TOWN OF MOUNTAIN VIEW REGULAR TOWN COUNCIL MEETING April 15, 2024 MINUTES Note: This Meeting Agenda started at agenda item number six (6) because the meeting followed a Workshop Meeting which contained agenda items one (1) through five (5). No meeting minutes are created for workshop meetings. 6. Call to Order Mayor Mitcham called the meeting to order at 7:45 p.m. in Town Hall, 4176 Benton Street, Mountain View, Colorado. 7. Roll Call Present: Mayor Emilie Mitcham, Council Member Leal Algiene, Mayor Pro Tem Kathleen Bailey, Council Member Sean Davis, Council Member Laura Dennis, Council Member Brittany Loecher, and Council Member Brent Metz. A Quorum was established. Staff in attendance: Town Administrator John Beltrone, Interim Town Clerk Amanda McLaughlin, Town Attorney Austin Pierce Flanagan, Police Chief Michael Nesbitt, Public Works Coordinator David Nugent. 8. Pledge of Allegiance 9. Agenda Approval Those present stood and recited the Pledge of Allegiance. Mayor Pro Tem Bailey made a motion to approve the Agenda. Itwas seconded. The Agenda was approved by unanimous consent. 10. Interview - Board of Adjustment and Appeals Mayor Mitcham introduced the applicant for the Board of Adjustment and Appeals, Catherine Colwell, who was applying for the vacancy. Mayor Mitcham stated the vacancy was created because Lee Robinson had moved out of Town and was thereby no longer able to serve on the Board. She stated the position had been posted on the Mayor Mitcham gave the floor to each Council Member in turn to ask questions of the applicant. Council asked about the reasons for Ms. Colwell's interest in serving, her ability to be fair and apply the rules, avoid making decisions based on her own feelings, and her prior experiences of serving on the board. Ms. Colwell answered Council's questions and was also given an opportunity to ask her own questions. Ms. Colwell asked when the term for the position ended, and Mayor Mitcham clarified that it was serving out the term of vacant position and would expire in May of 2025. website, on the bulletin boards in Town, as well as in the Gazette. Resolution No. 2024-4-15A - A Resolution of the Town of Mountain View, Colorado Appointing Catherine Colwell to the Board of Adjustment and Appeals Mayor Pro Tem Bailey made a motion to approve Resolution No. 2024-4-15A. Itwas Mayor Mitcham and Council thanked Ms. Colwell for her application. They expressed their appreciation for her continued engagement in the work of running a small town. The resolution passed by unanimous consent and Ms. Colwell was sworn in by Interim 12. Resolution No. 2024-4-15B - A Resolution of the Town of Mountain View, Colorado Appointing Judge Charles Peters as the Town of Mountain View Associate Mayor Pro Tem Bailey made a motion to approve Resolution No. 2024-4-15B. Itv was Administrator Beltrone introduced and described the reasons for the agenda item. seconded. There were no objections to the appointment. Town Clerk McLaughlin. Municipal Judge seconded. Council had no questions and expressed general support. The motion was adopted unanimously via a voice vote. 13. First Reading- Ordinance No. 2024-4-15A - An Ordinance of the Town of Mountain View, Colorado Amending Section 6.08.020 of the Mountain View Municipal Mayor Pro Tem Bailey made a motion to approve Resolution No. 2024-4-15B. Itwas Mayor Mitcham left the room due to her conflict of interest on the matter and gave the Mayor Pro Tem Bailey described the reasons for bringing the change to the floor, stating that staff believed Council's original intent regarding the two types of Short-Term Rental (STR) licenses was to allow for slightly less regulation if the applicant, or another permanent resident who could manage the STR, lived on the property where the STR was being run. But the definition that was adopted allowed for less regulation if any permanent resident lived on the same property, regardless of whether or not they had any responsibility for managing the STR. Council agreed the reason for a Type 1 license having less requirements for the application were because it was presumed that the permanent resident was also someone who was responsible for managing the STR. Mayor Pro Tem Bailey summarized the clarification was necessary and consistent with their original intent. this back to Council for clarification. The motion was adopted unanimously via a roll call vote. 14. Town Administrator Trial Period Performance Evaluation Mayor Mitcham summarized the agenda item by stating that Council had hired Administrator Beltrone with a three-month probation period. Being that it is nearing the end of that three-month period, she wanted to recognize that Council was likely in agreement that Administrator Beltrone has been a good fit for the Town and she believed that everyone will want to continue Administrator Beltrone's employment past this probation period. Council agreed unanimously and expressed support for Administrator Beltrone. Mitcham suggested that the annual review for the Town Administrator be handled in Executive Session at a later date, due to the fact that it is personnel related and should Mayor Pro Tem Bailey made a motion to continue the employment of the Town be more confidential. Town Administrator Administrator Beltrone thanked everyone for the last three months and said he appreciates the opportunity. He reported on staff's recent workload, including the work to finalize the Comprehensive Plan, onboard Judge Jonson, get ready for an upcoming trial, and recover from the recent windstorm. Town Council Regular Meeting Draft Minutes 04/15/24 Page 3of7 Administrator Beltrone highlighted the work of Court Clerk Vicki Wilcox for her court-related work, and also thanked Public Works staff for their efforts to clean up after the recent windstorm. He stated that the windstorm brought very little damage to the Town, compared to some neighboring municipalities, and he recognized Council's support for trees in Town and Public Works' consistent effort to keep trees healthy had a