Minor Subdivision, Preliminary Certified Survey Map Petition for Modification of Subdivision Ordinance Application, Application for A petition for modification of the subdivision ordinance is being petitioned for the proposed reconfiguration of the existing lots resulting with one of the lots not meeting the minimum lot width. Prior to recording of the proposed Certified Survey Map, the survey would need to be reviewed and approved by Lincoln County Land The landowner is requesting to reconfigure the existing lots to facilitate one of the lots to have water frontage and the other neighboring lot adequate area for a new garage. The proposed reconfiguration does not create any additional lots, but the CSM indicates that one lot will not meet the minimum lot width requirement as Services (zoning, survey and real property lister). defined in ordinance. STAFF ANALYSIS What aspect of the Subdivision Ordinance would be compromised by this request? Staff analysis: Section 18.7.08(1) of Lincoln County Ordinances requires newl lots and reconfigured lots to still contain the minimum zoning district lot dimensions regarding area, width, and public road frontage. The proposed reconfiguration would result in the lot width being smalleri than the minimum RR2 lot width of 130' in portions of the lot as defined by ordinance. The applicants have achieved meeting the minimum lota area and also the minimum 30' of lot frontage on a public roadway for both lots. What features of the property prevent compliance with the required standards? Staff analysis: The proposed lot configuration does not allow for the required lot width because of the proposed lot configuration around the existing dwelling development pattern of irregular shaped parcels along the shores of Lake Alice. GEURTS-STAFF REPORT 9/12/2024 PAGE10F3 How does the request provide an alternative method of protecting public health, safety and welfare and uphold Staff analysis: The proposed subdivision of the existing lot does not appear to, ori intensify any impact to public health, safety and welfare, and will still uphold the intent of the ordinance to create orderly the intent of the ordinance? development of lots.
