MINUTES OF MEETING OF THE CITY COUNCIL SANFORD, NORTH CAROLINA The City Council met at the Sanford Municipal Center, 225 E. Weatherspoon Street, on Tuesday, September 17, ,2024, at 5:00 p.m., in Council Chambers. Council Member Ferguson made a motion to approve the consent agenda. Seconded by Mayor Pro Tem Akinosho, the motion çarried unanimously. SPECIAL! AGENDA Liaison. Proclamation Proclaiming National Hispanic Heritage Month (ExhibitD) Mayor Salmon read the proclamation and presented it to Hannia Benitez with The Hispanic Proclamation Proclaiming Tuesday, October 1, 2024, as National Night Out in Sanford( (ExhibitJ) Mayor Salmon read the proclamation and encouraged everyone to participate in National Night Out activities on October 1, 2024, which will be held at City Hall. REGULAR AGENDA NEW BUSINESS There were no items on the regular agenda. Resolution in Support oft the Temporary Closure ofMultiple Streets for the Purpose ofNational Night Out Parks and Grounds Administrator Carolina Ratkus explained that this resolution lists several streets that will be closed for National Night Out activities on September 28, 2024, when activities will be held on Saturday, September 28. 2024 (Exhibit K) during the day. Council Member Rhodes made a motion to approve the Resolution in Support of the Temporary Closure of Multiple Streets for the Purpose of National Night Out on Saturday September 28, 2024. Habitat forHumanityo ofthe Sanford Area, NC(ExhibitL) Community Development Administrator Karen Kennedy explained that she previously presented Council with an offer from Habitat for Humanity for the purchase ofsome lots on Bullock Circle. Council declared the property surplus and authorized the sale of the property using the upset bid procedure. The offer has been properly advertised and no increased bids have been received. Saff is requesting that Council accept the $3,000 offer from Habitat for Humanity. Mrs. Kennedy noted that the minutes should reflect the request from Habitat for Humanity for the waiver ofthe water and sewer tapi fees as stated ini the "Land Dispositions Interim Process for Non-Profits dated 8/19/1999." She noted that City Attorney Susan Patterson is reviewing a grant incentive policy for System Development Fees (SDF). Should Council approve this offer, it will not inçlude the waiver for SDFS until a decision has been made. Mrs. Kennedy noted that tap fees are waived for not-profit agencies who provide affordable housing to area residents since waiving those fees reduces the cost; non-profits do not make any profit on developing these lots and selling the homes. Attorney Patterson noted that waiver ofSDFs willl be discussed at1 the next City Council Seconded by Council Member Dabbs, the motion carried unanimously. scheduled workshop. 2 City Council Meeting September 17,2024 Council Member Dabbs made a motion to approve the sale of vacant lots on Bullock Circle to Habitat for Humanity of the Sanford Area, North Carolina, and waive the water and sewer tap fees. Resolution Authorizing Advertisement of an Offer to Purchase a Vacant Lot at 1406 Boykin Avenue Community Development Administrator Karen Kennedy explained that staff has received an offer from Freddy Johnson in the amount of $5,000 to purchase the vacant lot located at 1406 Boykin Avenue. This property has a tax value of $6,800. Mr. Johnson resides in the adjoining property at 1402 Boykin Avenue. Mr. Johnson has been maintaining this lot for many years and he has placed a deposit. This resolution authorizes the advertisement of! his offer to purchase for any other interested parties to make a Seconded by Mayor Pro Tem Akinosho, the motion carried unanimously. CLOSED SESSION Council Member Dabbs made a motion to go into closed session pursuant to N.C.G.S. 143- 318.11(a)(4), to discuss matters relating to the location or expansion ofindustries or other businesses in the area served by the public body. Seconded by Mayor Pro Tem Akinosho, the motion carried unanimously. RETURNTO REGULAR: SESSION CASES FOR PUBLIC HEARING Council returned to regular session and Mayor Salmon reconvened the meeting at 6:05 p.m. Application by Bohler Engineering NC, PLLC, to rezone 6.48 +/- acres ofl land, comprised oftwo vacant adjoining