Taylor Borough Council Meeting Minutes September 11,2024 The Taylor Borough Council held its regular monthly meeting on Wednesday, September 11, 2024, at 7:00 P.M. at the Taylor Municipal Building, 122 Union Street, Taylor, Pennsylvania. President Mickavicz chaired the meeting. President Mickavicz opened the meeting with the Pledge of Allegiance. On Roll Call: Councilman Fox, Yes; Councilman Maldonato, yes; Councilman McKeel, Absent; Councilman Nezlo, Yes; Councilman Digwood, Yes; Councilman DeAngelo, Yes; President Mickavicz, Yes; Mayor Kavulich, Yes President Mickavicz asked if anyone from the public had any comment or input on any agenda item, ifr none, you will always be given the opportunity at the conclusion to state any matters pertaining to Taylor Borough. Peg Derenick made ac comment regarding the Splash pad that was supposed to be created in Taylor. President Mickavicz stated that because there is one at McDade Park, its very close to Taylor also, the liability that comes with it. Peg Derenick requested that the money be used for the children ofTaylor and ift the names oft the people that donated to be mentioned. President Mickaviczaskedif'Council read thei minutes. Councilman Digwood made amotion. Seconded by Councilman DeAngelo. A voice vote was called, and all Council Members were in favor and the motion was accepted. Item A is to consider a motion to approve partial payment of $98,928.51 to D&M Construction for the DPW Garage doors. Remaining balance of $31,071.49. Councilman Maldonato made a motion. Seconded by Councilman Fox. A voice vote was called, and all Council Members were in favor and the motion was accepted. Item B is to consider a motion to approve the 2025 Uniform Minimum Municipal Obligation (MMO) in the amount of $299,138.00. Councilman Maldonato made a motion, and second by Councilman Fox. A voice vote was called, and all Council Members were in favor and the motion was accepted. Item C is to consider a motion to approve the 2025 Non-Uniform Minimum Municipal Obligation (MMO) in the amount of $46,878.62. Can I get a motion to adapt Item C. Councilman DeAngelo made a motion, and second by Councilman Maldonado. A voice vote was called, and all Council Members were in favor and the motion was accepted. Item D is to consider a motion to ratify the release of the Financial Security Bond Number BX20895R2MB, the Developer Taylor 1 LLC, however the Developer remains liable for the completion ofany uncompleted items. Repealing Resolution 9of2024 for the release of the security of a Maintenance Bond in the amount of $56,053.00 to Taylor 1 LLC which expires on September 1, 2024. Conditioned upon the occurrence of the Borough Engineer. Councilman Maldonato made a motion, and second by Councilman Fox. A voice vote was called, and all Council Members were in favor and the motion was accepted. Item E is to consider a motion to approve a proposal of $4,500.00 from Bowen Enterprises to add an inlet and pipe to the existing outfall on E. Prince Street. Councilman DeAngelo made a motion, and second by Councilman Digwood. A voice vote was called, all Council Members were in favor and the motion was accepted. Item F is to consider a motion ratifying and authorizing the appropriate Borough Official(s) to execute any required paperwork to transfer ownership of] Patrolman Stephen A. Derenick issued Service Weapon: Sig Sauer, Model-P220 Serial #G194379 to him as per Article XI, 4, Subsection 5 oft the' TPOA-CBA. Councilman Maldonato made a motion and seconded by Councilman Fox. A voice vote was called, and all Council Members were in favor and the motion was accepted. 2 Item Gi is to consider a motion to authorize the solicitor to research and prepare any necessary documentation to establish a curfew for the Taylor Memorial Cemetery. Councilman DeAngelo made a motion and seconded by Councilman Nezlo. Av voice vote was called, and all Council Members were in favor and the motion was accepted. Item His to consider a motion to approve the purchase of all 10 tires for the DPW Packer Truck from Kost Tire & Auto in the amount of $3,052.38. Councilman Digwood made a motion and seconded by Councilman Fox. A voice vote was called, and all Council Members were in favor and the motion was accepted. Item Ii is to consider a motion to approve Resolution No.11 of 2024 to apply for the LSA Grant from DCED in the amount of$100,000.00 for repairs and improvement to the Taylor Cemetery. Councilman DeAngelo made a motion and seconded by Councilman Nezlo. A voice vote was called, and all Council Members were in favor and the motion was accepted. Item Jis to consider a motion to approve a purchase order in the amount of $54,992.00 for the purchase ofa 2024 Chevrolet Tahoe 4WD. Costars#13-B22- 232 from Chapman Auto Group Fleet and Government Sales. Councilman Maldonato made a motion and seconded by Councilman Fox. A voice vote was called, and all Council Members were in favor and the motion accepted. Item K is to consider4 a motion to ratify the resignation of Stephen A. Derenick effective. August 28, 2024. Councilman Maldonato made a motion and seconded by Councilman Fox. A voice vote was called, and all Council Members were in favor and the motion accepted. Item Lis to consider a motion to accept the only bid of $43,500.00 from G-Mek Plumbing, Heating and Air Conditioning for