PRESENTATION BY PLANNING AND ZONING COMMISSION PZ-2024-02 Consider adopting an ordinance rezoning 2.546 acres of land, Z-24-02 legally described as Lot 1, Block 1 of the A.D. Jackson Addition, Benbrook, Texas (4632 Williams Road) from "C" Multiple-Family District to "A" One-Family. The property is generally located northwest of the intersection of Williams Road and Meadowside Drive (Public Hearing) Jim Hinderaker gave the following report: According to the Tarrant County Appraisal District, a single-family home was In1 1990, City Council adopted Ordinance 866 rezoning the property from "D" Multiple-Family District to "C"N Multiple-Family District (City file #s Z-90-01 The residential use of the subject property is non-conforming as single- family dwellings are only permitted in One-Family Districts. The applicants recently submitted an application to construct an accessory building on the subject property, which requires approval of a Conditional Use Permit (CUP) prior to issuance of a building permit (BMC: 17.84.030.H). Rather than pursuing the CUP, the applicants chose to rezone the subject property from "C" Multiple-Family District to "A" One-Family District. The "A" district zoning regulations do not require approval of a CUP for an accessory built on the subject property in 1942. and PZ- 90-01). 4 building (BMC: 17.84.030.G), and brings the use oft the property into conformance. The rezone request is consistent with the City's Comprehensive Plan and adjacent zoning: The Future Land Use Map (FLUM; see. Attachment 2) designates this area forl Low-Density Residential (LDR), which provides for densities up to 6.25 dwelling units per acre. The "A" District is consistent with the LDR Properties to the north and west of the subject site are also zoned "A" designation. District (see Attachment 3). The platted lot conforms to the "A" District's use regulations and dimensional standards and (BMC: Table 17.20.070 and Section 17.36.030): Uses permitted-Dy-right in "C" Multiple-Family Districts include attached one-, two-, three-, and four-family dwellings. The "C" district prohibits a detached single-family dwelling, which is only permitted in One-Family Districts, like the "A" District. Minimum lot size: 9,000 SF; Proposed: 110,903.76 SF. Minimum lot width: 75 FT; Proposed: 347.92 FT. additional residential lots in the future. Based on the proposed zoning district, the property could be replatted into See. Attachment 4 for comparisons between various dimensional and development zoning standards for the "C"and "A" Districts. Mayor Ward opened the public hearing at 7:42 p.m. Rick Vasquez requested clarification of future land use for Lot 1, Block 1 of the A.D. Jackson Addition. Mayor Motion by Dr. Marshall, seconded by Ms. Mackey to adopt the Ordinance No. 1502, rezoning Lot 1, Block 1, oft the A.D. Jackson Addition from "C" Multiple-Family District Ward closed the public hearing at 7:46 p.m. to"A" One-Family District. Ordinance No. 1502 being "AN ORDINANCE AMENDING TITLE1 17-Z ZONING OF THE BENBROOK MUNICIPAL CODE (1985), AS AMENDED, BY REZONING 2.546 ACRES LEGALLY DESCRIBED AS LOT 1, BLOCK 1, A.D. JACKSON 5 Motion by Mr. Phillips, seconded by Mr. Tiner to award the Timberline Drive Drainage Project contract to Patcon Services for $284,936.30.
