Currently, the City of Weed is scheduled to be closed on Wednesday, December 25th (Christmas Day) and January 1nd (New Year's Day). City Hall will also be closing at 12:00pm (noon) on Christmas Eve. By closing City Hall and allowing the employees at City Hall to take 3.5 days of vacation (Half day December 24, as well as all day 1. The city would save approximately $2,000 in utilities by having certain offices/Duldings 2. Itv would allow some departments to give their employees time off for the holidays and thus reduce the headaches of scheduling staff during an extremely slow week at City 3. Employees would be free to take off vacation which could take up to nearly $7,000 of December 26, 30, 31,)ita accomplishes multiple goals: closed during the break. Mayor Darrell Parham called the meeting to order and led recitation of the Pledge of Allegiance. Present, in addition to Mayor Parham, were Council Members Bob Hall, Mark Mazzoni, Ken Palfini, and Susan Tavalero. Also present were Interim City Manager Steven W. Baker, Police Chief. Council Member Palfini reported the senior lunch program is averaging 90 seniors per week, thanked the Siskiyou Democrats for volunteering, reported attending the Coller Interpretive Information meeting and there is a planned celebration oft their new! hiking trail October 9, 2024. The Council held a public hearing to discuss an appeal of the Planning Commission decisionon 8/21/24 for a use permit to sell drug paraphernalia at 375 S. Weed Blvd. Legend 295 Inc. Sarbjit Kang. Police Chief Mayberry recommended tabling this item due to an ongoing investigation. City Attorney Ruderman recommended continuing with the public hearing. Contract Planner Teague presented the staffr report. The Public hearing was opened at 5:57pm. Kurk Reichel, representing the applicant, stated he was unaware oft the current events and requested waiving the 45 days for council decision and give time for thei investigation. The City Attorney presented the council with two options. Council Members requested information regarding testimony at the planning commission. Council Members' questions were asked and answered. The public hearing was closed at 6:13pm. Council Member Tavalero made a motion to table the item. X.STAFF REPORTS Fire reported the grant for the tank was approved and scheduled to be installed by. June 2025, chassis fori the Type III was delivered to Medford for buildout, Engine 1214 has been assigned to the Bridge Fire and ongoing training. Finance reported the new software is being implemented, and reported on grants the city is applying for. Public Works reported on active projects within the city, the Museum is open for business, the application for the Lincoln Heights paving project was completed, and reported on personnel changes. The Police Department responded to 1869 calls for service, 52 cases pulled, 10 arrests, schools back in session and they are monitoring speeding within the school areas, and K9 Drax assisted the Siskiyou County Sheriff's Office with a traffic stop. Drax alerted the vehicle and approx. eight (8) pounds of fentanyl was discovered. XL,ADIOURNMENT Council Member Hall moved to adjourn. BACKGROUND The Housing Element is a mandated element of the General Plan and is the only Element thati is required to be updated on a regular basis. This is the sixth update cycle, andi ifa adopted the new element is valid for eight years. The process for updating the housing element re- quires review and compliance by the State Housing and Community Development Depart- ment (HCD). The City has received its conditional compliance letter from HCD. See Attach- Key toi the Housing Element is a demonstration that there is sufficient land within the city with the appropriate land use designation and zoning to accommodate housing. The regional housing needs allocation (RHNA) is assigned to the city by the state. For the City of Weed the RHNA is twol housing units. As the City does not build the housing units, a RHNA buffer is recommended to give the City the ability to approve housing projects at less than the maximum density. The City will increase the allowable density in the High-Density Residential Land Use Designation to at least 15 units per acre to ensure consistency with the R-3 and R-4 zoning dis- tricts. Additionally, as required by State law, the City will complete an annual review which will cover consistency between the Housing Element and the other General Plan Elements. As portions of the General Plan are amended, the Housing Element will be reviewed and revised to ensure that internal consistency is maintained. As ar rural community the City has a default density of 15 units tot the acre as set by state law. (Government Code $65853.2) When HCD reviewed' Volume 1oft the General Plan they read that High Density could not exceed 12 units toi the acre (Vol. 1, Page 46) The actual adopted General Plan Designation is under the Preferred Alternative is shown in Table 5.2.3 on page 134 of Volume 2 that allows 16 - 21 units to the acre which is consistent with the default density. As such there is no reason to change the General Plan. Staff will later change how the General Plan is published to eliminate later confusion, but that will take more effort and discussion with the Commission. Perhaps in spring of 2025. 