Chairman Burner reminded all commissioners and speakers to please turn on and/or speak into the microphones. Mr. Hahn conducted an attendance roll call. [Susan Kile and Ms. Grech were not present at roll call, but arrived as indicated in the minutes, below.] Adoption of Agenda Mr. Turner made a motion to adopt the agenda as presented. Mr. Adams seconded the motion. Chairman Burner asked all those in favor to signify by saying "aye," and members present all indicated "aye." Chairman Burner stated the agenda was adopted as presented. Citizen Comments on Agenda Items 1. Patricia Long: She apologized for sending them a very lengthy document. It's not really a lot to read; it has al lot of pictures. She sent it this afternoon. She hopes they find the information valuable for their decision-making.. plans and proposals that she thinks will bel helpful for the case. She is grateful above all for the work [the Planning Commission] is doing, and she really hopes the decisions they make are for the betterment of the entire County. She thanked them. 2. William Long: He lives at: 3095 USI HWY211E. Patricia is his wife, and they have been there since 1984. He was going to go into al bunch ofthings tonight, and bring up some facts, but he decided not to that. There are two books in Page, floating around, that are well-written, plenty of photographs. He wonders how many of them know the first gas station for old Model-As. Where was it located? The first toll road between New Market and Sperryville. Where was it located? The first tourist stops and gift shops. Where were they located? When they answer that, het thinks they'll find the answer to this dilemma. Patricia has been doing some work that has amazed him on what could be proposed for Brookside, which he thinks would make Bob and Cece very happy. This is notj just about money. This is about the history of Page. He is sO proud tol be from Page. Hel had no idea until he went through these books what Page represents. The families, what has become of the families through the years, and what continues. Iti is amazing. It is a great place. We need to save it. We need to enhance it. And we need to take 3. Randy Howan: He introduced himself and thanks the Planning Commission. He knows they are looking into the matter more intently. Hej just wants to put out it there that he does whole- heartedly agrees with the need for such a facility. He is not questioning that. He thinks it'sa [Ms. Grech arrived during Ms. Long's comments.] care ofcitizens. He thanked them. Planning Commission Minutes- September: 10, 2024 great thing. The reservation he has is concerning the location. That is just input from one person. He knows there are plenty of options that are available. From listening to other people who have been through rehab, and you look around at things that are going on in society we could definitely use those facilities. Just again, the pause he has is for the proposed location. 4. Cece Castle: She thanked the Planning Commission for their time, attention, and their serious consideration of this. She is a little dumbfounded that we are yet again discussing details that she thought had been addressed. On a personal level, she had invited Mrs. Long for a conversation last week to try to understand and address concerns she might have. On August 29th, [Mrs. Long] asked her for the contact information for the purchaser sO she could ask questions, which [Ms. Castle] gave her, with [the purchaser's] permission. He eagerly welcomed any questions. [Mrs. Long] did not reach out to [the purchaser] in all that time. In their conversations [Mrs. Long] suggested a number of things, which [Mr. Long] had alluded to, including making boutique cabins that sold coach bags, designer sunglasses, and hand-knit shawls that they do in Cancun and Key West. Somewhat preposterous notion, in her mind. However, all that aside, she trusts this body to make a rational and logical decision about what ist best fort the community. On the other comment Mr. Long made: wheyt they bought Brookside, as all of! [those in attendance] may have bought properties, businesses, and private residences, she doesn't know that they committed to maintain them forever in posterity and perpetuity. She finds that a little bit bizarre. Brookside has a history which they have maintained, which she thinks will endure in its buildings and structures. She thanked them for their commitment to He thanked the Planning Commission. the County and the time they devote to these matters. A. Adoption of] Minutes- August 27, 2024 New Business Chairman Burner allowed some time for any necessary changes to be noted. There were no changes. Mr. Turner made ai motion to adopt the minutes as presented. Ms. Grech seconded the motion. Chairman Burner asked all those in favor to signify by saying "aye," and members present all indicated "aye." Chairman Burner stated the minutes were adopted as presented. Unfinished Business A. Brookside Restaurant and Gift Shop, Inc.