parcels with one having frontage on Broadway Road and one being landlocked to the reard of 1120 and 1124 Broadway Road, from SN-12 Suburban Neighborhood District - Low (formerly Residential Single-family (R-20) prior to the September 1, 2024. effective date for the recent administrative rezonings) to General Commercial (C-2). The subject property is owned by Janet Brown Warner and Preston D. Warner, I.and is identified as Lee County Tax Parcels 9662-13-8066-00 and 9662-13-6055-00 as depicted on' Tax Map 9662.03. (Exhibit N) Mayor Salmon opened the public hearing. Zoning Administrator Amy McNeill reviewed information from the attached Exhibit N and explained that the building located at 1136 Broadway Road, Sanford, North Carolina, has now been demolished (in connection with the Broadway Road widening project). She reviewed the adjoining zoning and land uses, examples of permitted uses for the current and proposed zoning districts, information on the PlanSanlee Land Use Plan and utilities. She noted that the subject property lacks access to public sewer service and fronts Broadway Road, which is currently being widened to a four-lane highway between Sanford and Broadway. She added that the applicant wishes to rezone this property to allow the development ofa general retail store and that General Commercial (C-2) is established to allow General Commercial activities. 3 City Council Meeting September 17,2024 Ryan Gallager, Bohler Engineering, 4130 Parklake Avenue, Raleigh, North Carolina, stated that he is the engineer working with the seller to develop this site and they did the preliminary conceptual design for the proposed retail on this site. Steve Malloy, with Adcock and Associates, residing at 2615 Bellaire Drive, Sanford, North Carolina, noted that with the road widening project and the bypass, its simply makes sense that this] property should be zoned for commercial. He suggested that uses allowed in the Maker District do not have as much traffic as Broadway Road and al Maker Industry cannot afford road frontage. Council Member Taylor asked Mr. Malloy how it would affect his property connecting to the parkway (the connection point between Horner Boulevard and Broadway Road). Ms. McNeill replied that the applicant is not proposing to connect to this road. With no other speakers, Mayor Salmon closed the public hearing. Application by Peak Engineering & Design, LLC, to rezone a vacant 0.64 acre +/- lot with frontage on East Seawell Street from General Commercial (C-2)toLight) Industrial(LD.1 Thesubject propertyis is owned byNC Industrial Holdings, LLC,and isi identified as Lee County Tax Parcel 9651-79-1013-00 as depicted on' Tax Map 9651.07 (Exhibit 0) Mayor Salmon opened the public hearing. Zoning Administrator Amy McNeill reviewed information from the attached Exhibit 0. She explained that the intent of the applicant is to recombine the two lots into one larger lot for a future use. Ms. McNeill added that staffs supports the proposed rezoning. Jeff Roach, with Peak Engineering, 1125 Apex Peakway, Apex, North Carolina, noted that this request is only for the 0.64-acre tract and the adjoining property is zoned Light Industrial. This rezoning request is to make the subject property consistent with the adjacent parcel. With no other speakers, Mayor Salmon closed the public hearing. OTHER BUSINESS Council Member Rhodes commented that many people enjoyed the Lee County Regional Faira and H3 helped provide medical care to the employees of the Lee County Regional Fair. She reminded everyone of Thursday's concert. Council Member Dabbs encouraged everyone to attend Saturday's Farmers' Market. Council Member Ferguson stated how much he enjoyed judging cakes at the Lee County Regional Fair. Mayor Salmon commented on the high caliber of the Lee County Regional Fair and reminded everyone of the importance ofa agriculture in our area. She also commented on the quality ofthe recent Temple Theatre production. RETURNTOCLOSED SESSION Council Member Rhodes made a motion to return to Closed Session in accordance with North Carolina General Statute 143-318.11(a)(4) to discuss matters relating to the location or expansion of industries or other businesses ini the area served by the public body.