3 Zoning Changes There were several minor changes to the existing zoning code required by the Housing Ele- ment update. The recommended zone changes are included Exhibits A through D of this Staff Report. As can be seen in the changes, there are additions to definitions and minor changes to procedures, and a better connection to the Zoning District Regulations Table. The changes, such as adding uses as residential" to the table, are consistent with state law which already applies to the City. The reason that the changes are included in this action even though the provisions already apply to the City, is that HCD requires that the zoning code mirror state law to avoid confusion. ENVIRONMENTAL REVIEW AND FINDINGS The proposed project meets the criteria for an exemption from the California Environmental Quality Act Guidelines (CEQA) Section 153061(b)(3). Common Sense Exemption: The activity is covered by the commonsense exemption that CEQA applies only to projects which have the potential for causing a. significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not. subject Policies, programs, and actions included ini the Housing Element Update encourage housing production and outline steps for the future implementation of certain actions consistent with the existing Land Use Element of the General Plan. Project Description 2.1 REGIONAL LOCATION The City of Weed is located in California, nestled ati the base of Mount Shasta int the Cascade Mountains and halfway between San Francisco and Portland in Siskiyou County. It covers approximately 280 acres. There aresevealunincorporated subdivisions adjacent to, orj just outside' Weed proper. These include Edgewood, Carrick, Lake Shastina, Rancho Hills, and Hammond Ranch. 2.2 PROPOSED PROJECT 2.2.1 Project Background The City of Weed is preparing an update toi its existing Housing Element, a State-mandated policy document that is a component oft the City of Weed General Plan. The overall purpose oft the Housing Element Update ist toi identify current and projected housing needs; show locations where housing can be built; and: set goals, policies, and programs to meet the community's housing needs. Thei foundation of the Housing Element is the Regional Housing Needs Allocation (RHNA), which begins with a determination of housing need issued byt the California Housing and Community Development Department (HCD). The RHNA for the City of Weed fori this Housing Element is two units, one very low-income unit and one low-income unit. 2.2.2 Proposed Sites and Zoning State law requires that the Housing Element identify adequate sites for housing by including an inventory of land suitable for residential development, including vacant sites and sites having potential for redevelopment, including analysis of the development capacity that can realistically be achieved for each site. The purpose of the Sites Inventory is to evaluate whether there are sufficient sites with appropriate zoning to meet the RHNA. Iti is based on the City's current land use designations and zoning requirements. The City's Sites Inventory for future housing identifies housing sites spread throughout the city that could be developed with up to 29 new housing units, exceeding the RHNA assigned to the City. A significant number oft these sites are located ini moderate resource areas to meet Affirmatively Furthering Fair Housing (AFFH) requirements. No area in the city is designated Racially/Ethnically, Concentrated Areas of Poverty (R/ECAP) area. The development capacity of each of the identified housing sites is based on existing land use and zoning densities currently in place. Findings Concerning CEQA Exemption 3.1 SECTION 15061(B)(3): COMMON SENSE EXEMPTION The proposed project is exempt as a "common sense" exemption under State CEQA Guidelines Section 15061(b)(3) becauset the project involves policies, programs, and actions to meet the City's RHNA: allocation that would not have the potential to cause a significant physical effect on the environment. As it can be seen with certainty that there is no possibility that the proposed 6th Cycle Housing Element Update would have a significant effect on the environment, the 6th Cycle Housing Element is exempt from CEQA under the common sense exemption. 3.2 ANALYSIS IN SUPPORT OF FINDINGS Policies, programs, and actions included int the Housing Element encourage housing production and outline steps for the future implementation of certain actions. Future implementation actions would include amendments to: zoning and other regulations tof facilitate housing development; however, no amendments tot the City's land use regulations are included in the Housing Element Update. In addition, as discussed in Section 2.2.2, Proposed. Sites and. Zoning, the Housing Sites Inventory utilizes existing land use and zoning densities and does not require redesignation or rezoning to meet the RHNA. Transit is mostly handled by STAGE, the local transit system which is part oft the County. Any decisions on STAGE that are acted on must also be acted on by the County Board of Supervisors as well. This creates a decision- making process that is lengthier than it needs to be and also puts some final decisions on STAGE By creating this JPA, the decisions on STAGE will be made using the same representation structure between the cities and county as thel LTC. At a minimum the Board shall meet annually. 7.3. Brown Act. All meetings of the Board shall be called, noticed, held, and conducted in accordance with the provisions of Government Code Section 54950, et seq. 7.4. Minutes and Records. The Executive Director of the Agency shall provide for the keeping of minutes of regular and special meetings of the Board and shall provide a copy of the minutes to each member of the Board at the next scheduled meeting. 