Public Notice: Ms. Kovach announced that council met in executive session this evening at 6:00 pm for the purpose ofcollecting information or educating agency: members about an issue. Ms. Kovach stated that after the council meeting, borough council will convene a continuance of aconditional usel hearing for Maya Sweet, aj personal service business use at 3633 Poplar Avenue. Public Comment - Agenda Items: Ms. Kovach opened the public comment for agenda items Jerry Coombs, Belleville Street - noted the agenda contained a motion to approve a contract award for emergency sidewalk repair on Castle Shannon Boulevard and questioned if the borough manager has a spending amount limit for these actions. Mr. Foote answered that the policy committee is working on spending limit guidelines. Ms. Kovach answered that the Manager's Report will address the sidewalk project. The bid received was for $14,400 for the sidewalk and $16,750 for the temporary crosswalk. Ms. Kovach stated that the crosswalk was installed by the Mr. Coombs noted Resolution #750 requires speakers to utilize a sign-in sheet and be recognized by the council president. Ms. Kovach answered that council is taking comments for discussion on the resolution and not acting on this tonight. Mr. Foote stated that the public comment is for comments, not for exchange or dialogue. Mr. Coombs believes the four-minute time limit for each speaker is an insufficient amount of time, and the public comment period should not bel limited to Robert Broman, Blossom Hill Road - admits that many boroughs have guidelines for meetings such as proposed Resolution #749 and #750 and noted that only one public comment period shall bep provided for public meetings where no official action will bei taken. Mr. Broman suggested that the general guidelines of the resolution should require cell phones to be silenced. Rules of Decorum #3, Mr. Broman questioned if board members must address questions to the council president. Ms. Kovach has the ability to direct questions to appropriate board members/personnel. Mr. Broman questioned Enforcement of the Rules of Decorum #3 and believes this item should apply to council members also. Ms. Kovach noted that this rule applies to "any person", which Vanessa Beck, Castle Road - discussed an updated slide show on the Six Parks Plan that is posted online and pointed out differences from the original plan on YouTube from March 2022. Ms. Beck also discussed the bond expenditure summaries for lower Hamilton Park that went from and noted that a sign-in sheet for speakers is available. borough's! public works department. 301 minutes. does include council members. 1 Minl $4,432,100 from $4,580,000. Ms. Beck referenced past meeting minutés of May 22, 2023,J July 24, 2023 and August 14, 2023 regarding Hamilton Park and grant funding. Ms. Beck asked ifo council could be specific regarding the safety concerns for soccer ifbase plugs were installed for baseball. Ms. Beck showed graphics of options for possible base Bryan Gigliotti - stated that he is a loud and passionate person and apologizes if anyone was offended by his comments at the last meeting. Hel has also researched base plugs in areal ballfields such as Peters Township. CSYA females will not be able to play on the turf field as proposed for softball, especially for pitching with a drop down base. The force and pressure that a female puts on a pitching rubber will not enable it to stay in place. Peters Township's pitching mound and bases are pegged, and the field is not just used for softball and is used for soccer and football. Mr. Gigliotti does not believe that pegged bases are a safety concern or issue. CSYA teams 10U softball, 12U fast pitch, and 15 fast pitch would not be able to utilize the turf field without pegs. Mr. Gigliotti concluded stating that it would be detrimental for females not tol be able to utilize the Ms. Kovach presented correspondence from Keystone Sports Construction Company that stated the company would require written legal indemnification to proceed with a request for the provision and installation of22 base sleeves, and they would not recommend the installation due to the effect it would have on the overall play for other sports. The company proposed toj proceed with cleated base options which aligns with the approach adopted by most parks. Council has been researching options and solutions, however council's main concern at this point is to get the park project completed. After that, council can consider options to make the park more usable. Tom Beck, Castle Road - replied that twenty-two pegs arei not necessary. CSYA would only need a1 total of 12 pegged bases. Mr. Beck added that hel believes the cost to install the pegged bases at plugs for baseball. Ms. Shartlemotioned Administration: Mr. Foote requested council's consideration regarding the implementation ofa yard/green waste collection program for residents due to comments from residents that the trash cart capacity is insufficient for disposing of grass clippings/yard waste. Mr. Foote has contacted thei manager in Dormont who has recently implemented a collection program. The proposed pilot program would include a public works crew collecting