NEWVILLE BOROUGH COUNCIL WORK SESSION/REGULARMONTHLY MEETING AUGUST27,2024 The work session meeting of the Newville Borough Council was. held on Tuesday, August 2024 at 6:00 PMi ini the Newville Borough Office Meeting Room, 4 West Street, Newville PA 27, with the regular monthly meeting at 7:00. PM. The meeting was called to order by Council President Scott Penner. The invocation was given by Solicitor Marcus McKnight, followed bye the Pledge of Allegiance. Oni roll call, the following members were present: Mr. Robert Darius, Mr. Jack Ericksen via Zoom, Mr. Charles Heberlig, Also present: Borough Solicitor Marcus McKnight, Borough Manager Robert Sabatini, Borough Secretary Jody Hoffman, Chief of Police Todd Koser, Mayor Michael Croutch, Codes Enforcement / Rental Inspector Jeffry Line, Sentinel reporter Maddie Seiler, Kim Wilson, Becky Barrick, Liz Knouse, Vicki Witter, Sam Stine, Jessica Wittman, and Vincent Mellott. Pastor. Joseph Kindon, Mr. Edward Sinkovitzand Mr. Scott Penner. WORK SESSION: Finance and Manager's Report: Mr. Sabatini submitted his report with two additions. He reported that hel has received two requests to remove handicapped parking designations at 18 East Main Street and 25 West Main Street. Secondly, he reported that the Borough of Mechanicsburg has generously loaned two speed check signs to the Borough for the next few weeks. He has received a letter from Friendship Hose Company requesting payment donation for worker's compensation tol EMS. Also, al letter was received from Cumberland County regarding an energy saving program. He has registered two employees for administration training. Mr. Sabatini stated that this will be the last meeting at this location. The move to 103 South High Administration: Pastor Kindon was happy to report that the Parking Meter Fund at ACNB will Public Safety /Public Works: Mr. Darius reported that safety and security goes together and commended ChiefKoser for his work as the single officer in the Borough. He shared that he was approached regarding aj placement ofa a four way stop sign at the intersection of West Street and West] Main Street. Mr. Penner stated that that type ofr request would have to go through PennDOT since Main Street is a state road. Mr. Penner asked ift the current flashing cross walk could be Economic Development: Mr. Ericksen reported meeting with DCED regarding the extension of the trail along the waterway. Mr. Sabatini would like to add signage along Vine Street to the downtown area. Mr. Ericksen also reported that he has been raising the profile for the use of best management practices to protect the water source regarding the new warehouse proposals. Also, he stated that if this project goes unfavorably, it will increase the amount oft turbidity treatment required ori it damages the flow. That would increase the cost to customers. He stated that the current cost is relatively low and with more treatment required, rates would increase. That is something that he would not like to see considering the stress oft the increase in taxes that the residents are already facing this year. Mr. Darius suggested organizing aj protest to bring awareness to the media. Recreation: Mr. Sinkovitz did not have anything to report from the Recreation Commission. He did: report that the Back to School Bash held by three area churches, headed by Pastor Chris Faylor was a great success. Mrs. Knouse stated that she had attended the Recreation meeting and that Mrs. Brymesser would be stepping down from Summer Recreation Program. She would like to see. Mrs. Brymesser recognized for her dedication to the program. Mrs. Knouse share that there had been about 25 children that attended the events and that there are plans for a chicken Mayor's Report: Mayor Croutch reported that revenues collected for the month of. July was $203.69: from Cumberland County Clerk of Court of Common Pleas and $319.13 from Magisterial District 09-3-02. John. JI Hanner II. Big Spring School District reimbursed the Borough $61.20 for the Fire Police provided from the 2024 Senior Parade. He noted that the computers for the police body and traffic cameras are at their end ofl life. He is requesting to use the budgeted money for a police department computer by the end oft the year. Chiefof] Police: ChiefKoser reported a total of6 69 calls for service for the month ofJuly. Four citations were issued and there was a total of481 patrol vehicle mileage. The Chiefreported that Code Enforcement, /1 Rental Inspections: Mr. Line reported that he had received 8 complaints int the month ofJuly. Hel had 31 inj person contacts, and 33 phone calls/texts. He placed 6 door hangers, 61 notices of violation and 11 letters. Four letters were sent for 8 units of rental inspections. Fouri inspections have been completed. Four letters were sent requesting information barbeques fund raiser in the fall and then in the spring. iti is very difficult getting pricing on the newi required radios for the county. and 86 photos were taken for problems /violations. Citizens comments will start at 7:00 at the beginning oft the Regular