MINUTES OF THE TOWN OF ARGYLE WEDNESDAY, SEPTEMBER 4, 2024 PLANNING AND ZONING COMMISSION REGULAR MEETING AI regular meeting of the Argyle Planning and Zoning Commission was held on' Wednesday, September 4, 2024, at 6:00 p.m. This was an OPEN MEETING, open toi the public, subject to the open meeting laws of the State of Texas and, as required by law, was hereby posted on August 30, 2024 at 5:00 PM, at Argyle Town Hall, giving notice of time, date, place, and agenda thereof. "Honor the Texas Flag; I pledge allegiance to thee Texas, OPEN FORUM: Pursuant to Section 551.007 of the Texas Government Code, any member of the public has the opportunity to address the Planning and Zoning Commission concerning any matter of public business or any posted agenda item; however, the Act prohibits the Planning and Zoning Commission from deliberating any issues not on the public agenda and such non-agenda issues may be referred to Town staff for research and any future action; all persons addressing are limited to five (5) minutes and subject to council adopted rules and limitations permitted by Chairman Nelson opened the meeting to public comment. With no speakers, Chairman Nelson closed law. the open forum at 6:06 PM. CONSENT AGENDA 1. Consider approval of the minutes of the Regular Planning and Zoning Commission Meeting of August 7, 2024. Minutes oft the September 4, 2024 Page 2of3 Argyle Planning & Zoning Commission Commissioner Lewis motioned to approve the minutes of the Planning and Zoning Commission Regular Meeting of August 7, 2024, as presented. Commissioner Snell seconded the motion. The motion carried unanimously by a vote off four (4) in favor to none (0) opposed. PUBLIC HEARING ITEMS 2. Hold a public hearing, consider and make recommendation on a Specific Use Permit (SUP- 24-006) amendment to a Child Day Care Center (Business) use, known as Argyle Christian Academy, located at 319 South US Hwy 377, Town of Argyle, Denton County, Texas; and being located on the east side of US Hwy 377, south of Cook Street, and north of FM 407. Principal Planner Harrison Wicks provided a presentation on the item. Property owner Mr. James Reid spoke and answered questions. The Commission discussed the item and considered the Chairman Nelson opened the public hearing at 6:20 PM. With no speakers, Chairman Nelson Commissioner Brading motioned to recommend approval to Town Council for Specific Use Permit (SUP-24-006) as presented by Town staff. Commissioner Lewis seconded the motion. The motion 3. Hold a public hearing, consider and make recommendation on an ordinance amendment (TDS-24-007) amending Article III, Zoning, of the Town of Argyle Town Development Community Development Director Nur provided a presentation on the item. The Commission Chairman Neison opened the public hearing at 6:40 PM. The following individual spoke: proposed specific use permit request. closed the public hearing at 6:21 PM. carried unanimously by a vote ofi four (4) in favor to none (0) opposed. Standards regarding amendments to landscape buffer requirements. discussed the item and considered the proposed ordinance amendment. 1. Commissioner Lewis motioned to recommend approval to Town Council for ordinance amendment (TDS-24-007) as presented by Town staff. Commissioner Snell seconded the motion. The motion 4. Hold a public hearing, consider and make recommendation on an ordinance amendment (TDS-24-008) amending Article III, Zoning, of the Town of Argyle Town Development Standards regarding Accessory Buildings, Accessory Dwellings, and Use Regulations. Community Development Director Nur provided a presentation on the item. The Commission Chairman Nelson opened the public hearing at 6:58 PM. With no speakers, Chairman Nelson Commissioner Snell motioned to recommend approval to Town Council for ordinance amendment carried unanimously by a vote ofi four (4) in favor to none (0) opposed. discussed the item and considered the proposed ordinance amendment. closed the public hearing at 6:59 PM. That reference to caretaker, servant and farm worker be removed from the ordinance. 2. That an agricultural exception be added to the size limitation for accessory buildings. Commissioner Brading seconded the motion. The motion carried unanimously by a vote of four (4) ini favor to none (0) opposed. FUTURE AGENDA AND ITEMS OF INTEREST 5. Active Development Project List overview of upcoming projects. Town staff provided the commission with recent development project updates and gave an ADJOURNMENT Commissioner Brading moved to adjourn the meeting. Commissioner Lewis seconded the motion.
