ASNATON-EGSLAIVE UPDATE FROM ASSEMBLYMEMBER HOLDEN Assemblymember: Chris Holden just completed 12 years with the 415t Assembly District. He provided a legislative update to the City: Council. Following a brief question and answer period, Assemblymember Holden presented Mayor Barakat and the City of Bradbury a Resolution thanking them for their many years participating and contributing to the 415t Assembly District. 4. PRESENTATION = SGVCOG CITY COUNCIL ROADSHOW From the San Gabriel Valley Council of Governments, a presentation was made by Levonn Gardner, Management Analyst and Melissa Troung, Senior Accountant, apprising the Council of their latest programs as well as a peek into what they' re working on next. DISCUSSION ON RENAMING THE LEMON CUT-THROUGH TRAIL City Manager Kearney suggested Council choose a name for the "Lemon Cut-Thru Trail" when conversing with residents, completing a work order, or any situation where between the current two "lemon" trails. The City Council chose eliminating Lemon Trail any possible confusion sO that the trail needs and Lemon Parkway. to be identified, there would be one name familiar to all 6. RESOLUTION NO. 24-24: A RESOLUTION OF THE CITY COUNCIL OF THE CITY BRADBURY EXPANDING UPON THE CITY'S MISSION STATEMENT AND VISION OF STATEMENT During the Retreat on Saturday, March 9, 2024, the City of Bradbury City Council decided to the City's Mission and Vision Statement, through a Resolution Mastlemopusdaewe alter time the City's General Plan is updated. Councilmember Lathrop made suggested Mayor Pro Tem Hale made a motion to incorporate Resolution 24-24 with Councilmember changed. Lathrop's changes and Councilmember Bruny seconded that motion. The motion passed unanimously 4:0. 7. DISCUSSION ON USE OF CALRECYCLE FUNDS The City Council directed Staff to coordinate with the City of Duarte to water station on the Royal Oaks Drive North Trail. The City of Duarte potentially partner on a proposed a location opposite of the boundary between 1775 and 1825 analyzed the Trail and ofi its proximity to a water valve for connectivity and shut off while also Royal Oaks North because brush overhead which could lead to clutter and this motion which passed unanimously 4:0: being free of any trees or clogging of the fountain in the future. City responded by reporting that the Planning Commission approved the Conditional Manager Use Kearney (CUP), and recommended approval of the other applications: TPM, Variance, General Project Plan Amendment, and Zone Change. These are scheduled for the City Council October 15, 2024. Mayor Pro-Tem Hale then said that the CUP should be called meeting since on part of an overall project. After the close of the public hearing, the Planning Commission adopted Resolution No. PC 24-323 (Attachment J) to conditionally approve Conditional Use Permit No. CUP 24-001, adopted Resolution No. PC24-324 (Attachment 'K') to recommend that the City Council conditionally approve Tentative Parcel Map No. 084353 and Variance No. V 24-003, and adopted Resolution No. PC 24-325 (Attachment 'L') to recommend that the City Council approve General Plan Amendment No. GPA 24-001 and Zone Change No. ZC Tentative Parcel Maps, General Plan Amendments, and Zone Changes are subject to City Council approval following a recommendation by the Planning Commission. Conditional Use Permits are subject to Planning Commission approval provided the decision is not appealed or called up to the City Council. The recommended findings and actions, including the determinations that the project and the various land use applications qualify as Exempt and Categorically Exempt under the provisions of the California Environmental Quality Act (CEQA) are discussed in this report and included in the attached draft resolutions (Attachments 'A, 'B'&'C) and draft ordinance (Attachment 'D'). The applicantdeveloper shall defend, indemnify, and hold harmless the City, its agents, officers, and employees from any claim, action, or proceeding, damages, costs (including, without limitation, attorney's fees), injuries, or liability against the City ori its agents, officers, or employees arising out oft the City's approval of the proposed project. The City shall promptly notify the applicantdeveloper of any claim, action, or proceeding and the City shall cooperate fully in the defense. If the City fails to promptly notify the applicant/developer of any claim, action, or proceeding, or if the City fails to cooperate fully in the defense, the PPlcantdeveloper shall not thereafter be responsible to defend, indemnify, or hold harmless the City. Although the applcantdeveloper is the real party in interest in an action, the City may, ati its sole discretion, participate in the defense of any action with the attorney of its own choosing, but such participation shall not relieve the applicant/developer of any obligation under this condition, including the payment of attorney's fees. Applicant/developer shall promptly pay any final judgment rendered against the City. 3. Import shall be limited to