EAST BERLIN BOROUGH COUNCIL 128 Water Street, East Berlin, PA 17316 Call to Order: The monthly meeting of the East Berlin Borough Council was held Wednesday, June 9, 2021, at the Members Present: Roberta Teal, James LeVan, David Meixner, Anne Geiger, Jason Wood, Donald Dixon and East Berlin Borough Hall. The meeting was opened with the Pledge of Allegiance at 7:00 PM. Also Present: Solicitor Matthew Battersby and Secretary / Treasurer Cindy Smith Mayor Greg Green Absent: Charles Krall (EMC), Emma Diehl Guests/Constiftuents present: Walt Geiger, Chris Warner - Borough Emergency Management Coordinator Approval of Agenda: James LeVan motioned to approve the Agenda second by David Meixner. Motion carried. Solicitor Battersby - Report: No updates with regards to EBACC building Transfer ofTitle. Solicitor Battersby will continue to edit and update the proposed "Chicken Ordinance" and draft the public The Codification process continues and the Borough Council will receive the printed draft version. Solicitor feels that KPI is on tract and working to obtain grant money for upgrading the Borough Hall notice advertisement information. Building with regard to an ADA ramp. Constituents Address Borough Council- Robin Heyser will have a report and information from EBACC to present from the "Partner Meeting" at the Walt Geiger, Planning Commission Secretary updated the Council regarding future goals set forth by the Emma Diehl, 203 Beaver Street, requested to be documented on the Public Record disclosing the fact that her property is eight and one half acres, including a chicken house that dates back to 1908 and can accommodate 240 chickens. The property is enrolled in the Land Conservancy and] has historically had 20+ chickens. She currently provides eggs for many Borough residents. Solicitor Battersby stated that it is acknowledged and documented on the Public Record that the Agricultural Operation is unique to the East Berlin Borough and would be exempt from the impending Borough Chicken Ordinance". This exemption is due to the fact that Chris Warner presented the Council with a copy of the existing Fire and EMS Services agreement between Washington Township and the Borough. James LeVan motioned to continue the existing agreement, second Borough Council Meeting on July 14, 2021. Planning Commission. Agricultural Operations are exempt under the Pennsylvania Right-to-Farm Law. by Donald Dixon. Chris Warner presented his monthly report to the Council. Reviewed the 16i incidents from the May Police report. Mayor's Report: Approval of the Minutes: The May 12, 2021, meeting minutes were approved as presented by James LeVan and second by Donald David Meixner requested that the draft meeting minutes be e-mailed to the Council 24 hours in advance of the Dixon. Motion carried. upcoming meeting date. -2- Committee Reports: Finance: Roberta Teal Council acknowledged receipt of the Profit and Loss statement. bills by Jason Wood, second by David Meixner. Motion carried. As summary of the bills paid for May totaling $24,142.00 was reviewed. A motion was made to pay the May Roberta Teal made the Council aware ofimpending money that the Parks and Recreation Commission may need to complete the Park Restroom project due to the unexpected building material price increase. David Meixner read and reviewed information in the Borough Maintenance Report. David Meixner noted that the Park Bathroom is slated to be complete by the end ofJ June. Streets/ Maintenance: Anne Geiger requested that David Meixner discuss with Bob Meminger add an additional crosswalk within the Borough. Planning/Zoning: David Meixner acknowledged ai resignation letter from Tom Burger, Planning Commission, due to the fact he David Meixner mentioned an impending letter from the Planning Commission the East Berlin Area Joint is not currently a resident within the Borough. Authority for refurbishing the water tower. Personnel: James LeVan acknowledged that he will continue updating the Personnel Policy to combine employee sick James LeVan updated the Council that the vacant, part-time, maintenance position has been advertised. The Council agreed the position would begin at a minimum of1 12.50 per hour or more depending on experience. Ini follow-up to the discussion held at the May 12, 2021 meeting regarding Don Myers' retirement gift, James LeVan motioned to recognized Don with a 10% bonus based on his gross earnings in the calendar year 2020, and vacation leave into paid-time-off leave and address carried over time. second by Anne Geiger. By roll call vote motion carried. Parks and Recreation: Communications: New Business: Old Business: Correspondence: Roberta Teal briefly noted the Parks & Recreation Commission meeting minutes. Anne Geiger read her "Statement" dated June 9, 2021, that she drafted. It will be stored in the Borough Correspondence file for future reference. Introduction of Interim Mayor, Greg Green, effective through December 31, 2021. Subsequent to a discussion, Jason Wood motioned to increase the Planning Commission from 5 members to 7 members and 2 alternates with a second by David Meixner. By roll call vote 4 yes/3 no. Motion carried.
