Resolution No. 2023-20 DECLARED A PUBLIC NUISANCE  AUTHORITY TO ASSESS PROPERTY OWNERS FOR THE REMOVAL OF WEEDS  WHEREAS, the City of Brundidge Code Enforcement has identified weeds within the City limits WHEREAS, Code Enforcement has notified the property owners oft the intent to remove the WHEREAS, the property owners did not respond nor did they take any action to have the WHEREAS, the City of Brundidge removed the nuisance in accordance with requirements WHEREAS, the City of Brundidge had the nuisance removed at the following address and  and declared them to be a public nuisance; and nuisance if no action is taken by the owner; and  nuisance removed; and  established under Ordinance and as established by the legislature; and  associated cost: Street 414 Mike Street  Parcel No. 5160/264005.06.00  Cost to Remove $610.00  WHEREAS, a public hearing was held by the Council giving the above party the opportunity to show cause why the property should not be assessed and al lien placed. on the property for costi incurred;  and  NOWTHEREFORE BE IT RESOLVED by the City Council of the City of Brundidge, Alabama, that the City Manager is authorized and directed toi take the necessary action to have the foregoingproperty  owner assessed and collected to recoup the cost ofr removing the nuisance. MC-23-46  JUDGMENT  This cause was set for trial on August 2,2023 on a complaint made. July 19, 2023, by. Judith W. Hughes, an employee of the City of Brundidge, alleging a violation ofthe City's Weed Ordinance, Number 87-6 and Defendant failed to appear. Mrs. Hughes appeared and testified that a notice dated. April 18,2023, advising that property at 414 Mike Street, Brundidge, AL, was in violation of the ordinance had been. sent to defendant at4 414Mike Street, Brundidge, AL36010. Pictures ofsaid property werei made on. July17,2023, and. August 1, 2023 depicting the alleged violation, that proper notices as required by the said ordinance had been served and posted as required by said ordinance and were introduced as evidence. The City is ordered to cut said weeds and report the expenses incurred tot the court for possible judgment against the property owner. It is noted that a similar case was docketed during 2022 wherein the defendant failed to appear, was found guilty and with the city being ordered to bring the property into compliance with the NOW THEREFORE, ITI IS HEREBY ORDERED, ADJUDGED AND DECREED as follows: Thel Defendant, having: failed to appear, was found guilty upon evidence offered byt the City, is hereby fined The Chief of] Police is hereby ordered tol have the property brought into compliance with the ordinance.
