Regular City Council Meeting September 9, 2024 STATE OF TEXAS COUNTY OF MONTAGUE CITY OF BOWIE Ont this the 9th day of September, 2024, the council convened in a regular meeting open to1 the public as advertised with four Councilors present. Councilors McEwen and Post were absent. Presiding: Mayor Burris Councilors: Ashley, Bates, Gunter, and Shaw City Secretary Page City Manager Cunningham Mayor Burris called the regular meeting to order at 6:00 p.m. Invocation was given by Fire Chief Doug Page. Items of Community Interest at City Hall. City Manager Report Invocation There will be a Downtown Revitalization Project meeting on Wednesday, September 11, 2024 at 5:00 p.m. The plans for the Downtown Revitalization Project are now mostly ready. Ihave a copy oft the plans in the conference room. Ihave calleda a public meeting for 5:00 p.m. on Wednesday the 1" and made sure that allt the businesses on Smythe Street were notified. Idelivered announcements to each business that were open last Thursday. We: also posted the meeting on our website and the city's Facebook page. Feel free to look att the plans after tonight'smeeting. Iwill be happy to answer any questions that I can, but ifyou Aslt told you at thel last meeting, TCEQ has requested that we install another raw water pump at the pump station at thel lake. They said that we have six months to take care oft the problem. In the meantime, our engineers are asking for a variance to this requirement so that we can have extra time to take care of this. Jerry Sutton also went to the old raw water pump station on the old side oft the lake and found it to be in fairly good working order, which may also buy us some time. The old pump will require some repairs but nota al lot. Hopefully these two things will give us time to get the new pump request engineered and bid for The Nelson Street project has run into more problems. The culverts that run from Houston Street to the dropl box and from the dropl box to the bridge culverts have come loose and must be repaired before we do any more work at the intersection. Also, the drop box does not have the correct elevation sO water will not enter the drop box under normal rainfall circumstances. Problems with the drop box continue to be a sore point andt the project will not be finished until the contractor gets everything fixed at the box and concrete is poured at thei intersection. There are other items that need to be addressed, but the drop! box is our main concern. Ihave not asked Hayter Engineering, but I'm pretty sure that the contractor is in the time-limit penalty phase of the project. Asl have told you before, the penalty is $700.00 per day ifthe project is not Consent Agenda Items: Approval of Minutes -August 26, 2024 Regular Meeting. Second reading of Ordinance 2024-05- An ordinance adopting an annual budget for the Cityof Bowie for the fiscal year beginning October 1,2024 and ending September 30,2025. Adoptinga referenced document as said budget and establishing approprintions for the various activitiesa and functions oft the city, establishing an effective date and repealing all ordinances and regulations in Councilor Gunter moved, with a second from Councilor Shaw, to approve Ordinance 2024-05. Regular City Council Meeting September 9,2024 Page 2 Ordinance 2024-06-/ An ordinance levying an annual ad valorem tax rate for the City of Bowie, Councilor Gunter moved, with a second from Councilor Shaw, that the property tax rate be increased by the adoption ofa tax rate of0.5430, which is effectively: a 11.4% increase in the tax rate. Motion carried with Adopt written findings as to collection services contract and approve a contingent fee contract with Perdue Brandon Law Firm pursuant to Article 103.0031,Tx Code of Criminal Procedure, said contract being for the collection of court fines and fees owed to the City of Bowic (the "City").and notice of which is provided with the agenda in accordance with Section 2254.136 of the Govt Code.
