COUTA  MISS  Dale County Commission  Commission Meeting Minutes = April12,2022  The Dale County Commission convened in a regular session Tuesday, April 12, 2022. The following members were present: Chairman Steve McKinnon; District One Commissioner Chris Carroll; District Two Commissioner Donald O. Grantham; District Three Commissioner Charles W. Gary; and District Four Commissioner Frankie Wilson. Chairman McKinnon called the meeting to order at 10:00am. Commissioner Wilson opened with the Pledge of Allegiance. Commissioner Carroll followed with prayer.  APPROVED - AGENDA  Commissioner Grantham made a motion to approve the agenda.  Commissioner Carroll seconded the motion, all voted aye. Motion carried.  APPROVED = MEMORANDUMI OF WARRANTS  Commissioner Wilson made a motion to approve the following Memorandum of Warrants:  Accounts Payable Check Numbers 92644-92809. APPROVED = BOARD APPOINTMENTS = DALE CO HEALTHCARE AUTHORITY Commissioner Gary made a motion to approve the following board appointments to the Dale  County Healthcare Authority Board:  Dr.. Jeff Walding (until May, 2023, replacing Mr. Nolan Williams) Mr. Jeff Johnston (until May, 2025, replacing Mr. Larry Ezell)  Commissioner Wilson seconded the motion, all voted aye. TABLED - BID - TRAINING FACILITY-I DCP 23-11-21  After opening the bids, Commissioner Gary made a motion to table the awarding of the bid  for the metal lean-to and concrete apron addition for the Training Facility. Commissioner Grantham seconded the motion, all voted aye. Motion carried.  APPROVED - SURPLUS EQUIPMENT - ROAD & BRIDGE  Commissioner Grantham made a motion to approve the request to surplus equipment in  Road & Bridge department. See Exhibit 4. APPROVED - REQUEST TO BID CUSTODIAL SERVICES  Commissioner Wilson made a motion to approve the request to seek bids for custodial  services for the Dale County Commission.  Commissioner Gary seconded the motion, all voted aye. Motion carried.  APPROVED - CREEL RICHARDSON ROAD = GENERAL FUND EXPENSE Commissioner Grantham made a motion to approve the General Fund, 001, to reimburse the Gas Tax for work done on parking lot that was not reimbursed by the DCBOE. Mr. Brewer's current contract will expire December 1, 2022. Commissioner Grantham seconded the motion. Commissioners Carroll, Grantham, and  Wilson voted aye. Commissioner Gary vote nay. Exhibit 2  RESOLUTION REGARDING ELECTION OF THE STANDARD ALLOWANCE FOR  REVENUE REPLACEMENT FROM THE COUNTY'S AMERICAN RESCUE PLAN ACT FISCAL RECOVERY FUNDS WHEREAS, Dale County, Alabama (the "County") has received American Rescue Plan Act fiscal recovery funds ("ARPA funds") and is charged with ensuring that such funds are administered in  accordance with state and federal law; and  WHEREAS, under the Final Rule published by the United States Department of Treasury ("Treasury") dated January 6, 2022, the County has the option either to elect a standard allowance of $10,000,000 to be categorized as revenue replacement funds, or to perform calculations of revenue loss as  provided in the Final Rule; and  WHEREAS, the Final Rule provides that the election is a one-time, irrevocable election that must WHEREAS, the election must be made int the next Project and Expenditure Report, which is due  be made for the period of performance of the ARPA funds award; and  onApril 30, 2022.  NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION as follows:  The Commission hereby elects to utilize the standard allowance for the purposes of calculating revenue loss for the County and shall direct the County's authorized reporting representative for ARPA funds to make a corresponding election in conjunction with thet filing of the County's ARPAI Project and  Expenditure Report on or before. Sha Sfn Steve McKinnon Chairman, Dale County Commission    Exhibit3 3  RESOLUTION OF THE DALE COUNTY COMMISSION  EMERGENCY CLOSING OF COUNTY BUILDINGS AND CESSATION OF OPERATIONS WHEREAS, Section 11-1-8, states, The countycommission ofany countyi int the State of Alabama may by resolution close the offices in the county courthouse or other county buildings : for special  circumstances deemed necessary or appropriate';and,  WHEREAS, Section 31-9-10 states, "The governing body of each political subdivision shall have the power and authority to close, notwithstanding Section 11-1-8, any and all public buildings owned or leased by and under the control of the political subdivision where emergency conditions warrant, whether or not al local state of emergency has been declared by the governing body of the political subdivision." WHEREAS, the Alabama Rules of Judicial Administration 5 (C)gives the authority to close court offices to the circuit clerk unless court is in session. Ifcourt is in session, the presiding circuit judge must approve the decision. As theJudicial Article of the Alabama Constitution establishes that court is always insession, the presiding circuitj judge will always be thet final word as when court offices will be  closed. No courtofficial has the authorityt to close anynon-judicial loffice;and, various satellite offices be closed for non-essential services; and,  WHEREAS, from time-to-time, weather conditions require that the County Courthouse and WHEREAS, it may be necessary to close the County Courthouse complex and various satellite offices when the health and safety of citizens and employees arei in imminent danger; and, WHEREAS, the Dale County Commission desires for the Commission Chairman to coordinate with the Presiding Circuit Court Judge of the 33rd Judicial Circuit the closing of the County Courthouse Complex and Probate and Revenue Commission satellite offices, when situations are deemed necessary. If the Commission Chairman is unavailable, the following is the chain of command for the  County: duly designated Acting Chairman, County Administrator.
