Built level concrete pads for chlorine container storage for all well houses (6) total. Inventoried and replaced all damaged or hard to read regulatory and street name signs. Started safety checks and routine maintenance on all City vehicles. Replaced all 41 tires on the Genie high lift, per the high lift recertification inspector's recommendation. Regular scheduled Park and public works maintenance, numerous funerals, and as always responded to any and all City related calls. Contractor's Insurance for Other Losses The Contractor shall assume full responsibility for all loss or damage from any cause whatsoever to any tools, Contractor's employee owned tools, machinery, equipment, or motor vehicles owned or rented by the 2020 Sodium Hypochlorite Service Page 19/30 Contractor, or the Contractor's agents, suppliers, contractors or subcontractors as well as to any temporary structures, scaffolding and protective fences. H. Waiver of Subrogation The Contractor and the Owner waive all rights against each other, any of their Subcontractors, Sub- subcontractors, agents and employees, each of the other, for damages caused by fire or other perils to the extent covered by Builders Risk insurance or other property insurance obtained pursuant to the Insurance Requirements Section of this Contract or other property insurance applicable to the work. The policies shall provide such waivers by endorsement or otherwise. I. Acceptability of Insurers Insurance is to be placed with insurers with a current A.M. Best rating of not less than A: VII and licensed to do business in the state of Washington. Verification of Coverage J. Contractor shall furnish the Owner with original certificates and a copy of the amendatory endorsements, including but not necessarily limited to the additional insured endorsements, evidencing the Automobile Liability and Commercial General Liability insurance of the Contractor before commencement of the work. Before any exposure to loss may occur, the Contractor shall file with the Owner a copy oft the Builders Risk insurance policy that includes all applicable conditions, exclusions, definitions, terms and endorsements related to this project. Upon request by the Owner, the Contractor shall furnish certified copies of all required insurance policies, including endorsements, required in this contract and evidence of all subcontractors' coverage. K. Subcontractors: The Contractor shall cause each and every Subcontractor to provide insurance coverage that complies with all applicable requirements of the Contractor-provided insurance as set forth herein, except the Contractor shall have sole responsibility for determining the limits of coverage required to be obtained by Subcontractors. The Contractor shall ensure that the Owner is an additional insured on each and every Subcontractor's Commercial General liability insurance policy using an endorsement at least as broad as ISO Additional Insured endorsement CG20380413. Failure Notice of Cancellation L. The Contractor shall provide the Owner and all Additional Insureds for this work with written notice of any policy cancellation within two business days of their receipt of such notice. M. Mini-bulk tanks shall be rotationaly-molded, vertical, high-density, cross-linked polyethylene one- piece seamless construction; cylindrical in cross-section, vertical, with flat bottoms. The wells listed for each week are listed in the order that the tanks will be removed and installed. The contractor removing tanks for the week will remove the tanks on Monday and Tuesday. The contractor installing the tanks for the week will install the tanks on Wednesday, Thursday, and Friday. The contractor should verify with the City that the wells scheduled for the week have been removed before showing up toi install the new tanks. Payment will be based on the unit price listed in the Proposal for freight plus applicable taxes. 5.1 COMPETITIVE PRICING Contractor warrants and agrees that each of the charges, economic or product terms, or warranties granted pursuant to this Contract are comparable to or better than the equivalent charge, economic or product term, or warranty being offered to any similarly situated commercial or other government customer. If contractor enters into any arrangements with another customer to provide product under more favorable charges, economic or product terms, or warranties, contractor shall immediately notify City of such change, and this Contract shall be deemed amended to incorporate the most favorable charges, economic or product terms, or warranties being offered by the contractor. 5.2 ANNUAL PRICE ADJUSTMENT On the annual anniversary dates of the Contract, the City and the contractor may renegotiate, in good faith, the contract prices. The Contractor's request shall be accompanied by sufficient documentation toj justify a requested increase. The justification shall be based on changes in the annual Producer Price Index, labor agreements, and other documented statistical data. Acceptance will be at the discretion of the City and shall not produce al higher profit margin than that established on the original contract pricing.