the yard waste on separate Saturdays for four months. The material would be taken to Michael Brothers for disposal. Residents would need to call for a scheduled collection on the Wednesday prior to the Saturday collection. Budget costs would be approximately $2500 for public works overtime and disposal cost of $2500 for the collection period. Funding would be expended from the economic development section ofthe budget with money that was provided by ARPA. Mr. Emph motioned to authorize borough stafft to proceed with the Yard Waste Collection Program. Ms. Shartle seconded; all in favor; motion carried. Items collected will be grass clippings, weeds, and trimmings ofb bushes to approve the minutes. Ms. Kovach noted that that borough's fall leaf Bid Openings, Contracts, and Resolutions: Mr. Foote received proposals for two options for the Castle Shannon Boulevard Emergency Sidewalk/Crosswalk Project. Staff elected to proceed with the sidewalk repair only option. To save money, the crosswalk was installed by public works. Mr. Brannon motioned to award an emergency contract to Michael Facchiano Contracting, Inc for the repair of a section of sidewalk adjacent to Ice Castle in the amount of Ms. Shartle motioned to award Environmental Assessment Library Roof] Replacement contract to Allegheny Global Environmental, Inc. in the amount of $650.00 for an asbestos analysis. Mr. Seiler seconded; all in favor; motion carried. Mr. Foote said that staff was notified last year rof the roof replacement needs, and the project was included in the 2024 capital budget. The library would not be closed while asbestos sampling occurs, however it may need closed for a day or collection is] planned for later this year. $14,400.00. Mr. Oates HRPersonnelrolcy - Ms. Shartle motioned to revise the current borough policy from a new employee to receive individual health insurance coverage only to a new employee will receive individual, spouse or family coverage and remove residency requirement for new: non-union Ms. Shartle motioned to authorize thel borough manager to extend a conditional offer of employment to Carolyn Powers for the position of Administrative Assistant at the rate of$22.28 Mr. Foote stated that the resolutions being presented this evening are inj preparation oft the launching ofhybrid meetings and to provide basic guidelines for council members and attendees. The true: intention is toj provide rules in order tol have an organized meeting. Ms. Kovach presented Resolution #749 - a resolution to adopt rules of decorum during public meetings. The resolution is being presented this evening for discussion only, and action will be taken at the July gth meeting. Generally, in aj public meeting, all comments should be addressed Mr. Kovach presented Resolution #750 - a resolution establishing and adopting policy to address public comment procedures. Mr. Foote noted that a sign-in sheet was available this evening and will bei required for future meetings. As council continues to follow the Sunshine Law Guidelines, council is limiting those who can address the board to residents, tax payers, and rate seconded; all in favor; motion carried. employees. A thirty-minute time limit is proposed to track time and run an orderly meeting. The council president can extend that timeifr necessary. The four-minute time limit per person was selected by the policy committee, and council agreed. Mr. Foote added that the resolution can be revised ifi needed. Ms. Kovach asked for comments. Mayor Baumgarten stated that hel believes that all public comments should bei made at the beginning oft the meeting as this would expedite meetings, and Public Safety - Bob Sutton, President of the CSVFD - presented the June report. In-house fire training was conducted on June 10th, with firefighters practicing hose line advancements and pumping scenarios from the engines with new nozzles. The: new nozzles are easier to handle and only require two people, whereas the former nozzles required three to four. In-house training on June 17th had firefighters taking it easy due to the warm weather. Some members were able to Several firefighters attended the Emmanuel Church Block Party on June 7th and spoke to approximately 150+ children that evening. The kids also got the chance to look at the fire equipment and flow some water from al hose line. It was a great evening. Several firefighters attended the St. Anne Carnival on June 11th. They spoke with many people during the evening regarding several topics. Again, this was another great evening meeting folks Mr. Sutton stated that unfortunately the CSVFD had a member recently resign due to work requirements and family obligations. The member left in good standing, and members are The CSVFD responded to 18 total calls in June: 12i in Castle Shannon, 1 in Baldwin Township On behalfofthe fire department, Mr. Sutton thanked council for their assistance in obtaining a grant for the garage doors. New windows are also being planned for the facility. As always, the CSVFD very much appreciates the support received from our borough council members. On aj personal note, Mr. Sutton recalled two significant rainfalls this year in April and added that the CSVFD was