-1- EAST BERLIN BOROUGH COUNCIL 128 Water Street, East Berlin, PA 17316 Call to Order: The monthly meeting of the East Berlin Borough Council was held Wednesday, November 10, 2021, at the East Berlin Borough Hall. The meeting was opened with the Pledge of Allegiance at 7:001 PM. Members Present: Roberta Teal, James LeVan, Donald Dixon, and Charles Krall Members Absent: Anne Geiger, David Meixner, Jason Wood Also Present: Mayor Greg Green, Solicitor Matthew Battersby and Secretaryllreasurer. Cindy Smith Approval of Agenda: Donald Dixon motioned to approve the Agenda second by Charles Krall. Motion carried. Solicitor Battersby's Report: The Solicitor acknowledged the receipt ofal letter from Anne Geiger. The letter referred to the ongoing personal dispute between Council President, Roberta Teal and Council Member, Anne Geiger. The Solicitor stated that both ladies have written letters to the Editor oft the Gettysburg Times newspaper expressing their opinions. As the East Berlin Borough Solicitor, he serves at the direction of Borough Council. His invoices are paid by the Borough Taxpayers and Citizens. The Borough does not have a vested interest in this personal dispute and has Municipal Immunity. With the concurrence of the Council he will not be further addressing the letter from Regarding the East Berlin Area Community Center (EBACC) hel has had no further correspondence from their Additionally, he updated the Council regarding an e-mail from John Schlaline, Planning Commission Chairman The e-mail requested guidance regarding potential Planning Commission By-laws. The Solicitor stated that he will be addressing the e-mail and that he does not feel the Planning Commission needs By-laws. This is due to the fact they are not a separate entity, operate as a sub-committee ofand serve at the pleasure oft the Borough Chris Warner, Emergency Management Coordinator (EMC) presented his monthly report to the Council. Constituents Address Borough Council- Mayor's Report: Reviewed the 17 incidents from the October Police report. Approval of the Minutes: The October 13, 2021, Regular Meeting Minutes were approved as presented by James LeVan and second by Charles Krall with a minor grammatical correction. Motion carried. Committee Reports: Finance: Roberta Teal Council acknowledged receipt of the Profit & Loss Statement as well as the as the Summary of Accounts. As summary oft the bills paid for October totaling $15,056.62 was reviewed. A: motion was made toj pay the bills by Charles Krall, second by James LeVan. Motion carried. Streets/ Maintenance: Roberta Teal read and reviewed the Borough Maintenance Report. She also stated that the Council may need too consider replacement oft the Hustler Riding Mower as iti is beginning to age and the repairs are increasing. Roberta Teal explained the Radar Traffic Speed Sign annual technical support renewal fee. A motion was made by Charles Krall for payment of$1,500.00 to renew the annual Speed Sign technical support agreement fora a feeof$1,500.00, second by James LeVan. Motion carried. Personnel: James LeVan motioned for the Borough to employ Anthony (Tony) Baker as an Independent Contract. Mr. Baker will be providing his own insurance and will assist with snow removal during the winter. The possibility ofe expanding his responsibilities, as needed, does exist and he will be hired at aj pay rate of $20.00 per hour, second by Donald Dixon. Motion Carried. This motion will be contingent upon a driving record report being obtained by the ChiefSeitz, Borough Police. Parks and Recreation: Planning & Zoning New Business: Roberta Teal stated that the Borough Restroom Building has been winterized. Roberta Teal presented the Planning Commission approved meeting minutes. James LeVan motioned advertisement of the 2022 Proposed Budget, second by Donald Dixon. By roll call vote, motion carried. Solicitor Battersby commented that the Proposed Budget does NOT necessitate the need Charles Krall requested consideration of an expenditure for $25,000.00 from the American Rescue Plan Funds (ARP): for ai new tractor comparable in size to the current one used by the East Berlin Area Joint Authority. for an increase in taxes. This is due to the fact the current tractor is aging out. Old Business: Camping Ordinance Hearing 2021-04 Byr roll call vote, motion carried. Charles Krall motioned to approve Ordinance 2021-04 second by James LeVan. the proposed ADA Ramp Project which includes a start date and procedural outline. The Council acknowledged a letter from Ryan Picarelli, KPI Technology dated November 10, 2021, outlining Correspondence: EBACC: Meeting Minutes EMC Report EBAJA Report Fire Department Reports Training and Webinars Available Closure: The next meeting is scheduled for Wednesday, December 8, 2021, 7:00 PM at the Borough Hall.
