EAST BERLIN BOROUGH COUNCIL 128 Water Street, East Berlin, PA 17316 Call to Order: The monthly meeting oft the East Berlin Borough Council was held Wednesday, March 10, 2021, at the East Berlin Borough Hall. The meeting was opened with the Pledge of Allegiance at 7:001 PM. Members Present: Roberta Teal, James LeVan, Donald Dixon, David Meixner, Charles Krall, Jason Wood, Mayor Keith Hoffman and Anne Geiger departed the meeting early. Members Absent: N/A Also Present: Solicitor Matthew Battersby / Secretary Treasurer Cindy Smith Guests /Constituents present in person & remotely: Walt Geiger, Chris Warner - Borough Emergency Management Coordinator (EMC), Alice, Pam Lady and Robin Heyser- EBACC, Rebecca Meixner, Emma Diehl, Approval of Agenda: Charles Krall motioned to approve the meeting agenda as presented second by James LeVan. Chris Teal and Rose Hoffman. Motion carried. Solicitor Battersby's Report: Solicitor Battersby reviewed the tax implications ift the Community Center deed transferred to the East Berlin Community Center (EBACC) and the rational for inclusion ofal reverter clause in the deed, to the East Berlin Borough. After discussion, James LeVan motioned with a second by David Meixner directing the Solicitor to draft a' "Letter of Intent" for transfer of the EBACC building. By roll call vote, motion Solicitor Battersby reported the plan finalization of 429 West King Street (Old Nell's Building). Solicitor Battersby presented the Old Firehouse estimate for repair/ / patch oft the Bell Tower: in the amount of$1,370.00. Don Dixon motioned to accept the estimate for repair / patch, second by Charles Krall. Solicitor Battersby is drafting an Inter-municipal Agreement be drafted for sharing employees between Robin Heyser clarified that as discussed earlier in the meeting regarding EBACC and the future and pending Letter ofIntent/A Agreement of Sale would be between the Borough and the EBACC Joint Commission. Rebecca Meixner stated that the Police Chief's recent actions were stupid and that the response from the Borough Council was even more stupid. She stated that there was no follow-up inclusive ofall Council Members, with regard to the agreed upon disciplinary actions against the Chiefof Police. Ms. Meixner also stated that disciplining Anne Geiger, Council Member, was an obvious case of "punish the whistle blower", by removing her from Committee's that she donates countless hours to. Mrs. Meixner stated to the Mayor that people are shocked when she re-iterates the story of when her husband, David Meixner was running for Borough Council, that the Mayor told her he was surprised Dave was running because the town is not growing and his wife would do a really good job. Mrs. Meixner stated her and her family spends basically the entire summer at Lake Meade. She would like to see the Borough ofEast Berlin be more progressive and a functioning government body. She stated that Anne Geiger donates countless hours of volunteer time, delivering food toj people with COVID, donates her stipend to the Park and remains al hero to her family, Emma Diehl stated and elaborated on the fact that shel has lived in the Borough her entire life and her extreme discontentment with the recent actions oft the Borough Council in regards to the removal of Anne Geiger from approved unanimously. Motion carried. East Berlin Area Joint Authority (EBAJA) and the Borough. Constituents Address Borough Council friends and neighbors. Borough Committees. Mayor's Report: Mayor Keith Hoffman read and reviewed the 16 incidents from the February Police report. 2- Approval of the Minutes: The February 10, 2021 meeting minutes were approved as presented by James LeVan with second by Donald Dixon. Motion carried with one dissenting vote. Committee Reports: Finance: Roberta Teal reviewed and the Council acknowledged the Profit and Loss statement. February bills by James LeVan with a second by Donald Dixon. Motion carried. As summary of the bills paid for February totaling $22,368.32 was reviewed. A motion was made to pay the David Meixner read and briefly reviewed the Borough Maintenance Report, commenting that the report was David Meixner reported that the Planning Commission has had discussion regarding the increasing the James LeVan reported that no action was required at this meeting by Borough Council. He had received an application from a Borough resident to fill the vacancy on the East Berlin Area Joint Authority board. It was confirmed by Charles Krall that the vacancy was for a Borough resident position. James LeVan stated the long time Planning Commission Member, John Schlaline'st term is ending and he will be confirming that John is willing to serve another term, prior to the April Council meeting. Per Anne Geiger, Andrea Everhart is not serving again on the Parks and Recreation Commission. Mayor Keith Hoffman reported the Parks and Recreation Commission had a re-organization. Thel Mayor also reported that aj pavilion rental application had been submitted for a Prom Celebration. After discussion the Council agreed on terms for allowing the Prom with adult supervision and allowing the celebration until 10 PM. The Mayor will be working with the applicant to ensure trash clean-up, noise levels Thel Mayor also reported a request for approval of the Annual Easter Egg Hunt. A motion was made to approve the request by Donald Dixon with a second from Charles Krall. Motion carried. Dave Meixner requested that the Council begin receiving the meeting minutes from the East Berlin Joint Authority. Charles Krall reported that he would request Melissa Earp, EBAJA Secretary e-mail them on a Chris Warner, EMC gave al brief presentation of the Adams County 2020 Hazard Mitigation Plan. Subsequent tot that presentation, Charles Krall motioned to approve Resolution 03-2021-02, second by James LeVan. By Chris Warner, EMC shared with the Council that Adams Regional EMS has donated 4 AED Units to the Roberta Teal requested the Council Members review the proposed "Chicken Ordinance" at home for Streets/ Maintenance: very thorough. Planning/Zoning: Personnel: number of members from 5-7 people. Parks and Recreation: are not disruptive to the community and restroom facilities are adequate. Communications: monthly basis to the Borough Secretary for inclusion in the monthly meeting packets. New Business: roll call vote 6 yes, 1 absent. Motion carried. Borough.