Meeting. Mr. Penner reviewed the items for the Consent. Agenda which included the minutes oft the July meeting, budget report, list ofbills, the Treasurer's Report, and reports from the department heads. Pastor Kindon questioned 400.450 on the budget report for administrative contract services. Ms. Barrick clarified that line item was to Benefit Connections. Ms. Hoffman stated Legal: Mr. McKnight stated that a correspondence was received from the DistrictA Attorneys Office requesting a victim impact statement be filled out. Mr. McKnight will bei in contact with the insurance companies regarding liabilities. Mr. Potzer has indicated that he would be filing suit for a wrongful discharge. A new DA has been assigned to the case and Mr. McKnight will bei meeting with her regarding this. The trial is tentatively set: for the week ofOctober 14th. Ms. Witter asked ifi impact statements could be accepted by the residents that have been directly affected by the increases in taxes. Mr. McKnight stated that he would look into that. meeting to discuss litigation matters. Executive Session: Mr. Sabatini stated that there will be an executive session during the regular New Business: Mr. Penner asked there were any questions regarding the request for solar panels for 55 West Big Spring Avenue. Mrs. Knouse asked ifthat would affect the historical factor of the home. Mr. Sabatini replied in the historical district, solar panels cannot be visible from the street. He explained that this request had gone in front oft the Planning Commission who approved it. Mr. Sabatini stated that a copy oft the map and placement oft the panels are ini the councils' packet. Pastor Kindon voiced concerns that the diagram oft the panels placed on the front ofthe house can be seen at street level. Mr. Ericksen stated that the Planning Commission unanimously agreed and that the panels are not substantially visible. Mayor Croutch replied that the panels are: not visible from the sidewalk ifyou are standing in front of the house but are visible from the sidewalk across the street, the panels are clearly visible. Mr. Sabatini replied that the record she requested does not exist. The Borough would have toj produce that record specifically for her, therefore it not covered under the Open Records Right tol Know requests. Mr. Penner concurred that the report Vicki Witter voiced her disappointment in receiving aj petition against her for legal fees from her petition to remove three Council members. Mr. McKnight responded that she attempted Mrs. Knouse stated that since the Borough could not accept ai monetary donation towards the legal fees, residents donated flags for the Borough. Legal Matters: Mr. McKnight did not have any legal matters to be discussed. Old Business: Mr. Sabatini did not have any information to be discussed about the forensic audit. New Business: a. Arequest was received by the Borough from the owners of55 West Big Spring Avenue, located in the Historic District, to attached solar panels. Mr. Sabatini reported that the Planning Commission approved it unanimously at their prior meeting. A diagram was submitted in the meeting packet. Mr. Ericksen stated that he supported the request. Mayor Croutch stated the placement oft the solar panels presented to Council do not adhere to the Zoning Ordinance in reference to the Amotion was made by Mr. Ericksen, seconded by Mr. Darious to approve the request for solar panels as presented for 55 West Big Spring Avenue. Assessment Grant of $23,874.64 from the Commonwealth Financing Authority tol be used for Municipal Safety Improvements." Amotion was made by Pastor Kindon, seconded by Mr. Heberlig to pass Resolution 27-2024 "Authorizing the destruction of certain records in accordance with the Municipal Records Manual." All were in favor. Motion carried h. Amotion was made by Mr. Sinkovitz, seconded by Mr. Darius to have the handicapped parking signs removed from the front of18 East Main Street and 25 West Main Street. Voice vote: Mr. Darius yes, Mr. Sinkovitz yes, Mr. Penner yes, Pastor Kindon yes, Mr. Heberlig yes, Mr. Ericksen yes. Motion carried. Amotion was made by Mr. Sinkovitz, seconded by Mr. Darius to authorize the payment of $2,419.70 to Friendship Hose for workers compensation coverage of paid personnel. Mr. Ericksen abstained from the vote. Motion carried 5-0. Amotion was made by Pastor Kindon, seconded by Mr. Sinkovitz to appoint Mr. Darius, Mr. McKnight and Mr. Sabatini to collaborate a victim's response to the Cumberland County District. Attorney's Office. All were ini favor. Motion carried k. Mr. McKnight advised that matters discussed in Executive Session is confidential and that no actions will be taken. Amotion was made by Pastor Kindon, seconded by Mr. Sinkovitz to come out of Executive Session at 8:47 PM. Mr. McKnight stated that during Executive Session no decisions were made. Amotion was made by Pastor Kindon, seconded by Mr. Sinkovitz to authorize the solicitor to seek legal action on 27 North High Street and 65 South High Street and to provide Council with information regarding blighted properties..
