Resolution No. 2024-10-07-001 Aurora, NC to Agape Health Services Authorizing Transfer of County-owned Real Property Located at 151 Third Street, WHEREAS, Beaufort County owns certain real property, including land and a building, located at 151 Third Street, Aurora, NC that was formerly a medical clinic operated by ECU Health, and; WHEREAS, in. January 2023, ECUHealth announced it was closing the facility duet too cost-saving WHEREAS, Beaufort County is now partnering with Agape Health Services, a nonprofit 501(C)G)Federally Qualified Health Center, to reestablish aj primary care facility at the site, and; WHEREAS, the Property, shown on the survey titled "A Subdivision Survey for: Beaufort County" and surveyed by Sorrell Land Surveying, Inc. on September 23, 2024, will bet transferred to Agape Health Services by the County sO that Agape Health Services can provide direct primary and preventative medicine, dental, pharmacy, and behavioral health services to the population of WHEREAS, NCGS 160A-279 reads, "Whenever a city or county is authorized to appropriate funds to any public or private entity which carries out aj public purpose, the city or county may, in lieu of or in addition to the appropriation of funds, convey by private sale to such an entity any real or personal property which it owns; provided no property acquired by the exercise of eminent domain may be conveyed under this section; provided that no such conveyance may be made for WHEREAS, the Property was not acquired by eminent domain and the County currently appropriates funding to. Agape Health Services to support its public purpose, and; WHEREAS,ti is not always constitutionally necessary that a local government receive monetary consideration when it conveys property because. Brumley V. Baxter, 225NC 691 (1945) provides thatifap partyreceiving the property agrees toj put it toj public use, the promise constitutes sufficient WHEREAS, NCGS 160A-279 further reads, "The city or county shall attach to any such conveyance covenants or conditions which assure that the property will be put to aj public use by WHEREAS, the County attaches the following condition on the conveyance of the Property: measures, and; this area and; afor-profit corporation", and; consideration for the conveyance, and; the recipient entity", and; 1. The Property will be used by Agape Health Services to provide direct primary and preventative medicine, dental, pharmacy, and behavioral health services to the population ofthe area, and; WHEREAS, ifthe above condition oft the conveyance is not met within three years, the Property and all improvements to the Property will revert to the County ofBeaufort with this being clearly NOW, THEREFORE, BE IT RESOLVED, that the Board of Commissioner, in a regular meeting on October 7, 2024, authorizes the transfer ofCounty-owned real property located at 151 Third Street, Aurora, NC, and shown on the survey titled "A Subdivision Survey for: Beaufort County" and surveyed by Sorrell Land Surveying, Inc. on September 23, 2024, to Agape Health Services for the expressed public purpose of operating a facility to provide direct primary and preventative: medicine, dental, pharmacy, and behavioral health services, with the above described understood and agreed to by Agapel Health Services. condition and reversion requirements.