- Special Use Permit Ms. Clatterbuck stated that after the last meeting, the applicant did: submit some documentation dated September 3, the copy of the Warrenton Woods Facility Emergency Plan which was requested by Commissioner Kile, and some other letters, which theys shouldread iftheyl haven't done so. She stated that today staff1 has received a number ofe emails, letters, and documentation from citizens, which the Planning Commission has received electronically, as well as hard- copies. Shes stated: shei is available for questions. Mr.Janney is present, and one of the applicants Mr. Hahn noted that staffl has consulted with the County Attorney about language to add to the draft conditions related to the preclusion of violent felons. That language is still actively being worked on, including in the last hour. We don't have a draft condition to recommend to the Planning Commission at this time. For that reason, he would ask that we discuss any matters related to this fully, but hold off a vote on this until at least the next meeting sO that staff can is on thej phone, as well. bring this condition back, property vetted. Page 2of6 Planning Commission Minutes- September10,2 2024 Chairman Burner asked for discussion by Commission members. Ms. Grech thinks it is very important that we have the conditions before we take a vote. We have received a lot of comments, and although they received them by email, al lot ofthem came in this afternoon. She thinks they owe it to them until they have read them, and digested them, out of respect for the work they have done. She would like to say that some of those comments, not necessarily the ones that have come in today, but generally, have surprised her. Some oft them have dismayed her. She sees al lot ofthings that are stated there that may or may not be factual. She is going to research everys single one of them. She wanted the public know that shel has visited the facility, personally, like she does with every application that comes before this board. They have spent ak lot oftime looking into this - many meetings. Ms. Grech made a motion to table this matter until the next meeting SO they can review all ofthe documentation that has been submitted and Chairman Burner asked Mr. Adams and Mr. Turner for comments. Mr. Adams stated he wasn't sure ift this was the right time to bring up a couple conditions ift this SUP does pass. The first one might sound a little insensitive. Since he was absent last meeting, he did go through the meeting minutes, and he watched the video, twice. He knows the applicant mentioned privacy screening/tencing. He would like a condition in there to require security fencing, and maybe possible screening. He realizes that patients aren't prisoners, but throughout the documentation and the notes that he has read, they say the patients will be required to be on site 24-7. He is curious ifany condition could be brought up he thinks there was one incident with the three sites for EMS, and he's not talking a medical incident, but maybe police-related - but ift there are any incidents that are off-site with a patient that are polite/Sherif-related, possible revocation of the SUP. He doesn't know how to word that, but he' d like to see something like Mr. Hahn referenced the motion that had been made. Chairman Burner asked if there was a second on the motion to table this matter. Mr. Turner seconded the motion. Chairman asked if there was any other further discussion. Ms. Clatterbuck asked for clarification on possible wording oft the condition with the privacy screening and fencing. Mr. Adams stated that there was a difference between a privacy fence and as security fence. Ms. Clatterbuck asked ifhe had al height in mind. Mr. Adams suggested 6 or 8 feet, but stated he would like to hear other opinions on it. He just thinks fencing is needed to protect the patients and protect the high- traffic area. Ifthis does get approved, he'dl like to have something like that inj place. Chairman Burners stated that a minimum 8 ft. would probably cover people walking around, ifthey wanted that. Mr. Adams would like to hear other opinions, because maybe he's thinking too fari into it. Mr. Hahn stated that ini response that, it may be appropriate to ask the applicant what measures ofs security they intend to have, and then the Planning Commission can assess what mitigation would bei required based on that level of security. As far as building ai fence, there is ai trade-of there with the character of that area. He thinks the applicant had indicated they weren't going to put up fencing or signage that would advertise that there was a rehabilitation center. Ifyou put up: an 8 ft. tall fence that looks like security fencing keeping people in, that is going to look like a rehabilitation