positive and direct impact on the Administrator Beltrone also shared some information about the state legislature bills related to STRS and land use decisions, and their potential future impact on Mountain View. He then reviewed a conditional use permit that was administratively approved. He discussed reasons for adopting a fee for a conditional use permit application, as well as the process for approving the conditional use, and Council's right to call up the decision and reconsider Mayor Mitcham stated that in this case the decision was non-controversial and did not lack clarity. Administrator Beltrone agreed and stated that had it been less clear, he could have referred the decision to Council for consideration. The Town Attorney concurred and stated the current code language could be improved by simply updating the timeline for Council to community. it, should they wish to do SO. consider the approval. B. Public Works Department Public Works Coordinator shared the process for bringing Code Enforcement back in-house and stated the Town will be ready to handle this instead of contracting with SafeBuilt, beginning in May. He also shared the work he's been doing to look into the lead pipe replacement questions community members and Council have had, and said Public Works will continue to try to get to the bottom ofi it and have answers and a timeline for the Town to have the necessary pipes replaced. And lastly, he asked Council to let community members know that if they have sprinkler repairs that need to be done, due to them being broken in the process of the curb and gutter work, to let Public Council asked if there were any trends with the recycling improvements due tor notices Summit was leaving when recycling was not done properly. Coordinator Nugent stated that previously, there had regularly been 151 to2 20 carts that would need to get put into the landfill instead of recycled, and his understanding was that it was now down to about 4 or 5 carts each time. He said he is looking at the households that are not responsive to the message to see if perhaps they would like to get rid of their recycling bin and exchange Works know sO it can get on the schedule. C. Town Clerk Interim Clerk McLaughlin reported on her workload. She shared several projects she's been working on with Administrator Beltrone, as well as with the Town accountant and the accounting system. She stated she wants to get through the utility audit before she sends out the next quarterly bills, sO that mailing addresses are correct, and the billing is correct for each property. Clerk McLaughlin also stated that she is learning more about liquor licensing as well as how to do the minutes. She said she hopes to get caught up with the minutes soon. D. Police Department Chief Nesbitt reviewed the report in the packet and shared some additional details regarding traffic enforcement and training over the last three to four months. He recognized Sgt. Berhman who was present for this portion of the meeting, and who then spoke to the different specific trainings that officers have been doing. The entire department was able to go to a Search and Seizure course, all of the officers will be getting Rifle-certified and trained on Less Lethal Force. Many of the officers are getting additional training to support their Driving Under the Influence (DUI) enforcement. Two of the officers will be attending an upcoming Women in Law Enforcement conference. Chief Nesbitt thanked Sgt. Behrman and said a lot of the training isc covered by scholarships and grants. He stated he was very proud of the Mayor Mitcham said it was especially noteworthy that this level of training was happening while the Town was still being policed well, with two officers on the schedule most of the time. She stated that she hears a lot of appreciation from the community for the traffic enforcement at intersections inside Town, Council asked about the change of seasons and if the crime statistics change with the season. Chief Nesbitt said that general crime increases in the Spring and Summer months. Council expressed appreciation for the work of the Police Department, especially for the traffic enforcement in Town. Mayor's Report Mayor Mitcham shared that she attended Sarah Albright's celebration of life recently. Ms. Albright was the Town Clerk in Mountain View for many years, before she passed away recently, Mayor Mitcham said. She stated it was a very moving event, and she was glad to have the opportunity to pay her respects and represent the Town at the celebration of life. She shared some photos on social media and encouraged people to view them. Mayor Mitcham also shared information about a recent tour of a modular home factory and stated that this is one potential way to help reduce the cost of housing. She said she was very impressed with the work being done. The statewide push to increase broadly affordable housing, as well as the Prop 123 funding that the Town is opting into, makes looking at modular homes something that the Town should consider, and that she'd like to have that conversation at a future date. B. Events Committee Council Member Loecher shared the work Council Member Dennis, and she had been doing to organize supplies for events, have music for Taco Tuesdays, and allow people to sell their arts and crafts at the Taco Tuesday events. Council Member Loecher also suggested a future volunteer event as something to consider. C. Finance Committee Council Member Davis stated that the report was in the packet and that he is working to meet with Administrator Beltrone about the committee goals. Mayor Pro Tem Bailey said the committee did not meet this month. Council Member Metz said that the committee is in a holding pattern. D. Historical Mountain View Committee E. Town Hall Remodel Committee 18. Future Agenda Schedule Administrator Beltrone discussed the effort to have traffic engineers weigh in on the vision triangle issues. He also reviewed all future agenda items and asked Council to add any updates.
