The Pledge of Allegiance followed. AGENDA AMENDMENTS: None. COMMISSIONER DISCLOSURES: Pursuant to Code of Virginia 2.2-3708.3 and Town of] Purcellville Resolution 21-06-06, Mr. Neham has requested toj participate in this meeting by electronic communication from aj remote location that is not open to the public. Due to ai medical condition, Mr. Neham will be participating int this meeting remotely from his home. As required by law, a physical quorum of the Planning Commission is present ini the Council Chambers, and Town Staffhave arranged for the voice ofMr. Neham to be heard by all persons in the Council Chambers. Mr. Neham made the request within the timeframe required by policy and the Town Attorney has determined that his request meets the requirements for remote participation. The Planning Commission will record in its minutes the reason for Mr. Neham's remote participation and the location from which he participated. CITIZEN COMMENTS: DISCUSSION ITEMS: None. 5.a Review of the Draft Zoning Ordinance 1Page The Commissioners took turns reviewing the draft and making final edits to their Zoning Ordinance draft. Commissioner Ogelman made the following motion: Imove that we. leave the draft Zoning Ordinance as we. had agreed in our straw votes earlier and remove duplex from single family detached areas, and have it only be an option in single family attached areas. Commissioner Green seconded the motion. Ogelman: Aye, Rise: Absent) (Carried 5-1-2 Absent, Forbes: Absent, Neham: Aye, Bertaut: Aye, Brown: Nay, Green: Aye, During his time to speak, Commissioner Green stated that all references to PDH should be removed from the document and added to the appendix. He also submitted minor edits to the definitions section. Commissioner Brown had no more edits. Council Liaison Bertaut had minor grammatical edits tol be corrected. Commissioner Rise deferred to Director Wilkes to summarize the agreed upon inclusion oft the Floodplain Overlay District into Article 4 oft the Ordinance draft rather than making it a separate Article. CLOSED SESSION: Vice Chair Neham made the following motion: As authorized under 2.2-3711(A)8) oft the Code of Virginia that Planning Commission convene in a closed meeting for consultation with legal counsel regarding specific legal matters requiring the provision ofl legal advice by such counsel regarding the Zoning Ordinance and Zoning Map. The following are: requested to attend the closed session: 1) All Planning Commissioners 2) Jim Meizanis, Town Attorney 3) Jordan Andrews, Plamner Council Liaison Bertaut seconded the motion. (Carried 6-0-1 Absent, Forbes: Absent, Neham: Aye, Bertaut: Aye, Brown: Aye, Green: Aye, Ogelman: Aye, Rise: Aye) The Commission went into closed session. ACTIONI ITEMS: 7.a Voting on the Zoning Ordinance Draft for the Public Hearing Commissioner Ogelman made the following motion: Imove to recommend the Zoning draft presented at the. July 10, 2024 Planning Commission meeting together with the zoning map to move forward with a public hearing as written and amended during the July 10, 2024 planning meeting. Council Liaison Bertaut seconded the motion.