approximately 12,000 cubic yards of structural fill with grading operations not to significantly exceed 2,000 cubic yards per day, and export shall not include any soil. 8. To minimize inconveniences and affects on the neighbors, the project shall be a. Along with the Grading Plan, the applicant shall also submit a Demolition Plan which identifies the extent of the removals and any structures which are to remain. The existing utilities should be indicated on the plan and their disposition as part of the construction. An Erosion Control Plan shall be submitted which identifies the Best Management Practices (BMP) to eliminate anyi illicit discharges during storm events along with the Demolition Plan. The erosion control measures may be included on the Demolition Plan if space permits. . The applicant shall be responsible for the removal and disposal of all materials which are unsuitable for future construction from the site. Disposal of all materials shall be executed in conformance with all City ordinances and requirements. d. Prior to the issuance of any grading or building permits, the applicant shall submit an Engineering Geology/Soils Report that includes an accurate description of the geology of the site and conclusions and recommendations regarding the effect of the geologic conditions on the proposed demolition. The Report shall include the composition of all import materials and the location from which they are being obtained. All import material shall be select fill capable of supporting up to and in excess of 90% in-situ compaction. Absolutely no deleterious materials or rock debris will be allowed to be imported onto the site for fill material. All fill material shall be certified by the project geologist or geological engineer. e. Prior to the issuance of any permits, the applicant shall submit an erosion control plan to the satisfaction of the City Engineer and all proposed erosion BMPS shall be installed and operable at all times. This plan shall be incorporated into the SWPPP ((see condition j). f. Prior to demolition activities, all utilities shall be removed or protected as indicated on the approved grading plan, including facilities and wires for the supply and CalAm - 1271 Lemon. Avenue 4 PC24-323 distribution of electrical energy, telephone, cable television, etc., to the satisfaction of the City Planner and City Engineer. g. The applicant shall obtain a public works permit for all work in or adjacent to the public right-of-way (ROW). All work within the public ROWshall be in accordance with applicable standards ofthe City of Bradbury, i.e. Standard Specifications fori PublicWorks Construction (Green Book), and the Work Area Traffic Control Handbook (WATCH), and further that construction equipment ingress and egress be controlled by a plan approved by the City Engineer. h. The applicant shall be responsible for any and all damages to the adjacent street improvements as a result of the demolition and construction activities. Any construction activities within the street shall result in the repair and restoration of the existing street improvements, including the application of Class I slurry coat to the centerline of Lemon Avenue across the project frontage to the satisfaction of the City Engineer. i. The applicant shall construct improvements within the City parkway and immediately adjacent to said parkway along the project frontage to the satisfaction of the City Planner and City Engineer, as indicated on the approved construction plans. General Permit for Discharges of Storm Water associated with Construction Activity, Construction General Permit Order 2012-0006-DWQ (as amended by all future adopted Construction General Permits). The Construction General Permit requires the development and implementation of a Storm Water Pollution Prevention Plan (SWPPP). The applicant must submit a Notice of Intent and Waste Discharger's Identification (WDID) number as evidence of having applied with the Construction General Permit before the City will issue a grading permit. The applicant is ultimately responsible to complywith the requirements ofOrder No. 2012-0006-DWQ, however, the City shall have the authority to enter the project site, review the project SWPPP, and require modifications and subsequent mplementations to the SVVPPP in order to prevent polluted runoff from leaving the project site onto public or private property. Prior to the issuance of permits, the applicant must obtain coverage under the k. The applicant shall provide drainage improvements to carry runoff of storm water in the area proposed to be developed, and for contributing drainage from adjoining properties to the satisfaction oft the City Engineer. The proposed drainage improvements shall be based on the approved grading and drainage plan. The proposed storm drain improvements shall be privately maintained by the property owner. I. The applicant is responsible for post-construction erosion and dust control across the entire site until such time as released by an alternate site development.
