Trustee Snooks discloses a possible bid for Cinnamon Heights. Town Attorney Goldman states he should Rick Ludwig 9002 County Rd. 521. As a Campbell Lateral ditch rider and a Board Member. Mustang Crossing was originally approved with the condition of the ditch being piped. The developer requested ac delay in piping the ditch when the project was broken down in to smaller sections. The ditch company was not consulted or notified. There are significant liability and safety issues with the ditch being opened to the public. The fence installed that the developeri installed does not keep people out of the ditch. Campbell Lateral requests that the ditch be piped prior to any new construction. Brian Blanchard 627 Louisiana Dr. My comments are small town tonight. Have a plan for the future. Failing to plan means planning to fail. Some people in small towns do not like change but change is inevitable. Two kinds of change. Planned or un-planned. Let us move forward not back. Marian Tone 1495 CR. 526 supports Mr. Ludwig comments. Need to get communication from the ditch companies. September 28 is Bayfield Heritage Day. Lucy Stewart 128 N. Appaloosa. Been watching the construction. Is afraid that they are going to get flooded out. If anyone has time please come look and help it make sense. All the things with the ditches and stormwater needs to be addressed. It will affect everyone in Town because of how the construction is done. Kay Phelps 1048 N. Oak Dr. therc are good things going on in Bayfield. There is a park and iti is the most beautiful park. Does not want to see the Board buy Katie out. Back her or not. The School District made a mistake multiple times taking money away from the kids. Glad to see the Board in more attendance. Trustee Katsos would like to walk the property with Ms. Killian and Ms. Stewart. Trustee Morlan asks if we can get the developer there to alleviate her concerns. Josh. Joswick 64 S. Los Pinos. Was the Mayor for five years and on the Town Board. Pulls out Ms. Sickles Performance Improvement Plan (PIP) and states this is embarrassing and you should not take pride ini this and should be ashamed. And this should be PHP Public Humiliation Policy. Your constituents still do not know why. She has passed her yearly performance reviews. Ini four months four of you have determined she has not done thet things required of her. Why? Isure would like some examples. Item 41 build a succession plan, what an insult. The PIP is written specifically to cause pain. In 1986, there was a Board that was arrogant and ignorant and they almost broke this Town. Chaos is power, Ifear your dedication to that cause is stronger than your dedication to bettering the Town. We deserve to know where you are taking us. Any Trustee that signs this PIP is complicit in this farce. Ms. Sickles answers Motion to Approve Grant $1000.00 to B.A.A.M.: Trustee MacLaurin Agenda Item #2: Cinnamon Heights Agenda Item #2 A: Documentation of Public History Katie Sickles (Town Manager) gives report. Goes through the history of the email polls and posted meetings and resolutions involved with Cinnamon Heights. Approved minutes. Resolution #486. Meeting on June 1. Another big meeting on June 15. All which have been posted by state statute. On November 2 adopted the 2022 budget and goals also included those documents. Lori Lazzeri provided a Durango Herald article. The documents that were in executive session that were due diligence. Ms. Sickles states that she asked Town Attorney Goldman about the documents in executive session. Town Attorney Goldman states the primary reasons for those executive sessions is for negotiations in dealing and buying real estate. You do not want to play your hand to the public when you are negotiating. Trustee Nyberg states this has been well documented and he has no concerns there. Brian Blanchard 627 Louisiana Dr. states the public is confused about what we are doing with Cinnamon Heights. Was there a problem among the Trustoos? Foryears we have talking about work force housing. Does not understand why we are here and does not understand the Board's concerns with this. Mr. Blanchard asks does the Board have any issues with Cinnamon Heights? Trustee Hartz states she echoes what Town Attorney Goldman states that new Board members did not have all the information. Trustee Morlan states she has voted for it for six years and has no issues. Trustee Hartz states she does not know how to answer that. Trustee Nyberg states not at this time. Agenda Item #2 B: Project Timeline Agenda Item #2 D: Developer Partner Contract Agenda Item #2 E: SGM Proposal Agenda Item #2C: Division of Housing Transformation Affordable Housing Grant Nicol Killian (Community Development Director) goes over the projects timelines. Had an architect look to make sure the plan matches the new building codes. States when Homes Fund gets involved. 80-120 AMI. Updated by HUD. The Town would have first right of refusal. Allowed to have 3% equity. 