not called out to assist with flooded basements. The two stream cleanups undertaken each year has made a significant impact to reduce flooding. Public Works efforts in keeping the sanitary and storm sewer inlets maintained has also had a positive impact. Mr. Sutton monitored the creek to prevent flooding issues at the Memorial Hall and noted very little debris in the waterway. Mr. Sutton complimented the positive actions that thel borough has taken and believes that Baldwin Township may have taken preventative actions at Armstrong Park. Ms. Kovach added that the volunteer Stream Clean Upi projects are undertaken by the Watersheds of South Pittsburgh. Mr. Sutton responded that a high-tension wire came down on a service line and an abandoned utility pole caught fire. The fire department responded, and Duquesne Light was contacted and extinguished Public Works- - Mr. Oates gave kudos to the department for their installation ofthet temporary the fire. crosswalk on Castle Shannon Boulevard. Board Reports ACBA - Ms. Kovach reported that the quarterly meeting was held June 20th. Economic Development - Mr. Seiler reported on the June 19th CSRC meeting. The Stream Clean Up was. June gth with 10-12 volunteers. This project is done twice a year and provides the borough with MS4 credits. The CSRC would like to apply for grant funding for a community garden. date changed to November 30th to coincide with Small Business Saturday. The CSRC would also like to partner with the CSVFD on Light Upl Night. CSRC would like the Library - Ms. Shartle announced al Dine Out Night fundraiser for the library at BJ's Restaurant on. June 27th. Adventure Basket Raffle is available through August 1st. The library will be closed July 4th for the holiday. July programs include folk music history with live music, cupcake decorating, writer's café, and adult bingo. Information is posted on the MRTSA - Mr. Swisher announced that the: next board meeting will bel held June 26th. SHACOG - Mr. Seiler reported having technical difficulties in attending the. June meeting via ZOOM. The. July meeting will be the annual golfouting at the Lindenwood GolfClub. Mayor's Report - Mayor Baumgarten announced that the bill to allow local police to use radar isstill in committee. The Pennsylvania State Mayor's Association has been lobbying tol have this ChiefTruver stated the police have stop watches and painted roadway lines to track speeding, including a laser and Accutrack which tracks distance over time. These tools are sufficient for Manager's Report - Mr. Foote displayed slides oft the Smith Street Pedestrian Bridge which was officially closed on June 14th. Borough staffi installed fencing on the Route 88 side. As part ofaj partnership with the borough, the PRT: installed fencing on the rail stop side. The borough library's website and Facebook page. bill passed for many years. our community'si needs. had applied for grant funding to install a new pedestrian bridge. min5 5 PennDOT: has informed borough staff that they will be undertaking aj project on Route 88 in May Mr. Foote displayed photos ofthe completed emergency sidewalk repair by the Ice Castle. Eight proposals were sent to vendors, and one responded. As stated previously, the public works crew installed the crosswalk. Both the sidewalk and crosswalk are available for pedestrians. Mr. Foote was alerted today about a four-phase project that Columbia Gas will be undertaking. Borough staff will review with the engineers and keep council and the public updated, which will Public Comment- - Non-Agenda Items Ms. Kovach opened the public comment section ofthe Bryan Gigliotti, Poplar Avenue - reported that the Summer Recreation Program started today. Over 85 children attended with 130 children registered. Mr. Gigliotti thanked public works for their assistance. Lunches through the Keystone Oaks program are being provided. CSYA will bel hosting three tournaments in July. Visitors from other areas always comment that the borough has one ofthe nicest parks and fields. Mr. Gigliotti attributes this to the CSYA's cooperative relationship with the borough. All residents are invited to attend the CSYA games The CSYA GolfOuting will bel held October 5th at Butler's GolfCourse. This is one oft the Asai resident, Mr. Gigliotti thanked council for their work and would also like to see Hamilton Park completed, especially for the Summer Recreation Program. However, Mr. Gigliotti added that he wants it done correctly and not just for the speed of opening the park. It would be Ifthe Party-on-Park events are planned, Mr. Gigliotti would like to see it expanded to include Nancy Dempsey, Willow Avenue - walks the borough with her dog and noted many weeds and ant hills in the brick sidewalk along Castle Shannon Boulevard. Iti is very unsightly. Ms. Dempsey noted that her area of Willow was one oft the first that Columbia Gas excavated two years ago. Both road and driveway restoration has not been completed, and Ms. Dempsey would like to borough to contact the utility company to get the: restoration completed. Temporary patching for the road has been washed out, and the stones and rocks are a danger. Ms. Dempsey asked for additional patrols. 