QUEEN ANNE'S COUNTY PLANNING COMMISSION MINUTES June 13, 2024 The Queen Anne's County Planning Commission met on Thursday, June 13, 2024, at 8:45 A.M. The following members were present: Sharon Dobson, Tom Leigh, Teddy Baker, Kathy Deoudes, and Bill Sylvester. Also present were. Amy Moredock, Director Department of Planning and Zoning; Rob Gunter, Development Review Principal Planner; Stephanie Jones, Long Range Principal Planner; Steve Johnson, Development Review Planner; Doug Summers, Development Review Planner; Sam Stanton, GIS Coordinator; John Shelton, Clerk; and Sharon Brinster, Esquire. 1.Public Comment - No comments received 2. Meeting Minutes Review - Upon motion made by Commissioner Leigh, seconded by Commissioner Deoudes and passed by voice vote, the May 9, 2024 Planning Commission Minutes were approved as presented. 3. Extension Requests - None. 4. UPDATES: (A)Legislation and Legal Matters - Ms. Amy Moredock, Planning and Zoning (1) Maryland Accessory Dwelling Unit Task Force - the final report was rendered which she summarized to include 4 recommended items to pursue legislation and 2 recommended item to provide guidance. (2) Solar Solutions Workgroup this is a collaborative group led by Power Plant Research Program staff, working to develop solar legislation that will be successful in creating middle ground between preemption and local (3) Maryland Association of Floodplain and Stormwater Managers - hosted a field tour of Smith Island in collaboration with the Virginia Floodplain Managers Association focusing on the impacts of at sea level (a) Zoning Inspectors - Bill Baum has been hired and will be starting on June 20, 2024. Robert Owen will be on military leave for one year starting June 21, 2024. B)Miscellaneous Staff Items = Stephanie Jones, Long Range Planner presented (1) Non-water Dependent Structures on Piers = County Ordinance #24-01 was approved by the County Commissioners and will become effective June (2) 2023 Queen Anne's County Department of Planning and Zoning Annual Report- - After presentation, the following motion was made by Commissioner Deoudes, seconded by Commissioner Sylvester, and passed the following: 29, 2024. by unanimous voice vote: RESOLVED, that the Planning Commission makes a favorable recommendation to submit the proposed 2023 Planning and Zoning Annual Report to the Maryland Department of Planning. (3) Update of Critical Area Modified Buffer Area (MBA) Maps - Along with Sam Stanton, GIS Coordinator, administrative corrections to the Critical Area Modified Buffer Area was completed to align the existing mapped area along The Planning Commission recessed for a short break at 9:20. SP#23-03-0101 - Sharon Brinster, Acting Planning Commission Attorney, read the Notice of Public Hearing and informed the Planning Commission that she was satisfied the notice requirements have been met to hold a Public Hearing to receive comments concerning a conditional use application for a proposed 31.1 acre expansion of the existing sand and gravel major extraction operation located on the south side of Grange Hall Road, south and west of Whitby Lane which was submitted by David A. Bramble, Inc. Steve Johnson, Senior Planner, provided the highlights of the applicant's request for Concept Plan approval and a favorable recommendation to the Board of Appeals to administratively combine three parcels for a 31.1-acre expansion of an existing major extraction operation in the Agricultural Zoning District. Kevin Shearon, DMS & Associates, described the Administrative Subdivision and on site operation of the existing and future extraction operation. Megan Bramble Owings, applicant, described the pit history and lot purchase. Jonathan Ferdinand, Vibra-Tech, provided a summary of the sound study. Chairman Dobson opened the Public Hearing for comment and received comments from the following: 2 (1) Alana Haddox - expressed concerns regarding noise, dust, and the hours and (2) Sue Haddox - agreed with the concerns expressed by Alana Haddox and said that she met with the applicant prior to the meeting and have reached agreement tor meet further and work together on noise, dust, night noise, and smell. Upon review and further consideration, the following motion was made by Commissioner Deoudes, amended by Commissioner Leigh, amendment and entire motion were seconded by Commission Sylvester and passed by unanimous voice vote: overall length of the operation. RESOLVED, that the Planning Commission, regarding the request by David A. Bramble, Inc. for Concept Plan approval for a 31.1-acre expansion of an existing major extraction operation in the Agricultural zoning district, which isr more particularly described in Planning & Zoning file SP- 23-03-0101, hereby finds: (1) the Concept Plan is consistent with the goals and objectives of the Queen Anne's County Zoning & Subdivision Regulations and the 2022 Comprehensive Plan, (2) the project is located within the Agricultural zoning district; one of the intensions of the district is to preserve and protect the areas of the county that are predominately in agricultural use, (3) In accordance with $18:1-14.C.(7), major extraction is a conditional use in the Agricultural district, (4) the operation complies with the following required mining setbacks: 50 feet from any property line, 125 feet from any street, and 200 feet from any residential or commercial district boundary line, (5) Environmental Health has approved the use of off-site restroom facilities by the employees of the operation at a nearby asphalt plant owned by the applicant, (6) the noise generated by the use will not exceed residential noise daytime limits of 65 dBA at the property line as required by state code (COMAR), and (7) the proposed stormwater management has been reviewed and approved by the Department of Public Works, and hereby grants Concept Plan approval subject to the following conditions: (1)p proper controls and methods are maintained to minimize truck "mud" tracking or dust plumes in dry times with wind drift suppression, (2) the facilities must be adequately designed and maintained to free dirt and debris from the wheels and undercarriage of trucks prior to entering Grange Hall Road, (3)a all Soil Conservation District approvals are maintained, (4) any changes in the hours of mining operations will require additional approvals, (5) all landscaping required shall be maintained to assure plantings remain alive and healthy during the operation period and the applicant shall 3 provide a cash deposit, surety bond, or letter of credit for all landscaping, (6) Haul trucks shall adhere to the approved haul route as discussed and presented, (7) Material storage piles cannot exceed 45' in height, (8) the applicant shall work with staff to determine whether an as-built report update or annual reclamation report is sufficient, (9) the applicant agrees to an annual inspection, (10) all State permits are in place prior to final permitting by Queen Anne's County, (11) any legal documents are reviewed and approved by the Planning Commission Attorney, (12) any future mining phases or changes to the end use plan must return to the Planning Commission for a recommendation to the Board of Appeals for an amendment to the conditional use, (13) any and all financial sureties for reclamation, landscaping, stormwater management, and enforcement, etc., are in place before final permits are granted, (14) there shall be no truck parking on Grange Hall Road, no stacking or parking outside of the gate, no Jake brakes, and no tailgate slamming either on site or on the public road and the applicant shall post a sign with a notice regarding these restrictions, (15) any requirements by the Queen Anne's County Roads Department must be satisfactorily addressed, (16) per the Department of Environmental Health, employees are to utilize off-site restroom facilities at the nearby asphalt plant owned by the applicant; should a scale house be constructed in the future, an approved sewage reserve area and on-site restroom facilities will be required, (17) the administrative subdivision must be approved and recorded prior to permit approval, and (18) any outstanding documentation or comments stemming from agency reviews are addressed prior to permitting. Upon further review the following motion was made by Commissioner Deoudes, seconded by Commissioner Leigh and passed by unanimous voice vote: RESOLVED, that the Planning Commission, regarding the request by David A. Bramble, Inc., for a 31.1-acre expansion of an existing major extraction operation in the Agricultural zoning district, which is more particularly described in Planning & Zoning file SP-23-03-0101, hereby forwards a favorable recommendation to the Board of Appeals under Sections 18:1-14.C.(7) and 18:1-95.E. 7.Public Comment- None.
