September 10, 2024 The City Council of the City of Clyde, Texas, met ina a Regular Meeting at Clyde City Hall, 222 Oak Street, Clyde, Texas on September 10, 2024, at 6:00 p.m. with Mayor Rodger Brown presiding. Councilmembers present: Staff present: City Administrator Chris McGuire, City Secretary Connie Thornton, Information Technology Specialist Chris Barnett, Director of Community Services Terry Davis, Public' Works Director Jerry Perkins, Chief of Police Trevor Barnes, Librarian Linda Cavanaugh, Police Officer Tommy Morris, Police Officer Tom Elick, Police Lieutenant Chad Boyett, Court Clerk Shyla Foutz, Assistant City Secretary Naomi Santos, and Rodger Brown, Paul McGuire, Jim Rector, Tammie Coffman, and Thomas Martin. Public Works employee Michael Small. An open meeting was held concerning the following subjects: 1.0 CALLTO ORDER AND ANNOUNCE A QUORUM IS PRESENT At 6:00 p.m., Mayor Brown called the meeting to order and announced a quorum was present. 2.0 INVOCATION Given by Mayor Brown. 3.0 PLEDGES TO U.S. AND TEXAS FLAGS All-I led by Mayor Brown. 4.0 COUNCIL COMMENTS Mayor Brown read a statement to the citizens about their concerns over the missed bond payments. McGuire reminded citizens of National Night Out at the Emergency Services Facilities on October 1st from 5 p.m. to 7 p.m. 5.0 PUBLIC COMMENTS Mayor Brown opened the public comments at 6:05 p.m. Several citizens addressed their concerns about the missed bond payments, the lack ofi information from the council and staff, the new sports complex and that cost, and the utility bill increase from the city. Mayor Brown closed the public comments at 6:52 p.m. 6.0 CONSENT AGENDA 6.1 Rector moved and White seconded to approve the minutes from the regular meeting of August 13, 2024, as printed. Motion carried unanimously. 7.0 PRESENTATION 7.1 Mayor Brown recognized. Jason Hughes for five years of service with the City of Clyde. 7.2 Mayor Brown recognized Jerry Perkins for five years of service with the City of Clyde. 8.0 PUBLICHEARINGS 8.1 Mayor Brown opened the public hearing on the tax rate at 6:55 p.m. Steve Kniffen, 419 Elm St., Clyde, Texas addressed council stating he is a former councilmember and Mayor Pro Tem this increase is a 29% increase in property taxes. Fuel, food and housing have all increased and the council should think about the Jim Paylor, 809 Hunt St., Clyde, Texas stated he has set ont the council and understands where the cityi is now there has to be an increase in taxes and utility bill. Mayor Brown closed the public hearing at 7:10 p.m. 8.2 Mayor Brown opened the public hearing on the 2024-2025 Budget at 7:11 p.m. Camilla White, 525 South First St. West, Clyde, Texas said she had heard the budget Sylvester Roberts, 1127 Sunset, Clyde, Texas said last year we started doing our own trash and was told it would save the city money. He would like to know how many was being cut and she would like to see a copy of the budget. thousands of dollars we have spent on trash service this year. Mayor Brown closed the Public Hearing at 7:17 p.m. 9.0 REGULAR. AGENDA 9.1 Chris explained there was a 12% reduction in spending in this budget. The budget has been slashed to bare bones. He wanted to emphasize that the City of Clyde is a utility bill not a water bill. It has three services attached to it, water, sewer, and sanitation. We are dealing with! 50 plus-year infrastructure which is having failures that require immediate fixes. The city as well as the school and other entities are facing the cost pressures. There are no easy or popular choices for these fixes. Mayor Brown said massive inflation is also contributing to these issues. Coffman stated she knows Chris has been reaching out at the state and federal White moved and Martin seconded to adopt AN ORDINANCE OF1 THE CITY OF CLYDE, TEXAS ADOPTING A BUDGET FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2024, AND ENDING SEPTEMBER 30, 2025 IN ACCORDANCE WITH STATE LAW; APPROPRIATING THE VARIOUS AMOUNTS THEREOF; AND PROVIDING FOR AN level to try and get help for our community. Chris said he has talked to the council about selling the distribution side oft the water and the council did not want to do that and there is also the option of selling the Lake Ft. Phantom water rights. Moton carried unanimously. 9.3 Rector moved and White seconded that the property tax rate be increased by the adoption ofa tax rate of$0.880000, which includes. $0.399034 for maintenance and operations and $0.480966 for interest and sinking fund, which is effectively a. 39.98% increase in the tax rate. There are going to be major upgrades to our: sewer plant in the next five years. Brown stated the city is not where it needs White moved and Rector seconded to adopt AN ORDINANCE OF THE CITY OF CLYDE, TEXAS AMENDING CHAPTER 13 UTILITIES, 13.02 SOLID WASTE, ARTICLE 13.02.010 WASTE SERVICE RATES, 13.03 WATER AND SEWERS, DIVISION 2 RATES, CHARGES AND BILLING, SECTION 13.03.51 WATER RATES AND SECTION 13.03.052 WASTEWATER RATES, OF THE CODE OF ORDINANCES OF THE CITY OF CLYDE, TEXAS BY INCREASING WATER AND WASTEWATER RATES; INCORPORATING RECITALS; PROVIDING, AREPEALER; PROVDINGFORSPVEBABLIT: AND: SETTING ANI EFFECTIVE tol be to sustain our infrastructure. Motion carried unanimously. 9.8 McGuire moved and Coffman seconded to adopt A RESOLUTION OF THE CITY OF CLYDE, TEXAS, REVISING THE PERSONNEL POLICY MANUAL, SECTION 8.4 BENEFITS AT TIME OF SEPARATION TO MIRROR THE VACATION PAID OUT WHEN AN EMPLOYEE TERMINATES IN SECTION 5.14.2 NUMBER 10. 9.9 Chris said the price increase for the campsite and cabin rentals were to offset the cost ofv water usage and maintenance. Rector moved and Coffman seconded to adopt AN ORDINANCE OF THE CITY OF CLYDE, TEXAS AMENDING THE CODE OF ORDINANCES OF THE CITY OF CLYDE, TEXAS AMENDING CHAPTER 15: FEES AND OTHER CHARGES, BY INCREASING THE FEES FOR CAMPING AND CABIN RENTALS; INCORPORATING RECITALS; PROVIDING A REPEALER; PROVIDING FOR SEVERABILITY; AND SETTING AN EFFECTIVE DATE. 10.0 FINANCIAL STATEMENT The August 31, 2024, Financial Statement was available to Council for review.
