Lopez Commissioner A1 Resolution of the Board of County Commissioners of Las Animas County, Colorado, Returning to a STAGE 1 FIRE RESTRICTION within unincorporated Las Animas County Resolution No. 22-027 Whereas, Pursuant to C.R.S. 30-14-401(.5, the Las Animas County Board of Commissioners has the general power and authority to adopt a resolution as deemed necessary for the control of open fires and to establish restrictions that may be necessary to protect the health, safety and general welfare of the citizens of Las Animas County; Whereas, Moisture recently received has reduced Las Animas County's Whereas, County Sheriff Derek Navarette, in his capacity as County Fire Warden, susceptibility to wildfire incidents; is authorized under provisions of C.R.S. 30-10-512 and C.R.S. 30-10- 513 to assume forest and /or prairie fire management; Whereas, Changing fire conditions require that restrictions be established and implemented as to mitigate, as much as practical, the threat of fire to the citizens and their property within Las Animas County; Whereas, On July 27, 2022, the Las Animas County Fire Chiefs Association voted unanimously to recommend to the Las Animas County Board of County Commissioners to move from a Stage 2 to a Stage 1 Fire Restriction and the Fire Chiefs' and Fire Warden/Sherif Dereck Navarette's recommendation and available Wildland Fire information including the Wildland Fire Outlook rating established by the National Interagency Fire Center Predictive Services, iti is prudent to reduce the current Stage 2 Fire Restriction to a Stage 1 Fire Restriction throughout Las Animas Whereas, The Las Animas County Board of Commissioner believe that, based on County. Now, therefore, be it Resolved by the Board of Commissioners of Las Animas County, Colorado, that: 1. Las Animas County hereby returns to a STAGE 1 FIRE RESTRICTION that includes the BANNING of all open fires within Las Animas County with the following allowances (all permitted activities shall be diligently supervised and never left unattended): a) Campfires, warming fires and charcoal fires in permanent fire rings with covering grates located within a developed commercial b) LP gas or liquid fueled stoves and appliances which allow the c) Fireplaces within enclosed building which are equipped with d) Combustion engines, all-terrain vehicles and/or chainsaws with adequate spark arrestors and all types of welders with a spotter provided that the operator has with him/her a pressurized chemical fire extinguisher of no less than five (5) pounds of capacity, a size O (or larger) round-pointed shovel with an overall length of no less than thirty-six (36) inches, and a container of water no less than five (5) gallons. The use of combustion engines and chainsaws shall conclude by 4:00 P.M. each day and the site where such equipment has been used shall be monitored for a minimum of one (1) hour e) Smoking of tobacco products in open non-combustible areas of no less than five foot (5') in radius and in conformance with other applicable laws (including the Clean Indoor. Air Actof2006) and shall include proper disposal ofall cigarette and cigar butts f) Burning of vegetative waste is permitted ONLY UPON the issuance of valid Controlled Burn Permit issued by the Las Animas County Fire Warden and authorized fire protection district. Agricultural burns must also have valid Controlled Burn Permit from Fire Warden and fire protection district havingjurisdiction. By state statute definition, an agricultural burn is the burning of non- woody vegetation in irrigation ditches and/or cultivated fields by an agricultural producer. Burning conditions may vary in different areas of the county as current fuel conditions, fuel types and amount of precipitation received is not uniform.
