FAIRVIEW TOWN COUNCIL MEETING MINUTES SEPTEMBER 3, 2024 The Town Council met for their regular session on September 3, 2024 at 372 Town Council present: Mayor Henry Lessner and Mayor Pro Tem John Hubbard, and Council members Rich Connelly, Gregg Custer, Ricardo Doi, Larry Little, and Ken Logsdon. Receive a presentation recognizing the Fairview Police Department for achieving Accreditation Status by the Texas Law Enforcement Accreditation Program through the Texas Police Chiefs Association Foundation City of Allen Police Chief, Steve Dye, to speak. The Allen Chief spoke regarding the requirements to achieve accreditation and presented the Fairview Police 2024 as National Payroll Week. Department with their accreditation certificate. Chief Chandler thanked Assistant Chief Sullivan and Officer Tomlinson for their hard work on this process. 4. Citizen's Comment (for Non-Public Hearing Items) Mayor Lessner called for Citizen's Comments. No one wished to speak when called for. 5. Consent Agenda Mayor Lessner called for the Consent Agenda. Council member Connelly submitted corrections on the August 1, 2024 special meeting and the August 6, 2024 regular meeting minutes to the Town Secretary. Council passed the motion by Council member Doi, seconded by Council member Logsdon, to approve the Consent Agenda in a vote of Yes 7, No 0, Abstained 0 a. Corp. regarding their 2024 rate review mechanism filing 6. Reports from Staff Mr. Ventura reviewed the Monthly Financial Report - Period ending July 31, 2024. Police Chief Chandler reviewed the Monthly Police Report- - Period ending August The monthly Fire report for period ending August 31, 2024 was submitted to Texas Representative Candy Noble presented a proclamation to the Fairview Fire Department honoring 50 years of service. Mayor Lessner and Former Fire Chief The monthly Code report for period ending August 31, 2024 was submitted to Mr. Chancellor provided an update on Town construction projects. 31, ,2024. Conduct a public hearing to consider, discuss, and take any necessary action ona a request for approval of an Ordinance approving a Conditional Use Permit (CUP) for a sports court (pickleball). The 1.1-acre site is located at 1021 Pecan Drive and is zoned for a (RE-1)One-acre Ranch Estate District. Owner/Applicant: Dave Flemming. Mayor Lessner called for item 7(a). Mr. Roberts spoke regarding this item. The applicant met all the requirements of the Town's ordinances. Staff and the Planning & Zoning Commission The Council and staff had discussion regarding this item. recommended approval. The applicant spoke regarding this item. Mayor Lessner opened the public hearing. No one requested to speak. Mayor Lessner closed the public hearing. Council passed the motion by Council member Doi, seconded by Council member Connelly, to approve an Ordinance approving a Conditional Use Permit (CUP)fora sports court (pickleball) in a vote of Yes 7, No 0, Abstained 0. 8. Action/Discussion Items a. - Consider, discuss, and take any necessary action on a Tower License Agreement with McKinney Amateur Radio Club Mayor Lessner called for item 8(a). Mr. Wilbourn spoke regarding this item. Mr. Wilbourn stated that the License Agreement will allow the McKinney Amateur Radio Club to install and operate a signal relay. Staff recommends approval subject to legal approval and plan review. Representatives from the McKinney Amateur Radio Club gave a presentation on the License Agreement. The Council and staff had discussion regarding this item. Council passed the motion by Council member Custer, seconded by Council member Connelly, to approve a Tower License Agreement with McKinney Amateur Radio Club subject to legal approval and plan review, in a vote of Yes 7, No0 0, b. Consider, discuss, and take any necessary action regarding a possible move of the regular October Council meeting date due to National Night Out Abstained 0. Mayor Lessner called for item 8(b). Ms. Couch spoke regarding this item. Ms. Couch stated that National Night Out is regularly scheduled for the first Tuesday in October, which would conflict with the Town's Council Meeting. Chief Chandler spoke regarding scheduled National Night Out events within the Town. The Council and staff had discussion regarding this item. Council passed the motion by Council member Doi, seconded by Mayor Lessner, to approve moving the regular October Council meeting date due to National Night The Regular Town Council meeting will be on Wednesday, October 2, 2024, in Council Chamber located at 372 Town Place, Fairview, Texas. C. - Consider, discuss the Town Disaster Plan Mayor Lessner called for item 8(c). Out in a vote of Yes 7, No 0, Abstained 0. Council member Custer spoke regarding this item. The Council member requested the Town to create a Disaster Response Plan for Fairview residents. The Council and staff had discussion regarding this item. The Council gave direction to staff to coordinate some meetings to address this item. 9. Council and Staff Comments Mayor Lessner called for Council and Staff Comments. The Mayor spoke regarding about the Rotary Club. Council member Doi spoke regarding the Town Disaster Plan. 11. Adjourn Mayor Lessner adjourned the meeting at 9:02 PM.
