profits be allowed toj place signs on1 town property? 2) Can a 2 week limit of the placement oft the signs be levied? 3) Can the number of signs allowed be limited? 4) Can the requirement that the signs be taken down within a certain: number of days after the event be levied? Aj presentation was made to the Council by Bart Fromuth, CEO ofFreedom Energy Logistics. He reviewed the benefits ofa Community Choice Aggregation Program. In short they offer, due to a recent change in State legislation, an opt-out program for the purchase ofe energy (electricity) to thel homeowners. No changes would occur to the billing and service process, simply who was acting as the deliverer oft the energy. Various questions were asked from both the Council and public. Jennifer Flather- - Is there ai town in RI of similar size to compare Little Compton with? No, existing in Massachusetts and New Hampshire, just signed on with Westerly, RI, but their agreement is not approved by RI Noted the Town itself is already in the RII League of Cities and Towns REAP program. Third-party delivery for Public Utilities Commission yet. savings. Maureen Rego - how many are needed to participate. The program is an opt-out program, theréfore ift the LC Council enters into this program all residents will automatically be opted-in and would reed to opt-out if they did not want to participate. The rate negotiated would remain constant even if5 50% of thè residents opted-out. There are no termination fees Victoria Talbot- is there at term length? That is dependent on the purchase of the energy and agreement Deliveryi is still remains as RI Energy. This program replaçes the commodity charge (electricity) the delivery and taxes remain the same. Ifa problem with billing occurs or à power outage occurs the resident still calls RI Energy. Councilor Mataronas is in an ekisting third-party program. He is worried that ift the Council votes to take on this program residents, especially seniors, may not notice the change and may not appreciate the Councils actions. Freedom Energy Logistics noted that they would do a campaign to notify the residents. Councilor Golembeske thought another preséntation with thé seniors at the community center might be beneficial. RESPONSE: Iti ist the opinion oft the Rhode Island Ethics Commission that the Petitioner, who has been offered the position of director ofthel Little Compton Department ofPublic Works, a municipal employee position, and who in his private capacity owns and operates a property management company for which he holds a trash hauler permit, collects trash for private clients, and disposes ofi it at the town's transfer station over which the Department of Public Works director has supervisory authority, may accept the director position and continue to dispose oft trash at the town's transfer The Petitioner is a resident of the Town of Little Compton who owns and operates Bodington Residential Services, Inc. (BRS), a private entity established in 2017 that provides property monitoring, maintenance, and management to Little Compton residents. He describes among the services provided by BRS the: following: home monitoring while homeowners are away, opening and closing homes whose owners reside seasonally in the town, performing minor home repairs, and waste collection and disposal. The Petitioner states that the town does not provide municipal waste collection for its residents; thus, residents may bring their trash to the town transfer station personally or hire someone to do SO. Thel Petitioner clarifiest that he only performs waste collection for his private clients and that he does not have a contract with the town for waste collection. The Petitioner explains that BRS provides waste collection three times per week during the summer months, and two half days per week during the winter months. The Petitioner notes that although he sometimes hauls waste for his] private company, his son-in-law is the one who mainly performs The Petitioner represents that to use the transfer station, residents are required to obtain a sticker for waste disposal issued by the town clerk upon showing of proof of residency, vehicle registration, and then payment of an annual fee established by the town council. Rhode Island Ethics Commission Advisory Opinion No. 2024-29 further represents that as a business providing waste collection services, he is required to obtain a trash hauler permit from the town council on an annual basis. He explains that this is achieved by submitting a letter requesting the issuance of such permit, providing proof of vehicle registration and insurance, and then paying an annual fee tot the town. The Petitioner states that the permit is then issued by the town clerk. The Petitioner further states that anyone can obtain al hauler permit, that there is no cap on the number ofhauler permits issued by the town, and that currently there is one other company that also provides trash collection toi residents ofthet town. Thel Petitioner notes that only trash generated in the town can be disposed ofi in the town transfer station and that there are certain requirements relative to the separation of the various types of trash that must be The Petitioner: represents that he responded to an advertisement by the town soliciting applications for part-time employment in the position of director of the Little Compton Department of] Public Works (DPW). He explains that he was interviewed during a town council meeting by the town council, the town administrator, and the town clerk. The Petitioner states that he was offered the position pending receipt of an advisory opinion from thel Ethics Commission regarding whether he may accept the position without running afoul of the provisions oft the Code of Ethics, given that The Petitioner represents that the DPW director is appointed by the town council and that the position is subordinate to the town administrator, carries flexible work hours, and requires a 20- hour work week. He further represents that the DPW director's duties include oversight and maintenance of town streets, roads and highways, snowplowing of municipal properties, maintenance of school and town buildings, and performance of the duties of a tree warden. The Petitioner states that a minor part oft the responsibilities of the DPW director includes oversight of the transfer station, management of its day-to-day operations, conducting a risk management assessment, and supervision oft the employees oft the transfer station. The Petitioner explains that the DPW director oversees four department employees, one ofwhom is part-time employee who works solely at the transfer station. The Petitioner clarifies that the other three are full-time employees, two ofv whom work at the transfer station when needed and a third who does not have any responsibilities relative to the transfer station.
