RESOLUTION R-2024-XX ARESOLUTIONOFTHETOWNCOUNCILOFTHETOWN OF LAKE HAMILTON, POLK COUNTY, FLORIDA, DECLARING A LOCAL STATE OF EMERGENCY FOR HURRICANE MILTON SIMULTANEOUSLY WITH POLK COUNTY, FLORIDA; PROVIDING FOR CONFLICTS; PROVIDING FOR: SEVERABILITY; AND: PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the State ofFlorida is under threat of being impacted by Hurricane Milton; WHEREAS, the Governor oft the State of Florida has declared a state of emergency for all counties in the State; WHEREAS, Polk County has declared a local state of emergency and; WHEREAS, The Town Council believe it advisable to declare a local state ofe emergency NOW' THEREFORE, BE ITI RESOLVED BY THE TOWN COUNCIL OF THE simultaneously with Polk County. TOWN OF LAKE HAMILTON, FLORIDA, AS FOLLOWS: SECTION1. The Town shall be under al local state of emergency immediately, a state ofe emergency has been declared by Polk County, Florida for Hurricane Milton on October 7,2024. Upon such declaration all terms and conditions imposed by Polk County shall be implemented along with all other applicable county, state and federal laws and regulations including, but not limited to, the provisions of $252.38, Florida Statutes. Any such state of emergency shall expire simultaneously with the expiration ofs such SECTION2. SECTION3. declaration by Polk County. SECTION 4. CONFLICTS. All Resolutions or part ofl Resolutions in conflict with any ofthe provisions of this Resolution are hereby repealed. SECTION 5. SEVERABILITY. Should any section, paragraph, clause, sentence, item, word, or provision oft this Resolution be declared invalid by a court ofcompetent jurisdiction, such decision shall not affect the validity of this Ordinance as a whole or any part hereof, not SO declared to Resolution R-2024-XX Page 2 of2 bei invalid.
