City of Mexico Beach Planning & Zoning Meeting Minutes MONDAY,. JULY8,2024-60OPMI The City of Mexico Beach Planning & Zoning Board met in a regular meeting on Monday May 6, 2024, at 6:00 pmi in the Public Works Buildingi in Mexico Beach. Board members present were Lee Ellzey, Julie Gardner, Steve Cox, Jack Kerigan, Erik Fossage and Larry Henderson. Rock Kries was not present. Also present were City Administrator, Chris Hubbard, City Clerk, Tammy Brunson and Interim City Attorney, Tim Sloan Callt to Order: Mr. Kerigan called meeting to order at 6:00 p.m. II. Swearing in of New Members: City Clerk swore in new members: Larry Henderson - Alternate 1 and Erik Fossage- - Alternate 2. Mr. Sloan reviewed the duties oft the Alternates and when they were required to vote. Alternate III. Consent Agenda: Mrs. Gardner motioned, and Mr. Ellzey seconded to approve the meeting minutes from 1 will vote when I member is absent and Alternate: 2 will vote when 2 members are absent. May 6, 2024. Motion passed unanimously. IV. Regular Agenda: Quasi-Judicial Hearing of Variance Request -3114 Hwy 98 -L Lance Watson with SCE, presented variance and stated that a portion of the city roadway is on this property which reduces the availability for impervious area. The reason for the variance request is to be able to use some space of the setbacks to offset some of this property thati is taken by the city roadway. The intent of this property is for a grocery store. The variance request is for 9.7ft on the south side, 3.2 on the northwest: side, 4.51 feet on the southwest side, and 1.31 feet on the north side. The intent oft the applicant, being granted this variance, is to deed the city a portion oft this area so1 the city will own the right of way to this section. He also stated that in the variance request application, they are requesting impervious area percentage and that he wanted to go on record: stating that they are not asking for this request. With the permeable pavers they Allara Mills Gutcher with tpc working on behalf of the City, stated that there was an analysis in the packet that they were given and went over the variance that was requested. Special conditions or physical circumstance requirement are met. Special conditions and circumstances that exist do not result from actions of the property owner and requirements are met. Relief granted is the minimum degree of relief necessary to make possible the reasonable use of the land in compliance with all other applicable regulations - due to the hardship placed on the site as a result of City action, this requirement is met. The existing character of this sitei is a centralized location within Mexico Beach of non-residential uses requirement is met. Recommendation of this variance, with removal of the impervious surfacei is approved. Lance added that before ar motion was made that thef front setback is 9.71 feet but he did want to make sure that it is mentioned in the motion that once this property is deeded to the Cityt that the 9.71 foot setback will be close toz zero. Mr. Kerigan asked that once property is deeded would there not need to be a request for variance, Allara stated that it would still need variance. Mr. Sloan asked specifically how this was advertised. Mr. Cox asked Zach Childs ifitv was typical to have a city right of wayt through a parking lot. Mr. Kerigan opened comments tot the public. Resident on 31st Street - just wanted understanding of the variance. He wanted to know if this was a variance or zoning issue and parking. Mr. Ellzey questioned since this was on the agenda as a Quasi-Judicial Hearing, he was concerned with making sure process was carried out properly. Allara stated that usually anyone commenting need to be sworn in. will be at 85.75% and willl be under the LDCI requirements and to please include in the motion. Asking about the property line on the other side oft the alley behind the property with trees and if maybe these trees could be taken down for parking. Allara stated we have to wait for the actual survey to be done. Mr. Sloan will review advertisement. Mr. Kerigan very much in favor of a grocery store on this property and very thankful that someone is willing to pursue this. Ms. Gardner also ini favor and feels that Mr. Duren cares about the community. Mr. Ellzey stated he was ready to make a motion and asked Mr. Sloan how specific he needs to be. Mr. Ellzey motioned to grant the variance as requested with the exception of requesting the impervious area percentage. Mr. Cox seconded the motion. Motion passes unanimously. ORDINANCE 838 - PROPOSED AMENDMENT FOR SIGN SECTION (POLITICAL SIGNS)- Chris Hubbard presented this Ordinance due to the confusion of the last election with the political signs andi tot try and make it easier on the staff to regulate these signs. Mr. Kerigan opened to the public. Lisa Logan, MB = stated this proposal was a waste of time to discuss. Closed public comments. Mr. Fossage did not think this would be worth the effort. Mr. Cox stated he was a big believer in the 1st and 2nd Amendment Right and to leave it alone. Ms. Gardner did agree that too many signs on residents' property was tacky. Mr. Henderson stated that it seemed to him that there were several misconceptions of where residents thought the ROW was, and he gets where the confusion is. Mr. Hubbard stated that there were a lot of property owners that don't know exactly where the ROW starts. Mr. Kerigan asked for a motion tor recommend or deny. Mr. Henderson motioned to denyt this proposal. Mr. Coxs seconded the motion. Motion passes unanimously to deny. V. ADIOURNMENT - Mr. Kerigan made motion to adjourn. Mr. Ellzey seconded.