6 mab Joann Strain, Hastie Road - stated that she spends a lot ofmoney landscaping her property, and the Columbia Gas project has damaged her property with patches ofs stone and dead grass from materials. Ms. Strain noted that other areas oft the borough that the utility company worked on have been paved and completed; however, no restoration work has been completed for Willow Avenue. Ms. Strain echoed Ms. Dempsey's comments to please contact the utility company to Mary Craig, Londonderry Drive - commented that yesterday a wire came down at Londonderry and Waterford. Thej police department and fire department responded immediately and took charge to ensure residents' safety until Duquesne Light appeared. Ms. Craig appreciated the Rob Broman, Blossom Hill Road - commented that hel believes that visibility has improved with InJ July of2022, Mr. Broman reported an issue with the over population of deer and noted an aggressive doe that kicked ai neighbor's dog. Mr. Broman understands that game commission rules standard, and guidelines that minimizes the ability for local government to act. Mr. Broman had a deer get aggressive in his yard this year. Hei must police his yard before letting his grandchildren go outside to play to ensure there are: no deer about and to clean up the deer manure. In addition, the deer are destroying landscaping vegetation and causing car accidents. Allegheny County is beginning to recognize the deer overpopulation as a severe problem, and the City of Pittsburgh will be conducting a controlled bow hunt int the parks. Mr. Broman asked council toj pursue deer population control options, perhaps multi-borough or county-wide. Ms. Kovach stated that the issue can be discussed with SHACOG representatives. Mr. Broman also noted that coyotes are: in the area and a danger to small children. get this fixed. quick response by both departments. the current council board. Jerry Coombs stated that hel believes in the past council was looking into options for digitizing the castle sign and wondering ift this was accomplished for social media. Ms. Kovach noted that the wayfinding street signs will have the castle logo. Mr. Swisher answered that this was false Jason Suchy, Arch Avenue - stated speeding and driver's ignoring stop signs are still a concern on streets inl his neighborhood. Mr. Suchy stated that Dormont and the City ofPittsburgh has programs to "share the street" with signage. Mr. Suchy would like to see some restrictions during rush hour to curb drivers using the streets as cut throughs from Castle Shannon Boulevard to Route 88. Stop signs at Myrtle, Poplar and Chestnut are being ignored by drivers. Mr. Suchy has noted increased police patrols, but hel believes additional measures as needed. Vanessa Beck, Castle Road - commented on the public comment sections of meetings and believes that residents should be able to speak at the first comment period for agenda items and also at the second public comment period. Ms. Beck understands the need for a 30-minute time limit for public comment, but also believes that everyone should have the opportunity to speak. Ms. Beck revisited the issue ofbase pegs for the turf field at Hamilton Park. The parks plan pictured that Riehl will have a deck hockey field instead ofbaseball, and O'Brien Field will not information. 7 Mi 7 have baseball either. What that means for the CSYA is that the organization will have one playable field. That scenario displaces the older boy population - the Pony League. Ifthe decision becomes either tol have the soccer component or pegged bases, she advocates for the Tom Beck, Castle Road - appreciated that the borough contacted the sports contractor, but believes that the requirement for written legal indemnification should not be the sole reason pegged bases are not used. This type ofindemnification would be required for any sports contract. Ms. Kovach: reiterated that council is doing due diligence and exploring options; however, the immediate goal is to get the field completed. Mr. Beck stated that CSYA would be willing to work with the borough to assist with funding for installing pegged bases. Lindsey Slagle. Sixth Street - has two young children and has noted many people moving out of the community. Ms. Slagle notes that many borough activities are sports related. Her daughter plays softball and is discouraged tol hear that her daughter may not be able to utilize the field that Ms. Slagle asked if council had considered putting additional sidewalks to make a more walkable Jason Suchy, Arch Avenue understands that council wants to get the field completed, but it needs to be completed correctly sO that it is available to be used by everybody for as long as Carrie Struth. Middle Road - referenced Title 9 and commented that ifs state or federal funding is used for Hamilton Park, the suggestion that females cannot use the baseball field could become sport supported by the CSYA with 140 participants and 131 teams. her tax dollars paid for. community. possible. an issue for the borough. Ms. Kovach closed the public comment section. Old Business: Ms. Kovach presented slides of the digital copy of the park contract signed in June 2023 by the former council president. Mr. Foote