Oak Springs Community Center/Police Department 342 Campbell Street, Cleveland, GA 1. Call to Order Mayor Turner called the meeting to order at 6:30 p.m. PRESENT: Mayor Josh Turner, Council Members Nan Bowen, Annie Sutton, Jeremy McClure (Mayor Pro Tem), and C.J. McDonald Mayor Turner was in attendance virtually. Also present were City Administrator Kevin Harris, City Attorney Keith Whitaker, and 2. Invocation - Campus Pastor Jeff Groves, The Bridge Church, and White County City Clerk Lisa Ritchie Ministerial Alliance 3. Pledge of Allegiance 4. Approve Agenda Motion by Council Member McClure, seconded by Council Member Sutton, and voted, unanimously, to adopt the agenda with an amendment to remove item 18, Executive Session. PRESENTATION 5. Georgia Reads Day Proclamation Ms. Ritchie read the Proclamation. Motion by Council Member McClure, seconded by Council Member Bowen, and voted, unanimously, to approve the Georgia Reads Day Proclamation. PUBLIC HEARINGS 6. Request for re-zoning for 1.2 acres from Tom Williams' resident located at West Mayor Turner stated the item. He said the request is to change the current lot from a B2 Highway Commercial loti to a Planned Urban Development (PUD). He defined PUD asa a community of homes with shared amenities and services operated by a Homeowner's Association. He said the specific tract is located at land lot 35, 2nd District, deed book 1597 on pages 525 and 526 with the nearest road intersection to Mayor Turner gave the public hearing instructions and proçess. He stated that ift the zoning is approved a zoning ordinance amending the zoning ordinance of Cleveland shall be signed by the Mayor and Council and filed as a part of the official record of the city and the city'sz zoning map shall be altered to reflect the amendment. Mayor Turner stated that if the request is denied, the same property will not be able to be considered for zoning until the expiration of at least 6 months following the Mayor Turner opened the Public Hearing. He stated that Mr. Williams has submitted the Disclosure of Campaign Contribution Certification that he had not, within the last 2 years, immediately preceding the application date made any contributions aggregating $250 or more to any local government official involved in the review or consideration of this application. Mayor Turner continued stating that additionally, the tax clerk has certified that all property taxes have been paid. He asked Mr. Williams if he acknowledge both statements. Mr. Williams stated, "yes". Economic Development and Planning Director Tom O'Bryant addressed the Mayor and Council Members. He stated that the Planning Commission met on August 22, 2024, regarding the rezoning request. He read portions of the minutes of the meeting Tom Williams, 175 North Mill Road, Sandy Springs, Ga, addressed the Mayor and Jarrard Street the parcel is located at Bell Street. denial of the proposed zoning amendment. and stated that the Commission recommended approval. Council Members in favor of the items. Mayor Turner asked those in favor of the item to raise their hand. Ms. Ritchie stated Mayor Turner asked those in opposition of the item to raise their hand. Mr. Ritchie that there were none. stated that there were none. Andrea Evans, 92 WestJarrard Street, addressed the Mayor and Council Members, Council Member McClure verified the acreage with Mr. O'Bryant. Mr. O'Bryant stated Mayor Turner closed the Public Hearing. Mayor Turner clarified that the application is 1) Internal yard requirements - Project will provide a 30-foot grass or landscaped strip between all buildings and interior driveways and/or streets. The 6 units that front Jarrard Street will have a 20-foot setback, a 10-foot reduction for the 2) Minimum heated square foot per unit of 784 square feet, instead of the regular not in favor or in opposition. She expressed traffic concerns. that the size of the property is 1.2 acres. seeking the following 3 variances: 6units would be needed requirement of 1,100 square feet 3) Density of 10 units per acre Council Member McDonald asked to amend the rezoning request by making ita a condition that the project revert, back, from PUD to B2 Highway Commercial if the project hasn't begun within 18 months of today, September 9, 2024. Motion by Council Member Bowen, seconded by Council Member Sutton, and voted, unanimously by raising of hands, to approve the zoning application 2047 to zone the requested parcel to a planned urban development with the approval of the 3 variances as well as the condition of the 18 months commencement from today's date or the zoning will revert, back, to commercial. Ms. Ritchie confirmed that all voted in favor of the motion. 7. Amendment to the Hotel/Motel Tax Allocation Mr. Harris stated that an issue was identified earlier in the year. He said allocation allowances need to be broadened for the purpose of maximizing resources and being good stewards of the monies. He said to make this change, the item will need to go through the General Assembly later this year for 2025/2026 Legislative Session. Mr. Harris stated the upcoming hearing dates as October 7 and November 12. PUBLIC COMMENTS Ms. Judy Lovell, 341 West Kytle Street, addressed the Mayor and Council Members. Ms. Lovell provided historical information from September 1948. DEPARTMENT REPORTS 8. Mr. Harris stated that the Mayor and Council approved a Capital Improvement Budget which included an appropriation of $4,000,000 for a new facility. Motion by Council Member McClure, seconded by Council Member Sutton and voted, unanimously, to approve the change order and authorize the City Administrator to proceed with the guaranteed maximum price of $3,995,411.33 for the construction of the new fire station and public restrooms at 84 Underwood Street. CITY ADMINISTRATOR KEVIN HARRIS Mr. Harris stated that the department reports show the efforts of Cleveland concentrating on the future. He stated some items stated were a guaranteed maximum price for a new fire station, SPLOST IV has been depleted, new well for more affordable water, grant fori the extractor, and 3 new restaurants; Scooters, Los Cerritos, and Tipsy Tomato. CITY ATTORNEY KEITH WHITAKER Mr. Whitaker did not have any items to report. ANNOUNCEMENTS Ms. Ritchie gave the announcement. 17.