a 2018 Ford F-350 Super Duty: 6.2 liter, V8, Automatic, 4WD w/Police upfit package; 4,146 miles, Mint Condition. This was discussed by not in detail, this was previously put up for bid, this is the second time, ironically Cindy received a call from Archbald Borough who is interested. President Mickavicz spoke to the Borough Manager, they maybe interested, their work session is tonight and I did reminded him, that ift they bought this vehicle that with the specs in it, it's worth about $115,000.00 that if 3 we: reject this bid tonight and ifthey felt they wanted to put in a reasonable offer, they can without the bid process, because they are another municipality. Under the bid requirements in Pennsylvania. Theriology we can give it to another Municipality because it's from one taxpayer to another. With that being said, the Chair would like to make a motion to accept or reject the bid. Councilman Digwood made a motion to reject and seconded by Councilman DeAngelo. There were 19 traffic crashes investigated; 165 Traffic Stops were made; and 96 traffic citations were also issued 2 non-traffic citations. Officers made 15 criminal arrests. Arrest Report's - Officer Boback 1 arrest; Officer Graham - 3 arrest; Officer Kowanick - 1 arrest; Sergeant Snyder - 6 arrests; Officer McDonald - 2 arrests; Officer Palonis - 1 arrest; Officer Palauskas -1 arrest; Officer Baizan - 1 arrest: Total 16 Revenues received for the month of August 2024, Parking Tickets: $40.00, Police Reports: $255.00, Magistrate Fines $3,363.51,Judicial Fines $543.39. Total $4,201.90. Next, President Mickavicz asked that the Mayor's Report for the month of August 2024 be placed on file. 6 President Mickavicz asked the Mayor for a reminder, when the National Night out is, October 5th, 2024, from 4:00pm to 6:00pm. Please make sure it's on our Facebook and Website. Then President Mickavicz asked ift the public had anything to say. Peg Derenick, Il live at 510S S. Main Street, in Taylor. She is here this evening on behalfofthe residents ofW. Atherton Street and surrounding areas of W. Atherton Street in the Borough ofTaylor. This is regarding a vicious dog owned by Mr. William Greco of216 W.Atherton Street. Ihave given you a petition, I gave it to Bill (Attorney. William Jones, Solicitor) we have collected 53 names for the Petition. Ialso have looked up the law regarding dangerous animals which is PA Statute 3P.S. 405-ET.SEQ. We feel this dog is a danger to the residents and taxpayers of West Atherton Street. Bill Greco who is an occupant of216 W. Atherton Street has a Pit Bull dog. The pit bull broke from the chain and went after her son-in-law and dog. Peg'ss son-in-law was walking her dog Molly on her usual route. Peg heard her dog yelp and went running out. The pit bull had the whole back end ofMolly in his mouth. Ray Malinaro, (son-in-law) started pounding on the dog, as a result he was bitten in the hand, arm and the back ofhis leg. All the neighbors heard the noise and came to the home to help. The police were contacted and did arrive. He could not produce any inoculation records of the dog and police did not pursue the issue of shots. Peg asked what could be done, and they (police) told her to walk a different route. So, nothing was done. Since no records for the dog, her son-in-law had to get a series ofrabies shots. The strain this has been on her family and the neighborhood is extreme. The least that could have been done was to quarantine the dog. The entire neighborhood is in fear ofthis dog. They don't feel safe, and they carry mace. This is a big danger to kids walking to school as well. Ifnothing is done my next stop is the SPCA to see ifthey can do something. Neighbors have seen Mr. Greco hit the dog with a shovel. Some people did not sign the petition for fear ofretaliation. Everyone is afraid oft this dog. President Mickavicz asked ifhis family signed the petition. Peg stated no. Ifthey did, he would have to recuse from talking. Since they did not, he can respond. The council fully supports this petition. Bill (solicitor William Jones) what can we do. 7 The solicitor stated, the short answer under the State Law, the dog warden or the police can file a complaint with the magistrate, the magistrate will then have a full hearing on it and evidence will get filed. I'm going to turn this over to the Chief and hel has already advised the dog warden. He will participate in this as well as the Chief, because they can file a complaint. At this type ofhearing, we want to make sure we. have all the facts and evidence, SO everyone gets a fair hearing. Under this law, ifinjury to a person or dog and they get attacked and it'sr not provoked they can be charged. The warden would not know to much, but ifthe Solicitor, Mayor and Chiefknows when the hearing will be, all the facts and evidence can be presented. President Mickavicz stated, the Mayor and Council support this. Mayor ifyou can direct the Chiefto conduct a thorough 1 investigation with the solicitor and the State Warden and move forward. Ifno one has any objection, the Petition is also now part ofthe record. Michael Kazmierczak also complained about the dog and worried about his wife walking their dog. Len Rakowicz who lives next door to Greco is worried about his family as well. President Mickavicz, ifthere is nothing else meeting adjourned. 8