center or a prison. He recommended they see what security measures are inj place, and then the Commission can assess that. Mr. Adams expressed agreement. Ms. Grech stated she thinks this is a terrible idea. It sends the wrong message. This is a rehab center. It isn't a prison. When she visited the site, she asked the applicant whether they were get the answers they need from legal. that in there. Page 3of6 Planning Commission Minutes- September 10, 2024 going to put in a few bushes and landscape the grassy area here for a little privacy for the neighbors and for their facility, but they did not discuss a fence, and she doesn't think it isa good idea at all. That is a misunderstanding oft the nature oft the facility, in her opinion. Chairman Burner stated that aj privacy fence, at true chain link fence, het thinks is a little overkill. He would be comfortable with some vegetative screening there. Having a security fence there would probably do more damage to the aesthetics of the surrounding environment. Having privacy screening that shields the view and doesn't provide as many places to walk out. Mr. Adams stated he should have probably asked the applicant what are the odds ofs somebody leaving the property. Has that ever happened in the past? Ms. Clatterbuck asked Michael Rothstein ifhe was still available over the phone. Mr. Rothstein asked ifhe could be heard, and Ms. Clatterbuck confirmed. Mr. Rothstein stated that ifa client was leaving the facility in an unplanned circumstance, meaning they haven't graduated and they are leaving, they don't allow them to walk off property. They are transported to a safe location. So, if they are going to another facility, they are transported there. Ift they are going home, they are transported to their home. The clients are not allowed to grab their belongings and just walk off property. Anyone whoi is leaving- itisc called. AMA or ACA, Against Medical Advice or Against Clinical Advice, meaning they haven't completed their treatment protocol. Anyone who leaves earlier than advised by clinical staff, they provide transport to a safe location, whether that is a center oft their choosing or back home. They are not allowed toj just walk off property by themselves. Mr. Adams asked ift they have ever had any incidents where someone has just disappeared. Mr. Rothstein answered that they have not. They have had instances they have called family members or someone to pick them up. They have security measures, including bedroom checks in the evening, multiple times throughout the night. They've never had it happen where they Mr. Rothstein stated that as far as security measures, he referenced security cameras. He stated they are open to feedback regarding limiting some ofthe access points that may be of concern to the community, and any privacy screening that has been mentioned, they are 100 percent on board with for the privacy of their clients and also to limit those access points. Mr. Adams apologized that the security fencing sounded a little insensitive, but he's also thinking about Ms. Grech asked, regarding the question that is in front of legal, were we trying to work out language to preclude sex offenders and violent offenders. Ms. Clatterbuck stated this was correct, and the third piece was the court-ordered clients. However, we do have a definitive answer that we cannot include court-ordered into that condition because that treads into the Fair Housing Act. Ms. Grech stated that at this point it does look like we will have language in the conditions to preclude the types of offenders that would need a fence, meaning violent offenders and sex offenders. Ms. Clatterbuck agreed. Ms. Grech asked why we would need a fence. Mr. Hahn noted that they were just working out the exact language regarding what state Chairman Burner asked ifthere were any other questions, and there were. none. He asked fora roll call vote on the motion on the table. The motion to table the item until the next meeting have done al bedroom check and there is a client missing from their bed. the safety of the patients. Zoning Ordinance Amendments: Non-conyentional Dwellings Ms. Clatterbuck noted that the document had changed a little bit since it was last presented at the last meeting. There was lengthy discussion about the definitions and proposed uses in the document. The Planning Commission directed staff to work on a draft that combines the definitions for yurts and domes, perhaps with language regarding temporary material like canvas, and limit them to campgrounds. Staffwas also directed to remove the definition oftree homes and not differentiate them from single-family dwellings. There was also discussion on tiny homes, and staffwas directed to work on the definition and seei ifit was possible treat them differently in residential subdivisions. [Ms. Kile arrived during this discussion.] C. Zoning Subcommittee