The Ephrata City Council hereby extends for an additional six (6) month period the moratorium on the acceptance, processing, and approval of applications for any residential subdivisions pursuant to' Title 18 oft the Ephrata Municipal Code. Lot line adjustments shall not' be subject to this moratorium. Section 2. Governmental, Commercial, and Industrial Development Moratorium Extended. The Ephrata City Council hereby extends for an additional six (6) month period the moratorium on the acceptance, processing, and approval ofa applications for any governmental, commercial, or industrial development requiring new connections to water or sewer utilities. Section 3. Effective Period for Moratorium. The moratorium set forth in this Ordinance shall be in effect for a period of six (6) months from the date this Ordinance is passed and shall automatically expire at the conclusion oft that six (6) month period unless the same is extended by the City as provided in state law or unless terminated sooner by Ordinance. Section 4. Should the City progress more rapidly through its periodic update of the Comprehensive Plan and Development Regulations, the City Council may review the timelines and restrictions set forth in this Ordinance and may make any adjustments deemed findings offact are made prior to each renewal; and attached and incorporated herein as Exhibit A; and and incorporated herein as Exhibit B; and Plan and Development Regulations as set forth in Exhibit B. necessary in its sole discretion. Declaration of Emergency. The City Council hereby declares that an emergency exists necessitating that this Ordinance take effect immediately upon passage by a majority plus one of the whole membership of the Council, and that the same is not subject to a referendum if passed by unanimous vote of the council (RCW 35A.11.090). Without an immediate moratorium on the City's acceptance of development applications for residential subdivisions within City limits, such applications could become vested, leading to development that could be incompatible with the development regulations eventually adopted by the City. Therefore, the moratorium must be imposed as an emergency measure to protect the public health, safety, and welfare, and to prevent the submission of a flood of applications to the City (upon knowledge of the City's intent to review the appropriateness of these uses Section 9.
