MINUTES TOWN OF COPPER CANYON REGULAR TOWN COUNCIL MEETING MONDAY, AUGUST 12, 2024 7:00 P.M. The Town Council of the Town of Copper Canyon met in regular session on Monday, July 22, 2024, at 7:00 p.m. in the Council Chambers at Copper Canyon Town Hall, 400 Woodland Drive, Copper Canyon, Texas, whereupon the following items were considered: I.CALLTO ORDER Mayor Robertson called thei regular meeting ofthe Copper Canyon' Town Council to order at 7:00 on the 12th day of August 2024. II.POLICE OFFICER - OATH OF OFFICE Town Secretary Morales administered the Oath ofOffice to Police Officer Richard Jouett and Dave Rossenthal. IL.PUBLICINPUT Citizens can make comments to the Town Council during this section of the meeting agenda. We ask citizens who wish to speak on agenda items to signi in on1 the sheet provided on the table at the back of the Council Chambers. There is a 3-minute time limit for each speaker. Pursuant to State Open Meetings law, the Town Council cannot discuss or take action on items not posted on the agenda. Therefore, the Council cannot take action on or discuss any issues or items brought up during public input. IV.STAFF, MAYOR, AND COUNCIL REPORTS ON ITEMS OF COMMUNITY INTEREST (Pursuant to Texas Government Code Section 551.0415 the Town Council may report on the following items: (1) expression of thanks, congratulations, or condolences; (2) information about holiday schedules, (3) recognition of individuals; (4) reminders about upcoming Town Council events; (5) information about community events; and (6) announcements involving imminent threat to public health and safety. No deliberations and actions will be taken. Mayor Robertson read a statement regarding Copper Canyon (attached to these minutes). V.STAFF REPORT In addition to the information listed in the Staff Report, the following comments were made: Town Administrator PD building will get a CO (certificate of occupancy) on Tuesday, 8/13/24 and This time of year, the Town is accepting applications for the Planning and TXDOT continues working on the streetlight at Vickery and FM407. Town Administrator Meyer gave an overview of the proposed 2024-2025 budget and Mayor Pro Tem Hill mentioned additional information relating to the current budget discussed overview summary sheet. and the proposed budget. No further action was taken. 3. Discuss, consider, and take action regarding the filing of the 2024-2025 Town Budget with the Town Secretary. Council Member Lybbert made a motion to file the Proposed 2024-2025 Town Budget with the Town Secretary. Mayor Pro Tem Hill seconded the motion. Discuss and consider accepting the submission of the no-new-revenue and voter approval tax rate calculations; take action to consider aj proposed tax rate. NOTE: Roll call vote on the proposed tax rate is required. Mayor Pro Tem Hill made a motion to accept the submission of the no-new- revenue and voter approval tax rate calculations and accept the proposed tax rate of .265990. Discuss, consider, and take action regarding Ordinance 24-002 amending the Code of Ordinances by repealing Chapter 10 'Subdivision Regulation' and Chapter 10A Subdivision Ordinance' in its entirety and replacing it with a new Chapter 10 Town Administrator Meyer briefly explained to the Council and meeting attendees the reason behind replacing the Subdivision Regulations (to ensure compliance with state laws and with the Town's zoning ordinance). He mentioned one change that needed to bei made-remove "approved development plan" onj page 21, as found in Sec. Discuss, consider, and take action regarding a contract for professional planning consulting services between the Town of Copper Canyon and Dunaway Associates, Mayor Robertson introduced the proposed consulting agreement with Dunaway Associates. Town Administrator Meyer explained the reasons for the need for hiring SAFEbuilt Council Member Lybbert and Andrews expressed their reservations to hiring a code enforcement company and cautioned the Town to limit the company's authority and Council Member Andrews made a motion to approve a Professional Services Agreement between the Town of Copper Canyon and SAFEbuilt for code and briefly explained their responsibilities. that the Town should require regular reporting on their findings. enforcement services. He confirmed that the Council Member Andrews made a motion to approve the Stormwater Drainage System Maintenance Agreement between the Town of Copper Canyon and MR agreement will follow the sale oft the property as well. Town Administrator Meyer stated that since the Town offices will be closed on October 14th due to a Federal holiday, Council will not meet that evening. Council will meet on October 28th instead. Recently, some have voiced specific concerns privately and in public forums. We hear you. I'd like to share some perspectives on: 1)how we arrived here today 2) the root causes oft the issues we've identified 3) the specific actions we've taken to remedy these issues, and 4) the processes we've established to mitigate these issues in the future. Copper Canyon has, is, and will continue to attract growth, which results in pressure to develop suburban housing that is less dense than normal for our town. These developments have the potential to disturb the "rural" fabric that makes this Ishare the passion and echo the sentiment many residents have expressed resisting dense residential development. As Mayor, and personally, I am committed to preserving the rural, equestrian nature ofCopper Canyon. Equally, Ia acknowledge the rights of landowners, and recognize that our Code ofOrdinances must reflect Through our Master Plan and Design Review Checklist (DRC), we have been, and are, careful to encourage this type of residential development along corridors that frame the town on major transportation routes. Vickery and Williams Ranch are two examples. However, market economic forces are driving some Copper Canyon landowners and outside developers to seek higher density development in interior portions of the Town. Our agenda for tonight includes two requests for the council's consideration: The first is to appoint a consultant to work with our Development Committee to ensure compliance with state, federal and local laws, and to close gaps and loopholes. Updated statement, the other request for the council's is the consideration to move forward with a part-time position as the Town's Development Director. Thisisa a new role being established to mitigate limitations from current workload and bolster experience. We are currently engaged with Mr. Harlon Jefferson to provide an overall assessment of the following town functions: Financial Operational Efficiency Service Delivery Infrastructure and Asset Management Development and Regulatory His focus will be on Operational Efficiency, as we believe Mr. Jefferson experience will be invaluable as we move forward during the town's growth and increase in residential development. We have other plans beyond these two items. As we welcome new members to the Planning and Zoning Commission, the Board ofAdjustment Commission, and the Council, we will require them to take the minimum courses available through the Texas Municipal League and/or the North Texas Council of Governments. The town will pay for the associated fees, and we will also have quarterly workshops with the Planning and Zoning Commission and Four years ago, I proposed hiring a part-time code enforcement officer. Residents of Copper Canyon didn't feel the time was right then. Certain issues, including unlawful buildings, make it clear that Copper Canyon requires this resource to ensure residents and developers adhere to Town Ordinances. Staffwill be working closely with the contract officer to ensure they deliver the level of service and enforcement that suits our town. Therefore, the council intends to hire a part-time Council to ensure ongoing education and development. code enforcement officer. Earlier this year, Id discussed an objective to reduce taxes by two cents. The changes I've mentioned tonight weaken that opportunity. Steve Hill has helped to model a one cent reduction, that both provides tax relief and enables an investment Our development ordinances, policies and procedures will undergo significant changes over the next six to twelve months. We ask for your trust, patience and involvement as we work through these challenges.
