Any person, firm, or corporationv violating any provision of this division may be enjoined by suit filed by the municipality in a court of competent, jurisdiction, and this remedyisin addition to any other penalty provision. Its shall be unlawful for anyi individual or group of individuals to participate in any activity on any public park area when such activity will create a danger to the public or may be considered a public nuisance. The council may designate particular locations within park areas for specific activities and, when deemed necessary, it may limit the conduct of such activities by the issuance of special permits upon application, which permits will set out the particular conditions under which such activity is permitted. (Ordinance 031208-6, sec. 1 (96.01), adopted 1/12/04) 1,0.063inluringtres, shrubs, fences or other property. Itshall be unlawful for any person to cut, break, deface ori in any way injure the trees, shrubs, plants, grass, turf, fountains, seats, fences, structures, improvements, ornaments, monuments, or propertywithin or upon any of the public parks. Itshall be unlawful for any owner, keeper, or person having the custody or control of any dog to cause or permit such animal to go into or upon the grounds of any public park within the municipality, unless such dogi is led by some person and retained in custody by having such animal securely fastened by means of a chain, rope, or strap and the person cleans up any feces left by the dog. (Ordinance 031208-6, sec. 1 (96.04), adopted 1/12/04) 1.10.066Driving and parking ofv vehicles. (a). (1) Ap person commits an offense ifi in any park or recreational area he or she knowingly: Drives a motor) vehicle; (2). (3) Stops, stands, or parks a motor vehicle; Parks a motor vehicle SO asi to obstruct the entrance to or exit from al roadway, parking area, or trail established for public motor vehicle use; or (4). Fails to park the entire motor vehicle within the limit lines of a designated parking stall, where such lines have been provided. (b). Itis a defense to prosecution under subsection (a) of this section that the driving, stopping, standing, or parking: (1) (2). (3). Was along a roadway, trail, or parking area established for public motor vehicle use; Was due toi temporary mechanical failure oft the vehicle; Was ordered by a police or park officer or a person charged with supervision of a park or recreation area within the municipality; or (4). duties. (a). Ap person commits an offense if he or she knowingly makes or causes to be made any loud and raucous noise in any public park and recreation area ini the municipality. (b). Itis a defense to prosecution under subsection (a) of this section that the person: Isar municipal employee acting within the scope of his or her official duties; or (1) (2) First obtained the written permission of the councila authorizing a special event. (c). The following enumerated acts are, presumed to create loud and raucous noises for purposes of this section: (1). The sounding of any horn or signal device on any automobile, motorcycle, bus, or other vehicle, except as a danger signal, as required by state law. (2). The use of any mechanical loudspeaker or sound amplifier for the purpose of attracting the attention of other persons by the creation of noise. (3). The playing of any radio, television, tape machine, compact disc player, musical instrument, or other machine or device for the production or reproduction of sound at such avolume that the sound produced is audible at a distance in excess of 150 feet. (4). The operation of any automobile, motorcycle, bus, or other vehicle or mechanical device in such a manner so as to produce a sound that is audible at a distance in excess of 150 feet. (Ordinance 031208-6, sec. 1 (96.08), adopted 1/12/04) $1.10.070Use of parks for engaging in enterprise for profit. (a). No agent, servant, or employee of the municipality having supervision orj jurisdiction over any of they various municipally owned parks may rent or allow the use of any of the parks to any person for the purpose of engaging in an enterprise for a profit, except as provided fori in this section, the city's special events ordinance or section1.10.071. (b). This section shall not apply to local civic, religious, and charitable organizations. Such organizations shall make application toi the municipal secretary for the use of any: such park, setting forthi ini the application the name of the organization and its officers, the purpose for which the parki is desired to be used, the length of time and a detailed statement showing the use ofi the revenue derived from the use of the park. Local civic, religious, and charitable organizations having a city area address on file with the Texas Secretary of State, Texas Comptroller or the county central appraisal district. The mayor is hereby given the authority to require at full showing, by documentary evidence ini the application, that any such organization is local in nature and comes underi the above classification as such organizations are generally regarded. Farmers' markets and events requiring a permit under the city's special events ordinance must still comply with such ordinances and regulations. (Ordinance 2014-07-28-01, sec. 