The Town ofNew Market 1793 Town Council Minutes General Session August 8, 2024- 7:00 p.m. 40 South Alley, New Market, MD 21774 The Mayor and Council of the Town of New Market met in person and virtually via Zoom on Thursday, August 8, 2024, with Mayor Winslow Burhans presiding. Council members present were. Dennis Kimble (via Zoom), Matt Chance, Shane Rossman (via Zoom), Chris Weatherly (via Zoom), and Michael Wright. Pat Faux, Zoning Administrator/Iown Planner; Chris Goettge, The Faux Group; Shawn Burnett and Erica Adamski, Wilson T. Ballard; Steve Pippin, President, NMCP; and Debra Butler, Clerk-Treasurer (via Zoom), were also present. Motion: Councilman Wright made a Motion authorizing the Mayor to sign the MOU, provided we receive a satisfactory answer to Councilman Chance's question, "Would the contract policies bind us regardless of whether we apply for money or not?" The Mayor volunteered to put the road closure signs up. NM District Volunteer Fire Company Request for Parking - August 17,2024 On behalfoft the NM District Volunteer Fire Company, Wayne Harris requested parking on Town property for the Fire Department's event on August 17, 2024. He also asked that the permit application fee of $85 be waived. Councilman Weatherly requested an MOU between the Town and the Fire Department SO that the Town can use the parking area at the Fire Department for future events. Motion: Councilman Chance made a Motion to Approve the permit with the caveat that Councilman Wright Walk the property 24 hours prior with Wayne Harris to determine ifthe lot is okay to park on, that the Fire Department submit a COI, and that there is protection around the well and picnic tables, and that the application fee be waived Councilman Weatherly Katie Russell, Howard Wilson For-3 (Chance, Kimble, Weatherly) Against -1 1( (Rossman) Abstain - 1 (Wright) Absent-0 The Motion passed. Second: Public Comment: Vote: Forest Protection Concept- 100 Acre Woods Tom Poss of Verdant Development Group presented a proposal to create Forest Conservation Easements in the park in selected areas outside the current LOUYAA lease area. The chosen areas include mature forested areas in environmentally sensitive areas with steep slopes and stream valley buffers. This proposal is being offered both as ai mitigation measure in the draft Preliminary Forest Conservation Plan (PFCP) prepared for the E Main Street TRC development project and as af forest conservation bank that others could utilize. Mr. Burnett stated that establishing a Forest Conservation bank would require changing the current Forest Conservation Ordinance. By unanimous consent, the Council decided toj pursue this concept. Public Comment: Howard Wilson Remediation ofTown Hall - 40 South Alley Due to the water leak at Town Hall before the Town Council meeting, this discussion shall be continued. Mayoral Initials: Town Council Minutes August 8, 2024 Page 4 of5 Glo-Fiber Notification Mayor Burhans discussed the possibility ofhaving Mr. Lederer, Esquire, specializing in franchise agreements, come and discuss the franchise agreement in a closed session. By unanimous consent, the council agreed that Mr. Wantz should contact Glo-Fiber and Mr. Lederer to attend a future Establishment of an Interview Committee for the Main Street Program Manager Mayor Burhans discussed establishing an Interview Committee for the Main Street Program Manager. Councilman Chance stated that he does not think a committee is needed, that each council member needs to take the time to meet with the businesses to understand what they are looking for, and that the Council and the Mayor should do the interviews. Councilman Weatherly would like to make sure that the Main Street Program Manager knows who to report to and that there needs to be constant communication with the Council. The Council agreed to have a meeting at Glo-Fiber'se expense. roundtable with the businesses and proceed with scheduling interviews. LIAISON REPORTS Councilman Weatherly reported on regional news for Baltimore, Frederick, and Carroll Counties. The transmission operator, PGM, has awarded a contract to PSEG, a company out ofNew. Jersey, to build transmission lines from Baltimore County running west through Frederick County to accommodate the large electrical needs of the data center to be constructed in Frederick County. He and the Mayor attended a meeting at Linganore High School last week. Large power linescould run through the Town, particularly in England Woods, between Gaver farms and behind Food Lion. They would be visible from the Town. There is a Facebook page called "STOP MPRP Community Group." Public Comment: Howard Wilson Councilman Rossman requested that edits to the 2016 Master Plan be added to the next agenda. Councilman Chance said this came up at the Planning and Commission meeting. Councilman Chance said he would recuse himselffrom any vote.