noted that the list ofitems included in the contract does not include a brown infield or pegged bases. The turf field has already been manufactured according to specifications and is a few weeks away from installation. The contract and information was shared with members of CSYA along with the dugouts ordered and other accessories. Ms. Kovach commented that council is working with the contractors and engineers for useable product options that can be installed at al later date. Mr. Emph motioned to adjourn. Change Order #3 Castle Shannon, PA July3, 2024 Scope: LSSE has requested pricing information fort the excavation, hauling and disposal of materials within the "field" footprint that appear tol be unsuitable. The excavated area would then be lined with geotextile material, to be specified by LSSE. Following installation of the geotextile material, the excavated. area willl be back filled, as detailed in the LSSE email The following details provide the scope of work associated with the LSSE request to remedy the unsuitable soil: dated, July 3, 2024, with aggregate. Excavation, hauling and disposal ofr materials, as directed by LSSE Site Personnel Purchase and installation of geotextile material, specified byl LSSE Site Personnel Purchase, hauling, and placement of aggregate, as specified by LSSE Site Personnel. Based on current site observations, it appears that an estimated quantity of 412 cubic yards will require removal and replacement. Actual quantities will be calculated daily by on-site personnel. The cost associated with the scope of work outlined above can be found below: Excavation, hauling and disposal of material $52.18 per cubic yard of excavated: soils Purchase, hauling, and placement of aggregate $45.50 per ton of aggregate Purchase and installation of geotextile material - Cost to be determined based on material specified by LSSE. For billing purposes, the actual quantity of excavated soils willl be billed. The excavation will be measured by on-site. personnel and quantities agreed on at the conclusion ofe each workday. For billing purposes, the actual quantity of aggregate, per the weigh-slips, will be used. The total aggregate quantity will be documented by the stone quarry on printed slips/receipts. NOW1 THEREFORE, BE IT RESOLVED, by the Borough, Allegheny County, The Borough adopts the: following rules of decorum during public meetings to assist in the Pennsylvania as follows: orderly deliberation of matters affecting the Borough and its citizens. PROVISIONS: A. General Guidelines The Borough has numerous public meetings such as Council Business Meetings, Borough Agenda Preparation Meetings, Special Meetings, etc. (hereinafter "Public Meetings"). In order to safeguard participatory democracy in the Castle Shannon Borough, all persons attending Public Meetings in castle Shannon Borough should HI strive to: Treat everyone courteously Listen to others respectfully Exercise self-control Give open-minded consideration to all viewpoints Focus on the issues and avoid personalizing debate B. Rules ofDecorum 1. Public participation should be limited to the designated comments periods, before or after the meeting, or ifspecifically called upon by the Council 2. Noj person attending Public. Meetings shall engage in disorderly or boisterous conduct-including: but not limited to applause, whistling, stamping of feet, booing, or making any loud, threatening, profane, abusive, personal, impertinent, or slanderous uterance-thatdisturbs, disrupts, or otherwise 3. All remarks by members of the public should be addressed to the Council President and not to any other member ofthe public or to any single Council Member, or staff member unless ini response to a question from Council President. 4. Speakers shall not make personal, impertinent, slanderous, or profane remarks to any member oft the Council, staff, or general public. Any person who makes such remarks, or who utters loud, threatening, personal, or abusive language or engages in any other disorderly conduct which disrupts, disturbs, or otherwise impedes the orderly conduct of any Council meeting shall, at the discretion oft the Council President or a majority oft the Council;, be cautioned or ejected and barred from further audience before the Council during that meeting. 5. D. Media Presence in Meetings 1. Video recording devices and any related equipment and still photography equipment may be: set up only in designated areas. In order to limit disruptions, the operator must have completed setup ofa videotape recorder and any related equipment or still photography equipment by no less than 10 minutes prior to the official start time of the public meeting. 2. The operator may not disrupt the public meeting with recording equipment. The operator may not set up or use the videotape recorder or equipment in such a way as to block or obstruct the view or access of other members ofthe public. The operator may not continually exit and re-enter the meeting room, or move around within the meeting room, during the public meeting. The operator must remain with the videotape recorder and equipment while 3. Microphones or other pickup devices shall be integrated into the recording device.
