WHEREAS, Pursuant to the provisions ofPennsylvaniaAct179of1984 the County is eligible to apply for and receive Community Development Block Grant funds from the Commonwealth ofPennsylvania, Department of Community and Economic Development with said funds to bused to assist the "non entitlement municipalities within the County, to undertake housing and community development projects, which primarily benefit persons oflow-to- moderate income; and WHEREAS, the County hereby requests the Authority to act as the representative of the County in all matters pertaining to the implementation of the subject Program; and the Authority agrees to assume that role on behalf of the County, and to administer, manage, and implement this Program on behalf oft the County in accordance with all applicable federal and state laws and regulations; NOW, THEREFORE, in consideration of the mutual covenants herein contained and of the benefits to accrue to the County as a result of the Authority's developing and undertaking the Program in accordance with applicable requirements and procedures, the parties hereto do mutually agree to the following: 1)The Authority hereby assures the Commonwealth of Pennsylvania and the Secretary of the Department of Community and Economic Development that, all funding approved by the Department for the Program will be awarded to eligible activities and beneficiaries within Susquehanna County with consideration to and in accordance with the Civil Rights Actof1964, as amended; Fair Housing Law and the Fair Housing Amendments Act of1988. This Agreement is executed in association with Susquehanna County Commissioner's proposed Bridge Replacement Project, hereinafter referred to as the Project". WITNESSETH THAT: WHEREAS, the Susquehanna County Redevelopment Authority, proposes to undertake the Forks Hills Road over Silver Lake Creek and Salt Springs Road over Siler Lake Creek Bridge Replacement Programs on behalf of Susquehanna County Commissioners, and; WHEREAS, the Pennsylvania Department ofTransportation recommends the Borough enter intoa Cooperation Agreement with the Authority, which defines the obligations of the Borough and the Authority with regard to the Program; and and undertake the Project; and WHEREAS, the Authority with the cooperation oft the Local Governing Body will develop WHEREAS, the Local Governing Body will provide aid to and cooperate with the Authority to facilitate the proper completion oft the Project; and WHEREAS, the Authority will make application to the Department on behalf ofthe Local Governing Body for funding for said Project; and pursuant to such application, the.