Report Ms. Grech stated the subcommittee has met a couple times, and they find themselves taking a much closer look at site plans -1 the definition and when and how we want to apply new: rules. That is not in the current code. Staff has been tasked to look at some new rules. They are meeting next week. Mr. Hahn stated they are: finalizing the date, but it looks like it will bet the following Tuesday at 4 p.m. D. Comprehensive Plan Subcommittee Report Mr. Hahn stated they will have thei first subcommittee meeting this Thursday at 6 p.m. We have the full list of the subcommittee members, but he invited anybody from the community to be in the audience, as well. It will be fairly informal. Ms. Grech and Ms. Kile are on that The first speaker signed up to speak was Patricia Long. She wasn't present, but someone from the audience indicated she would be right back. Chairman Burner stated that we could hold her spot until the end, but Mr. Hahn stated: she was the onlys speaker. Mr. Long requested that he be allowed 1. William Long: He can tell they have a lot they are dealing with. The terminology ofy yurts. But criminal [not audible] really concerns him, being a neighbor this close. And not seeing other neighbors that he has spoken to here, voicing how they feel, in person.. Gentleman Adams questioning about the fencei is high on everybody's priority list. When aj patient isi int there, they dol have the right tol leave. They are debriefed, and they are brought out. Ifyou do your research, you'll find this - they're told that their meds are wrong, they'll bring down their anxiety, give this a second chance. But the patient can opt to say they are going out that second door, and they are going to tell them face-to-face, here is your cell phone, but when you. hit that highway there is going to be a deputy waiting. But if they are clean, they can start hitch-hiking. You have two entrances in, and two entrances out for protection from fire and things ofthat nature. But are we talking luxuryrehab, or are we talking criminal. How many oft them are in there for the felony part, or the criminal parts is really his concern. He appreciates their situation. He appreciates that they take their time to researchi it. He stated they gave him an extra second last time to read the last sentence out of. John Hopkins' study: Take the patience, the resources, and thet time to talk and talk to: your community on the placement ofthese facilities. Het thanked the 2. Patricia Long: She thanked the Commission. Tonight we heard from Mr. Silverman, and we also heard Mr. Rothstein, on the phone. She would like to reiterate that what her husband says is true: we! hear that they are not going to be court-mandated cases. They are, going to come out subcommittee. So, out of their own will they can leave. She really appreciates the thought ofa fence. She noted that Ms. Grech was going to go and visit the facility. She extends the invitation for her to come and visit her home, why she is fearful, how vulnerable she is, all of the equipment and material that they have to run her business. Everything is in jeopardy and on the line. She thanked [Mr. Adams] for saying what he said about thei fence. That shows you are notj just thinking about the wellbeing of the patients - people who are coming from another area, not our patients = but thank you for thinking about the safety of neighbors. We matter. Her equipment, her investments matter. It is a shame that Cece does not appreciate the enthusiasm that she shared with her. This community has always supported her business. Through their cabins, she has always sent people tol her restaurant for breakfast before they go home. She can see that [Mrs. Castle] sees her comments as nonsense. They are not. She really ise enthusiastic that given the right amount of time and the right marketing, then we can really find al better solution for this dilemma. She does believe that since the patients are free to walk in-a also, she thinks they are telling us what we want tol hear, because honestly the do want this facility. But there have been crimes committed by people who have escaped facilities, obviously in larger cities. She is going to dol her investigation and send them that, as well-s she has sent them the valuation of property, crime rises, and other things she sent in the 40-some- page document. She hopes they take the time to read it. She has her best, best wishes for Mrs. Castle, but the best, best wishes for her well-being and the entire community of Page County. This is what matters to us. This is her home. She is going to fight for her home. She is going to fight for her community, with a clean, good, open citizenship. She wants to give them the respect they deserve, but she also is going to put more work into the matter sO she can share more information with them. She thanked them - she really appreciates them.
