The City did not received grant funding for the Nat Washington Way Resurfacing project. The budget was reduced by the estimated cost of this project. The revised 2022 Budget reflects a 14% increase from 2021. Overview of the major impacts to the budget was given. There being no public comment, Mayor closed hearing at 7:43 p.m. Ordinance 21-15- Adopting the 2022 Annual Budget: Motion to approve and accept Ordinance 21-15 adopting the final Budget for the City of Ephrata for the year ending Resolution 21-013 - Request to vacate. a portion of a Public Utility Easement: Director Leavitt gave a brief staff report. Public hearing was conducted by Council on this matter on November 17, 2021. The public hearing was closed and staff was directed December 31, 2022. (m/s Allstot/Mora) Motion carried. toj provide information of past public utility easement abandonments and that the Director Leavitt advised that in the past 11 years there have been four request to vacate easements; three were for the entire width and one was partial. All were located within Bob Muchlinski addressed Council concerns regarding this request. There is no access point to reach the easement and there are no public utilities located there. He advised that there is an irrigation pipeline that runs through this easement. Council discussion ensued. City Attorney Franz advised that she has concerns that this pipe line is making use oft this easement and requested Council to table this Resolution to give staff time to further Motion to table until the next meeting, December 15th. (m/s Moore/Allstot) Motion Ordinance 21-16-1 Implementing a 90-day Moratorium on Residential Subdivisions: Director Leavitt advised Council that with the increase in residential growth and the need top properly mitigate the impacts of development on existing parks and recreational services, this proposed moratorium would allow staff and Council the time to review and adopt revisions to the fee in lieu of land dediçation per EMC 18.04 and allow for the 60 day review period from the Department of Commerce. This would provide aj pause in accepting residential subdivision applications. Council discussion ensued. Park Fees/Fee in lieu of land dedication: At the last meeting, Council directed staff to provide information showing the fee in lieu of land dedication as aj percentage of the residential land values for lots adjacent to the three newest subdivisions. Single-family lots in these areas range in assessed value between $23,500 and $44,000. Based on a percentage of value (4%, 5% and 6%) the fee in lieu would range anywhere from $940 per lot to $2,640 per lot. There are also communities that utilize a flat fee per lot. Staff is requesting Council give direction on how to proceed. Does the method need to be changed; what method should be used; and direct staff toj prepare a draft ordinance. The additional work consists of assisting the City with repairing the existing deteriorated roof overhangs; pulling back the membrane; and repair fascia and soffits for new configuration. Action: Staff Report Summary Hold a Public Hearing and approve the resolution for the 6- year and 20-year Capital Facilities plans. Public facilities are those physical improvements that are constructed primarily by the City and provide the basic urban services of Ephrata. The Growth Management Act (GMA) requires that communities plan for capital facilities to ensure that adequate levels of facilities and services are inj place to support development at time of occupancy or use. A Capital Facilities Plan (CFP) is a long range, six (6) years (or longer), financial plan that allows the City to prioritize public projects and identify funding sources. The CFP doesn't commit the City to a particular expenditure for a particular year. Instead, it allows the City some flexibility in scheduling projects based on need or funding opportunities and doesn't The 20-year Comprehensive Capital Facilities Plan is being updated concurrently to reflect the proposed updates to the 6-year plan. Other changes to the 20-year plan have been lock the City into projects that may not be needed at time oft funding. reviewed and recommended by the Planning Commission. Page 1of2 Financial Implications The 6-year plan provides a framework for decision makers about what to buy, when to buy, how to pay for it. Iti is the intent and policy of this chapter that all persons constructing, reconstructing, widening, or repairing real propenyimprovements on lots abutting public rights-of-way are responsible for the costs of all street system improvements, constructed in accordance with the "City of Ephrata Community Street and Utility Standards,' on public rights-of-way adjacent to such lots, and in limited circumstances, on public rights-of-way which connect to a paved street surface. The City of Ephrata will, to the extent funding is appropriated by the City Council, reimburse the abutting property owner one-quarter (V4) of the actual cost to remove, repair and construct the sidewalk 19.22.020 Construction of this chapter,statement of purpose, fundamental principle. This chapter shall be liberally construed to effect the statement of purpose and fundamental principle described in this section. The tundamental principle of this chapter is that the owner, developer, and/or building permit applicant for proposed real property improvements is responsible for constructing street system improvements as defined in this chapter, or paying a street system improvement fee in lieu of construction as provided for in this chapter. Persons constructing real propertyi improvements are relieved ofone or more of these requirements in strict conformity with the exemptions described in this chapter. Persons constructing real property improvements are responsible for street system improvements to the extent those street system fronting or abutting their property. improvements do not exist at the time of building permit application. 19.22.030 Simultaneous construction of sidewalks and curbs required. No curb shall be constructed or placed on any street right-of-way in the corporate city limits abutting any lot of record or anyzoning lot existing as of November 3, 2010, unless sidewalks are constructed or placed simultaneously with curb installations. No street shall be paved within the city unless sidewalks and curbs are simultaneously constructed in those instances where curbs and sidewalks are not in existence at the time of the paving. 