Background: Request for Right-of-way Abandonment: Phil Patterson has requested the abandonment of the 60-foot wide right-of-way located between River Road and US Highway 220 adjacent to property at 215 River On May 3, 2022, Phil Patterson submitted a written request for the City Council to abandon the 60-foot wide right-of-way located between River Road and US Highway 220 adjacent to property at 215 River Road. The right-of-way is a remnant portion of the River Road right-of-way left over from the realignment of River Road with Midway Road during the construction of the interchange of US Highway 220 with Midway Road. The right-of-way is 601 feet in width and approximately 200 feet in length. Staff Comments: agenda packet. 1. A map illustrating the location of the right-of-way requested for abandonment is included in the 2. The subject right-of-way is a former NCDOT right-of-way. As indicated by the email correspondence from Matthew Kitchen, NCDOT District Engineer, included in the agenda packet, NCDOT officially abandoned maintenance of the right-of-way and has no interest in the property. Pursuant to NCGS 160A-299, the City Council must take action to officially close and abandon the right-of-way. This action is required by City Council even for those rights-of-way abandoned by NCDOT. 3. Pursuant to NCGS 160A-299, the right-of-way would be divided equally between all adjoining property owners if abandoned by the City Council. Staff Recommendation: of-way as requested. City staff recommends the Board review the request and recommend the City Council abandon the right- Planning Board Recommendation: The Planning Board reviewed the request at their June 7, 2022 meeting and recommended unanimously the City Council abandon the subject right-of-way as requested. 9 NORTH CAROLINA RICHMOND COUNTY RESOLUTION RESOLUTION CLOSING AN UNIMPROVED, 60-FOOT WIDE RIGHT-OF-WAY LOCATED BETWEEN RIVER ROAD AND US HIGHWAY 220 ADJACENT TO PROPERTY AT: 215 RIVER WHEREAS, on the 12th day of July, 2022, the City Council oft the City of Rockingham directed the A RESOLUTION DECLARING THE INTENTION OF THE ROCKINGHAM CITY COUNCIL TO CONSIDER THE ABANDONMENT OF THE UNIMPROVED 60-FOOT WIDE RIGHT-OF- WAY LOCATED BETWEEN RIVER ROAD AND US HIGHWAY 220 ADJACENT TO WHEREAS, the City Council, on the 12th day of February 2022, ordered the City Clerk to send written notification to all persons owning property abutting on the unimproved right-of-way to be closed WHEREAS, the City Clerk has advised the City Council that a notice was sent to each of the said abutting property owners, advising them of the day, time and place of meeting, and that the question as to the closing of said portion of the unimproved right-of-way hereinafter described would be acted upon; ROAD City Clerk to publish the following resolution entitled: PROPERTY AT 215 RIVER ROAD; and hereafter described; and and WHEREAS, the City Clerk has advised the City Council that none of the letters sO sent have been WHEREAS, after full and complete consideration oft the matter, and after having granted full and complete opportunity for all interested persons to appear and register any objections that they might WHEREAS, it now appears to the satisfaction of the City Council that the closing of said portion of the unimproved right-of-way is not contrary to the public interest and that no individual owning property, either abutting said portion of the unimproved right-of-way or in the vicinity of said portion of the unimproved right-of-way will as a result of said closing be thereby deprived of reasonable means of returned undelivered; and have with respect tot the closing of said portion of the unimproved right-of-way; and ingress and egress tol his property; and 10 WHEREAS, it appears to the satisfaction of the City Council that the closing of said portion of NOW THEREFORE, BE IT RESOLVED, by the City Council of Rockingham, North Carolina, meeting in a regular session, that the unimproved right-of-way specifically described as a 60 feet wide and 200 feet in length extending between River Road and US Highway 220 and illustrated on the attached map is hereby ordered closed, subject to the reservation of any easements to the City of Rockingham for utility purposes, and interest is hereby released and quitclaim to the abutting property the unimproved right-of-way will be in the public interest; owners under the provisions of North Carolina Statute 160A-299. Flag Football - This is a new program for the department and registration has been encouraging for a summer football league. Currently, we have over 75 participants registered to play and we should begin league practices and games Dental Awareness Week - Our Pool Director, Johnnie Brigman, is a licensed Dental ygienist/Instructor and employed full-time with our state. She, and a few of her colleagues, will be offering a free Dental screening and sealant procedure to our day camp and swim program children. July 13th-21*. Approximately 70 the middle of this month. children have registered for this special offering. Youth Baseball/Softball - Both of these programs concluded on Thursday, June 30th. Our new format of more games and less practices worked out well and both participants and parents seemed to enjoy the season. Summer Programs - Our Summer Day Camp and Swim Programs are progressing nicely. The seasonal staff is experienced and the campers are always busy and engaging in some activity. Both these programs have experienced 25-30% increases in enrollment. Hinson Lake - This remains a very popular destination and serves a diverse section of our city and county residents. Every weekend is reserved through the first weekend in December.
