CALLTOORDER The meeting was called to order at 7:30 p.m. by Chairman Ralph Ghent, who also led the Commission in the Pledge of Allegiance. 2. APPROVALOE MINUTES Motion: Bill Butts motioned to approve the. June 24, 2024, minutes with corrections. Seconded by Brian Bieda. Vote: 5-i in favor, 1-1 Ralph Ghent abstained, and none opposed. 3. CITIZENCOMIMENTSINeE items not on the agenda) None 4. CARROLL-/FREDERICK COUNTY PLANNERS Carroll County Planner - Hannah Weber - Hannah was not in attendance. Frederick County Planner - Justin Burker - Justin updated the Planning Commission on the Transmission Line Project: Frederick County encourages residents toj provide feedback on the Transmission Line Project to the Public Service Commission (PSG) and Public Service Enterprise Group (PSEG). Please check the county website for the links to the survey and additional information. Bill 24-12: Growth Moratorium: A residential Growth Moratorium, the Ordinance will be in front of the Planning Commission on August 21st, for more information see Bill 24-12 County Council page on the county website. The Alpine (Linganore) Preliminary Subdivision Plan: 488 age-restricted residential units. 192 single- family detached, 184 single-family attached, and 112 multi-family units will be in front oft the Planning Commission on August 14th. Justin also announced he will be leaving the Frederick County Planning Department. 5. SITEPLANS/SUBDVISIONS/DVELOPMENT CPROIECTS S-22-0037- - Southside Plaza Concept Site Development Plan - for approval. Bill Butts motioned to approve the open space waiver for this concept site plan. Seconded by Martina Hatley. Brian Bieda recommended editing the original motion to include the documentation submitted by the applicant. Seconded by Martina Hatley. Vote: Alli in favor, none opposed. Heather Wallace motioned that the Planning Commission grant concept plan approval of the site plan for the Southside Plaza Concept Site Development plan, located at 1508 and 1510 South Main Street, under the following conditions. 1.All town and county agency comments shall be addressed before the final site development plan submission. 2. The Town Engineer must grant the final approval oft the water and sewer allocation for this project development plan before submitting the final site development plan. 3. The receipt of adequate facilities documentation from the chiefof Mount Airy Volunteer Fire Company by the planning commission and that the planning commission subsequently approves adequacy of fire and rescue services. 4. The condition that the applicant relooks at the architecture and facade design to be compatible with the surrounding buildings and the town's character and that the planning commission review any changes to the architectural design before final approval. 5. (Edited motion) To add the increased height of landscaping along the rear. Seconded by Brian Bieda. Vote: All in favor, none opposed. 6. NEW BUSINESS/INTRODUCTION/RECOMMENDATION MA-BOA-2024-03 St. Andrew's Presbyterian Church Nursery School/Child Care Center- - Special Exception. The request is for review and toj provide a recommendation to the Board of Appeals to allow for al Nursery School/Child Care Center. The applicant, Dan Melton, presented the Special Exception to the Planning Commission. Ralph Ghent motioned to recommend a favorable conditional recommendation to the Board of Appeals regarding case # MA-BOA-2024-03 St. Andrews Presbyterian Church at 609 Center Street on the condition that the applicant complies with state requirements for such use. Seconded Tractor Supply Company (TSC) Enclosures Building Permit and Signage. Possible approval oft the proposed exterior structures for a Feed Center and Garden Center with signage, located off Century Drive. - Heather Wallace motioned for a favorable recommendation for the new: feed storage building and the covered area of the live goods center. Seconded by Martina Hatley. Vote: All in favor, none opposed. Now moving to the signage. Martina Hatley motioned to approve the garden center sign for the 85 square foot. Annexation Plan #2024-46 Pank Land LLC,- Pank Property request for annexation into the town with an Industrial Zone classification. Tom Pank, the applicant, was present with his Attorney, Bruce Dean, and presented the annexation to the Planning Commission. Steve O'Malley motioned for a favorable recommendation oft the #2024-46, the Pank Land, LLC Annexation to the Town Council. Seconded by Martina Hatley. Vote: 5-1, Heather Wallace Draft Open Space Waiver Worksheet - The Commission agreed that the open space waiver worksheet is acceptable after removing the word "Questions" on page 2. by Martina Hatley.
