August 13, 2024 The City Council oft the City of Clyde, Texas, met in a Regular Meeting at Clyde City! Hall, 222 Oak Street, Texas on August 13, 2024, at 6:00 p.m. with Mayor Rodger Brown presiding. Councilmembers Rodger Brown, Paul McGuire, Jim Rector, Tammie Coffman, and Thomas Martin. Clyde, present: Staff present: City Administrator Chris McGuire, City Secretary Connie Thornton, Information Technology Specialist Chris Barnett, Director of Community Services Terry Davis, Public Works Director Jerry Perkins, Chief of Police Trevor Barnes. An open meeting was held concerning the following subjects: 1.0 CALL TO ORDER AND ANNOUNCE, A QUORUM IS PRESENT At 6:00 p.m., Mayor Brown called the meeting to order and announced a quorum was present. 2.0 INVOCATION Given by Mayor Brown. 3.0 PLEDGES1 TOU.S. AND TEXAS FLAGS All-led by Mayor Brown. 4.0 COUNCIL COMMENTS Councilmember Rector wanted to remind citizens school is starting back up and to be aware of the kids and buses. 5.0 PUBLIC COMMENTS Kevin Fort, 118 Century, Clyde, Texas addressed council as a representative of Cowboy Heritage Church saying next October they were having a car: show benefit. They would like to invite all citizens Mona Hill, 1114 Crescent, Clyde, Texas said she had heard last Friday from someone representing the Abilene Reporter News that Clyde could be out of water in about a year. Mayor Brown told Ms. Hill to and their children to come to church. call Chris at City Hall, and he would go over that with her. 6.0 CONSENT AGENDA 6.1 Rector moved and Martin seconded to approve the minutes from the regular meeting of July 23, 2024, and the special meeting ofA August. 5, 2024, as printed. Motion carried unanimously with White being absent. 7.0 PRESENTATION 8.0 REGULAR AGENDA 7.1 Cameron Gulley, CPA, was not finished with audit. No presentation given. 8.1 McGuire moved and Coffman seconded to order the election for the General Election fNovember! 5, 2024. Motion carried unanimously with White being absent. 8.2 Imove that the property taxi rate be increased by the adoption ofa tax rate of $0.88000, which is effectively a 29.41% increase in the tax rate and the notice of public hearing be published in the Clyde. White-absent 8.3 Chris said there were 2 financial institutions that submitted for bank depository contract. Our current bank, First Financial Bank, scored the highest. Martin asked how Rector moved Martin seconded to award the bank depository contract to First Financial Bank. Motion carried unanimously with White being absent. 8.4 Chris said this is the negotiated contract that Lloyd Gossenlink did with Atmos. Lloyd McGuire moved and Coffman seconded to adopt AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CLYDE, TEXAS, APPROVING A NEGOTIATED SETTLEMENT BETWEEN THE ATMOS CITIES STEERING COMMITTEE ("ACSC")AND ATMOS ENERGY CORP., MID-TEX DIVISION REGARDING THE COMPANY'S 2024 RATE REVIEW MECHANISM FILING; DECLARING EXISTING RATES TO BE UNREASONABLE; ADOPTING TARIFFS THAT REFLECT RATE ADJUSTMENTS CONSISTENT WITH THE NEGOTIATED SETTLEMENT; FINDING THE RATES TO BE SET BYTHE ATTACHED SETTLEMENTTARIFFS TOBEJ JUST AND REASONABLE AND IN THE PUBLIC INTEREST; APPROVING AN ATTACHMENT ESTABLISHING A BENCHMARK FOR PENSIONS AND RETIREE MEDICAL BENEFITS; REQUIRING THE COMPANY TO REIMBURSE ACSC'S REASONABLE RATEMAKING EXPENSES; DETERMINING THAT THIS ORDINANCE WAS PASSED IN ACCORDANCE WITH THE REQUIREMENTS OF THE TEXAS OPEN MEETINGS ACT; ADOPTING A SAVINGS CLAUSE; DECLARING AN EFFECTIVE DATE; AND REQUIRING DELIVERY OF THIS ORDINANCE TO THE COMPANY AND THE ACSC'S LEGAL COUNSEL. Motion long the contract was for and Chris stated 5 years. Gossenlink negotiates for multiple cities on their behalf. carried unanimously with White being absent. 9.0 FINANCIAL STATEMENT The July 31, 2024, Financial Statement was available to Council for review. Coffman asked when is fiscal year end and Chris said September 30, 2024. 10.0 ADJOURNMENT McGuire moved and Martin seconded to adjourn the meeting at 6:14 p.m. Motion carried unanimously with White being absent.