19.22.040 Sidewalks constructed during building improvement. Curbs, gutters(G)) and sidewalks shall be constructed simultaneously with the improvement of real property on the street or streets abutting the property to be improved. "Improvement of the property" shall mean construction of a primary structure, or any remodels in any two year period representing greater than 50 percent of the value of the existing structure. Market value shall be determined by an appraisal from a qualified and licensed appraiser or by the county tax assessment. New construction shall be determined by the valuation of the structure using the most recent International Code Council valuation and construction tables,orifremodeling: that adds 20 percent Ord21-19 or more of gross floor area. The agreement shall specify that the applicant will install or reimburse the city for construction of the deferred improvements as directed by the city. The concomitant agreement shall be filed with the Grant County auditor and run with the property. The concomitant agreement shall provide fora review oft the subject property at three-year intervals and shall provide general criteria upon which the city may rely to make the necessary improvements at such later dates. Concomitant agreements shall expire 15 years after the date of execution. 19.22.120 Waiver of provisions. Upon written application to the city council, and upon their making a determination that the elimination of all or any portion of the provisions of EMC 19.22.030 and 19.22.040 will in no way be detrimental to the best interests of the city, and/orifthe city council determines that the current level and extent of the improvements in the right-of-way adjacent to the subject property are not likely tol be changed int the next 15 years, those provisions as may be authorized by the city council may be waived. The notice shall be given 24 hours in advance of such removal. The street department shall remove the sign, and replace it again at no charge. Ifa sign isr removed by anyone other than the street department, a charge will be made for the work involved in replacing the sign and for the cost of the sign. In addition, unauthorized removal of signs shall be subject to the penalties provided fori in applicable ordinances. 19.22.160 Frontage improvements required. 1. The term "frontage improvements" as used in this section shall refer to the construction, reconstruction or repair of the following facilities along the full abutting public street frontage of property being developed: a. Curbs, gutters and sidewalks; b. Underground storm drainage facilities; C. Patching the street from its pre-existing edge to the new curb line; d. Overlayment of the existing public street to its centerline; Ord21-19 . - Construction of new streets within dedicated, unopened right-of-way. All such frontage improvements shall be constructed to city specifications. 2. Property owners shall be required to construct frontage improvements along the full abutting public street frontage of property which is developed as provided in subsection (3) of this section; provided, that overlayment of an existing public street to its centerline shall not be required for single-family or duplex development. 3. Iti is the intent and policy of this chapter that all persons constructing, reconstructing, widening, or repairing real propenyimprovements on lots abutting public rights-of-way are responsible for the costs of all street system improvements, constructed in accordance with the "City of Ephrata Community Street and Utility Standards," on public rights-of-way adjacent to such lots, and in limited circumstances, on public rights-of-way which connect to a paved street surface. The City of Ephrata will, to the extent funding is appropriated by the City Council, reimburse the abutting property owner one-quarter (4) of the actual cost to remove, repair and construct the sidewalk 19.22.020 Construction of this chapter, statement of purpose, fundamental principle. This chapter shall be liberally construed to effect the statement of purpose and fundamental principle described in this section. The lundamental principle of this chapter is that the owner, developer, and/or building permit applicant for proposed real property improvements is responsible for constructing street system improvements as defined in this chapter, or paying a street system improvement fee in lieu of construction as provided for in this chapter. No curb shall be constructed or placed on any street right-of-way in the corporate city limits abutting any lot of record or any zoning lot existing as of November: 3, 2010, unless sidewalks are constructed or placed simultaneously with curb installations. No street shall be paved within the city unless sidewalks and curbs are simultaneously constructed in those instances where curbs and sidewalks are not in existence at the time of the paving. 19.22.040 Sidewalks constructed during building improvement. Curbs, gutters(G)) and sidewalks shall be constructed simultaneously with the improvement of real property on the street or streets abutting the property to be improved. Improvement of the property" shall mean construction of a primary structure, or any remodels in any two year period representing greater than 50 percent of the value of the existing structure. In the event the city council approves a deferment, the applicant and the city must sign a concomitant agreement. The city will prepare such agreement at the applicant's expense. The agreement shall specify that the applicant will install or reimburse the city for construction of the deferred improvements as directed by the city. The concomitant agreement shall be filed with the Grant County auditor and run with the property. The concomitant agreement shall provide for a review of the subject property at three-year intervals and shall provide general criteria upon which the city may rely to make the necessary improvements at such later dates. Concomitant agreements shall expire 15 years after the date of execution. 19.22.120 Waiver of provisions. Upon written application to the city council, and upon their making a determination that the elimination of all or any portion of the provisions of EMC 19.22.030 and 19.22.040 will in no way be detrimental to the best interests of the city, and/or if the city council determines that the current level and extent of the improvements in the right-of-way adjacent to the subject property are not likely to be changed in the next 15 years, those provisions as may be authorized by the city council may be waived.