7.5. Quorum. A majority of the members of the Board shall constitute a quorum to conduct a meeting. A vote of a majority of the members of the Board is necessary to take action. ARTICLE8 COMMITTEES 8.1. The Board of Directors may establish committees, as it deems appropriate, to conduct the business of the. Agency. Members of the committees shall be appointed by the Board, to serve one-year terms, subject to reappointment by the Board. Each committee shall be composed of at least three members and shall have those duties as determined by the Board or as otherwise set forth in the Bylaws. The members of each committee shall annually select one of their members to chair the committee. Each committee shall annually prepare and submit a report to the Board of Directors as to the activities and 8.2. Pursuant to Government Code Section 6505, the Agency shall either make or contract with a certified public accountant to perform an annual fiscal audit of all accounts and records of the Agency, conforming in all respects with the requirements of that section. The annual audit may be performed in conjunction with the annual audit requirements of the Siskiyou County Local Transportation Commission. A report of the audit shall be filed as a public record with the Auditor within twelve months of the end of the fiscal year under examination pursuant to Government Code 6505. The costs of the pursuant to. Article 6 oft this Agreement. as set forth in Government Code Section 6505. audit shall be considered an administrative cost of the Agency. 6 ARTICLE 11 RESPONSIBILITIES FOR FUNDS AND PROPERTY 11.1. Auditor. The Auditor shall be responsible for disbursement of the Agency's funds in compliance with Government Code Section 6505.5. The Auditor shall draw warrants to pay demands againsttheA Agency, making such payments fromA Agency funds, as approved 11.2. Treasurer's Duties. Pursuant to Government Code 6505.5, the Treasurer shall receive and Acknowledge receipt for all funds of the Agency and place them in the Treasury to the 11.3. Reports to the Agency. Pursuant to Government Code 6505.5 (e), at the request of the Board, the Auditor and Treasurer shall verify and report in writing tot the agency and to the contracting MEMBERS to the Agreement, the amount of money thati is held for the Agency, the amount of receipts since the last report, and the amount paid out since the last report. 11.4. Property. Pursuant to Government Code Section 6505.1, the Executive Director, and such other persons as the Board of Directors may designate, shall have charge of, handle, and have access to the property of the Agency. Property and Rolling Stock as identified in Attachment, A, attached hereto as part of the Agreement, shall bet transferred to the Agency within 90 days of execution of the Agreement. It is recognized by each MEMBER that said rolling stock was purchased by County from various transit grants with the intended use 11.5. Outstanding Revenues or Expenditures. The Agency shall be responsible for all expenditures and receive all revenues generated priort tot thet formation of the Agency. The Agency shall receive all future dividends authorized by the CalTIP Board of Directors. 11.6. Bonds. Pursuant to Government Code 6505.1, the Agency shall secure and pay for a fidelity bond or bonds in an amount or amounts and in the form specified by the Board covering all officers and staff of the Agency and all officers and staff that are authorized to by the Board of Directors or their designated representative. credit oft the Agency. being for transit services. have charge of, handle, and have access to property of the Agency. ARTICLE 12 WITHDRAWAL, DISSOLUTION, OR TERMINATION AND DISTRIBUTION OF ASSETS 12.1. Withdrawal from the Agency. It is anticipated that each MEMBER hereto shall participate int the Agency until purposes seti forth ini this Agreement are accomplished. The withdrawal of either MEMBER, either voluntary or involuntary, shall cause the Agreement to be terminated according to the following conditions: 7 a) In the case of voluntary withdrawal following a properly noticed public hearing, written notice shall be given tot the Agency, one hundred twenty (120) days prior to Termination oft the Agency shall not relieve the Agency ofi its debts or other liabilities prior to the effective date of the MEMBER'S notice of withdrawal. All debts, liabilities, and obligations incurred by the Agency shall be honored prior to apportionment and or distribution of remaining funds, including but not limited to the effective date of withdrawal; and b) contracts for transit services. 12.2. Dissolution of Agency. Upon dissolution of the Agency, there shall be a partial or complete distribution of assets and liabilities as follows: a) Upon termination of the. Agency, all funds including the proceeds of the sale of property, int the possession oft the Agency after payment of all costs, expenses, and charges validly incurred under this Agreement, shall be returned to the MEMBERS inj proportion toi their contribution as shall be determined by the Board. 12.3. Distribution of Assets. The assets listed in Attachment A shall be returned to each MEMBER. Additional assets acquired by the Agency shall be distributed to the MEMBERS inp proportion to their contribution as shall be determined by the Board in compliance with the Transportation Development Act. The distribution of assets may be made in kind or assets may be sold and the proceeds thereof distributed to the MEMBERS at the time of 12.4. Surplus Revenues. Upon termination of the Agency, all funds including the proceeds of the sale of property, in the possession of the Agency after payment of all costs, expenses, and charges validly incurred under this Agreement, shall be returned tot the MEMBERS in dissolution after the discharge of all enforceable liabilities. proportion to their contribution as shall be determined by the Board.