30-year deed restriction. Qualifications back from Silver Mountain Group. Goes over the grants for the project. Town Attorney Goldman states when we get a contract form the State we have to make sure itgets in the contract for the developer. Hoping to get to the Board by the 17th. We need approvals from the Board sO we can get grant funding. State grant contract and the developer partner contract and the contract with the County for the ARPA Funds. Needs 2 Town of Bayfield Regular Town Board Meeting September 3, 2024 1199 Bayfield Parkway Bayfield, CO81122 to be re-platted and adjusted. Infrastructure needs to start for the state grant. April 2026 is the deadline for the state contract. Should always have another engineer check the Town's engineer's work. SGM has a couple of things in the change order. Trustee Katsos thanks Ms. Killian for the work. Marian Tone asks was the Sewer Fund reimbursed. Why would public funds be used to re-plat private homes. Never apologize for asking questions this is a huge use of public funds. Ms. Sickles states the Sewer Fund was reimbursed almost completely with ARPA funds. The Board decided to reimburse the remaining part when those lots were sold. Ms. Killian on the plat we have to revise our pieces. Lori Lazzeri asks The Bayfield Town closed on these lots on 5/19/2021. It was reported in the Durango Herald on 5/15 and then on Facebook. Pat Bond Chairman of the Regional Housing Alliance of La Plata County. Durango does not care about Bayfield or Ignacio. Durango and the County are in conflict. Sincel Ihave been on the RHA, the Board has done better at working together. Grants are like gold these two have done a great job getting them. The average house in Bayfield costs $42,000 a year for principal interest and insurance. If you do not get them now you won't see them in ten years. respectfully ask you to approve this project. Linda Curtis 290 E. East Dr. asks what point in time did the Town become involved in purchasing this land. Trustee Morlan references the information timeline in the packet. Town Attorney Goldman states it was a great opportunity to get the property. Ms. Sickles states instead of having the Town pay for this we can have a grant pay fori it. Ms. Tone asks itj just wasn'tthe money and had there been more transparency on such a major policy change. People want a lot more accountability and transparency. Trustee Morlan states that was why there was a bigger presentation today. The public needs to be involved and feels it was 2020 and COVID and families had other things on their minds. Ms. Killian states the infrastructure will be covered by grants. Ms. Killian reiterates the need in a community for workforce housing. Trustee Nyberg asks if we still recoup the water and sewer tap fees. Ms. Killian states the grant would cover that for us. Trustee Katsos states Motion to direct staff to proceed to work on the Cinnamon Heights DOH TAHG Grant Contract, and Developer Partner Contract with Silver Mountain Group, LLC and bring final contracts to the September 17, 2024 Board rarely do those units come up for sale and this is a huge need. As of May of this year the district can adopt it without the Board of Trustees. They have to do a public comment period until September 18. Staff sent a letter asking the fees be waived for deed restricted or subsidized housing. Tractor Supply would have paid $45,000. Those developments will not pay that since they are under construction. Billing changes for the stormwater were challenging but done. Kristin Dallison (Deputy Town Clerk) has done a great job getting quotes for having Caselle come do some training for her, Town Clerk Hayden and our new front desk Mark Robinson (Parks and Trails Director) gives report. Shade structure at Mesa Park done. Pleased with the outcome. All done in one week. Property got ruts due to weather. Contractor cleaned it up. Tree at Eagle Park downed due to weather. Probably about 55 years old. Rented a roller to smooth the turf out and did all the sports fields. High influx of prairie dogs and rodents. Major safety issue. Had good experience with San Juan Wildlife. They are not as successful now. Did some research and found a machine that seems to be working. Emilio and Josh put plugs in for the sports fields sO marking the fields will be easier. Trustee MacLaurin states good job getting the tree cleaned up sO good and fast. And HR Director Kehm made the plan. Trustee Morlan asks why it is dated the 30th. Lucy Stewart states I'm not a Katie supporter and not the opposite. We disagree but always find common ground. It is a slap in the face that anyone would know how to do her job. You are not here to pick and choose. You are here to support us the people who pay taxes. She can'tmake everyone happy. Do not listen to little lips investigate find out for yourself. Trustee Katsos asks for the Morovan letter in the next packet. Trustee Morlan does not want a build a succession plan be part of the PIP. Trustee Snooks and Nyberg and Katsos concur. Trustee Hartz states after the executive session and constant education. Feels the plan is not appropriate and not measureable. Feels iti is important that we have one however. Feels that the timeline is appropriate for review anyway. Mr. Joswick states there is four Board Members that want Katie out. She hopes this is just his speculation. Trustee Morlan states the PIP has already been approved. But does not agree with the terms. Trustee Katsos is not pleased with how this has played out at all. Trustee Morlan asks can we change the PIP terms or motion to remove the PIP. Town Attorney Goldman states the Board could motion to remove or amend it.