3, adopted 7/28/14) 1.10.071Farmers. markets. (a). A1 farmers' market is defined as a single-use event with an area where space is rented to individual vendors who sell fruits, vegetables or plants grown locally by the vendor, or who sell food specialty items such as baked goods, candies, jams, jellies, spices, and condiments produced by the vendor selling such items. No other products may be: sold, including but not limited to potentially hazardous foods that have the tendency to spoil or rotten when not maintained at a specific temperature and that is regulated by the Texas Department of State Health Services, except for arts and crafts products made int the county or contiguous counties not more than 25% oft total vendors, dry goods, domestic pets, livestock, or any other items not specifically allowed by this section. (b). Each farmers' market setting upi in a city park with more: than one vendor shall designate one responsible individual to be the permit holder. The designated individual must file a market permit application at city hall at least two weeks in advance of the date of the farmers' market event. The market permit application fee shall be set forth in the master fee schedule of this code. Ifthei farmers' market event only has one vendor, the permit application requirements still apply, and the application fee shall he: set forth in the master fee schedule of this code. Vendors for a single-vendor farmers market must file a vendor permit application at city hall at least two weeks in advance of the date of the farmers' market event. An application fee may be refunded or an applicant may receive a credit of the application fee for a future farmers' market only if a farmers' market event is cancelled due to inclement weather or other circumstances which prevent the farmers' market event from occurring, only if the permit holder notifies the city that the event was not held on the date set forth in the issued permit within seven (7) days ofi the cancelled event. (1). The market permit holder must provide the city with a complete vendors list that shall be retained by the city for at least ninety (90) day's following the farmers' market event. This list shall include, at a minimum: (A). (B). (C). The name, address, and phone number of each vendor; Al list of the food items offered by vendor for each date operated at the farmers' market; Acopy of any applicable permits held by each vendor, including but not limited to a sales tax certificate and ai food manufacturers license, if applicable; and (D). The general location of each food item's origin, including information on where the food items were grown, cultivated, prepared or otherwise obtained by the vendor. (c). All tasting or sampling of food products shall be strictly prohibited at farmer's markets. (d). Except for plants, nuts int the shell and whole, rawi fruits and vegetables that are intended for hulling, peeling or washing by the consumer before consumption, food on display shall be protected from contamination by use of packaging. Such packaging must be properly labeled to identify ingredients, weight, and otheri information that may be required by state orf federal guidelines. (e). Final authority to modify or deny a permit shall be with the city council. (Ordinance 2014-07-28-01, sec. 4, adopted 7/28/14; Ordinance 2015-12-10-02, sec. 3, adopted 12/10/15) $1.10.072Gas and oil drilling; mining. Its shall be unlawful for any person, firm, entity or corporation to conduct any drilling activity orr mining on the surface of any public park to extract oil, gas, or other minerals or hydrocarbons or to drill an injection well. No well site or related piping or equipment shall be located on or near the surface of any public park. No previously drilled and abandoned well or mine may be reopened in any public park. (Ordinance 2015-03-23-01 adopted 3/23/15) Park propertygenerally: prohibited acts. Except as otherwise expressly provided, no person shall engage in any conduct prohibited by any section of this division, including but not limited to one or more of the following acts, while in or upon park property located within the incorporated limits of the city: (1). (2). To ride, hitch, fasten, lead, drive, or let loose any animal To use, carry or discharge any firearm (except as allowed by state law), firework, air gun, paintball gun, BB gun, slingshot, any manner of propelled weaponry, knife or other similar lethal instruments. (3). To use or operate any model, helicopter, plane, boat, rocket or any radio controlled device except in areas specifically designated for such purposes by the director. (4). To use or operate any motorboat, boat, kayak, canoe or watercraft on the waters of any lake, pond, or stream except in areas specifically designated for such purposes by the director. (5). To damage, cut, break, injure, deface, disturb, mark, write upon, paint, or disturb any tree, shrub, plant, rock, building, monument, fence, bench, or other structure. (6). To plant or place any tree, shrub, plant, rock, building, monument, fence, bench or other structure except in areas specifically designated for such purposes by the director. (7) (8). Tos swim, bathe, wade in or pollute the water of any pond, lake, or stream. To make or kindle ai fire, except in city-installed bar-b-q pits ori in areas specifically designated for such purposes by the director or at at time when a burn-ban has been declared tol be in effect by Grayson as applicable. (9). To discharge any noxious liquid, greywater, or solids on ori into any grounds, ponds, fountains, lakes, or streams. (10). Tol leave litter, garbage, cans, bottles, or other refuse elsewhere than in refuse containers provided for such purpose. (11). To participate or engage in any activity when such activity may cause, create or resulti ina a danger to the public or may be considered a nuisance to other users of park property ora hazard to public safety and welfare. (12). exhibition. (13). To disrupt in any manner any picnic, meeting, service, concert, exercise, event, or To distribute, post, place, or erect any device or document, including without limitation, handbills, signs, circulars, notices, papers, or otheri items displaying a commercial advertisement or otherwise offering goods or services for sale without written permission from the director, or as otherwise allowed by city ordinance or state law. (14). Toi fail or refuse to remove and properly dispose of solid animal waste of pets or other animals brought onto park property. (15). To: sell or offer: for sale any food, drinks, confections, merchandise, or services except as authorized by the city pursuant to an approved written agreement, or by written permission of the director for a city authorized or sponsored special event or when such sale is operated by city. (16). To practice, carry on, conduct, or solicit for any trade, occupation, business, or profession, except when approved, operated or sponsored by the city. (17). To play golf or use or play with golf balls or golf clubs, except when approved, operated or sponsored by the city. (18). Tol bring, carry, transport, or possess a glass container. (19). (20). (21) To possess or consume alcoholic beverages of any kind. Toj play or bet on any game whichi is played, conducted, dealt, or carried on. To operate any amplified device except when operated by the city or when operated as authorized by and in accordance with the parameters established by a special event permit. (22). For any person over the age of six (6) years to use a restroom and/or washroom designated for a member of the opposite sex. (23). To remain in or upon any park property at a time when the park property is closed. Signs indicating hours of operation shall be posted at conspicuous locations to give notice thereof. Hours of operation for park property shall be as follows: Except as otherwise specifically provided herein, all city park property shall be open for use by the public from 6:00 a.m. until 10:00 p.m., unless the use of such park properties has been: scheduled with the city for an athletic use, a special event, or a program, in which case use: shall be restricted to persons engaged in or attending. Vehicular regulations. Except as otherwise expressly provided, no person shall engage in any conduct prohibited by any section of this division, including but not limited to one or more oft thei followingacts, while in or upon park property located within the incorporated limits of the city: (1) Operate a motorized cart at a rate of speed in excess of fifteen (15) miles per hourupona drive, a designated area of a trail, a road or parking lot within or upon park propertyunless such area is otherwise posted. (2). Exhibit or cause any unnecessary acceleration of a vehicle, including but not limited to acceleration or any other action which causes gravel to bei thrown, tires to squeal, or otherwise creates or causes ai threat of injury or damage to persons or property. (3). Operate a vehicle, device, motorized assisted scooter or other motorized device including, but not limited to vehicles known as ATV's anywhere within the playing boundaries ofa sports field. (4). Parki in areas other than those specifically designated for parking or as otherwise authorized by the director. (5). Where parking spaces are marked, all vehicles shall be parked within and between the lines designating a single vehicle parking space and not otherwise in a manner that utilizes more than one parking space. (6). No vehicle shall be parked, stopped, or left standing behind any other vehicle in any location ori in any manneri that will obstruct, block, or hinderi ingress or egress from the line, a parking space, or a parking area. Any vehicle that is parked, stopped, or left in violation of this section may be removed at the owner's expense by a peace officer or by an authorized representative of the cityi ift the owner or operator of the vehicle is noti in control oft the vehicle or cannot be located to remove the obstructing vehicle and the obstruction creates ani immediate hazard or hindrance to thei flow of vehicle. No variation to the requirements oft this section shall be allowed unless specifically authorized in writing by the director. This section is cumulative of remedies authorized by state law for the removal of unauthorized vehicles. (7) Cause or allow either an operable or an inoperable motor vehicle or motorized cartto remain on any parking area for a period of more than twenty-four (24) continuous hours.
